Unpaid Dues and closing of Company

I have a contract with the Company for two years and due to insufficient funds they claim that they have to close the company. I have not been paid for the last two months, my salary being 1.5 Lacs per month, I work as a National Sales Manager. The contract has a three months notice period either ways.They have given nothing in writing but meet me on a weekly basis to give me an up date as they are looking for an Invester. During the last meeting they sais that they are still loking for funds to pay me but if I wish I can go ahead and file a Summary Suit. Do advice as to what steps can be taken moving forward?

our two employees attained age of 62 years, (crossed age of 58 and we were unaware) p.f. deducted for last 6 years. how to settle their a/c and case for withdrawal both are alive & left the service in april'11. kindly advice & oblige.

Dear Sir,
i am working as radiographer tutor in an institute that was earlier under the punjab health corporation systems mohali(PHSC) and at present under the baba farid university of health sciences,faridkot,punjab.
i was appointed by punjab health corporation systems, mohali in 21 march 2006.now as i say this institute was transferred to baba farid university of health sciences,faridkot,punjab(bfuhs) in 2007.since here every year my contrct is renewed by bfuhs and my terms are still same as was of PHSC.
Now my all colleagues of PHSC is permanent whose services was of 10 years and i am still on contract because i have only 5.6 years here. here the principal always says that your contract can be terminate any time because your course of radiography is not running successfully.
Now my question is that can i will be regularize as i am working here since last 5.6 years. and can i will be terminate at this stage. how i protect to myself.
please guide me soon.

Leave Encashment

Sir,

I am clarifying the earlier query

Suppose if Basic pay is 4800/- per month and HRA is Rs. 2200/- per month and conveyance is 500/- per month and the rule of leave encashment in which the employee is working is such that an employee can encash up to 20 days leave in a previous year, then what will be the amount an employee gets on resignation, say after service notice period of one month, the leave available to his credit is 56 days.as on 31.12.2010 ( Date of Joining Service 01.06.2006). The years of service is 5 years as on 01.06.2011.

If the employee resigns in July or August 2011, is it possible to add the Earned Leave available during the year (30 days) with the 56 days already available to the credit. If so, leave encashment is for 86 days (56 + 30). Am I correct?.

Hope I will be getting clarification soon.

dispute

sir,
my question is , company 7 workers are working presently in bangalore , onw employee trasfered from chennai to another branch ,all are saperate entity providing ESI PF also .that transferred amployee raised before the labour commissioner ,

my question is whether labour commissioner has a jurisdiction , if not which authority is having jurisdiction ,

in appointment latter there is a clause for transfer ,

reason for tranfer is that employee mingling with other outside bussinessmen , passing information about this company ,

how should i take defence

Compensation

In case a workmen dies during the course of employment in an motor accident, can he claim compensation under workment compensation act and motor accident claim both? or he is entiltled for any of the one. pls also provide some judgments also.

non payment and closing of company

Helly everyone,
firstly what is a summary suit?
My husband has not been paid for the last two months. First week of June 2011, the employers told him that the company would close down due to insufficient funds.
Please advise, how we can get what is due to us. As per the contract - the notice perid is 3 months.

BIFR

Sir, we r mazdoor sangh & our industry was clsoed down in yr.2006 without giving any notice & now the company moved to BIFR, our wages r remain, whether their any judgment or order against such company which curtail our rights....!!!! waiting in ur kind reply as we want to file the same... thank u in anticipation

Clarification on service matter

1. In APSEB orders were issued in BPMs.No.178, dt.3-7-1992 upgrading one of the existing posts of Deputy Secretary in Personnel Service as Joint Secretary and the method of recruitment to fill up this post of Joint Secretary is by way of promotion from the cadre of Deputy Secretary. At a latter date as eligible candidate is not available for promotion, the post of Joint Secretary is downgraded as Deputy Secretary.

2. Again in order No.111, dt.18-8-2004 the post of Joint Secretary was revived by converting the post of General Manager (IR) and the method of recruitment is same as mentioned above para. The following conditions were stipulated in the order dt.18-8-2004:-
a) The Joint Secretary post shall be downgraded as Deputy Secretary as and when the incumbent vacates the post either on superannuation or otherwise.
b) The Joint Secretary post shall be filled up as and when one of the Deputy Secretaries become eligible.

3. The above post of Joint Secretary was created at Corporate Officer of APSEB.

4. The post of Joint Secretary is downgraded in the year 2008 as eligible candidates is not available for promotion.

5. On 23-9-2009 orders were issued that the post of Joint Secretary was revived by converting the existing post of Deputy Secretary (Training)and the Deputy Secretary (Training)is at the Training Institute and not at the Corporate Office. Orders were issued that the incumbent working as Deputy Secretary (Training) at Training Institute is promoted and posted against the revived post of Joint Secretary with a condition that the incumbent promoted shall report to the Jt.M.D.(HRD)/Corporate Office. Accordingly the incumbent reported to the JMD(HRD) and assumed charge at the Corporate Office which was accepted on 25-9-2009. After assumption of charge the LPC was issued the Training Institute and pay fixed at Corporate Office based on the LPC issued by the Training Institute. The incumbent is drawing salary at Corporate Office since 25-9-2009.

6. Now the management is saying that the post of Joint Secretary is at Training Institute and not at the Corporate Office.

7. Kindly clarify the following:-

a) legally speaking whether the post of Joint Secretary revived as mentioned at para-5 is at Corporate Office or at Training Institute.
b) If it at the Training Institute as claimed by the management,having accepted the joint report at Corporate Office on 25-9-2009 and also salary being paid all these months at Corporate Office, is it valid now the version of the management that the post of Joint Secretary at the Training Institute.
c) Whether the contention of the management can be contested in the court of law or not. What are the chances.
