Appointment delay

hi i ve been offer a letter of appointment By a company h/r after completion of my interview and they ve asked to resign from my current job i ve resign from my current job and accepted the offer......but from till date they are keep delaying my joining for no reasons. they are saying my verification is pending from their end but i am now sitting at my home with no job .I ve with me the offer letter of that company i am sitting at home with no pay.....from 22nd of august till now....because i ve resigned from my previous job at 21st.....can i do something against them......

Contract license for the contractor

Dear Members,
I have a query on The Contract Labour (Regulation & Abolition) Act.
The act applies to every establishment in which 20 or more workmen are employed or were employed on any day on the proceeding 12 months as contract labour and to Every Contractor who employs or employed any day of preceding 12 months 20 or more workmen.

My question is that,
the requirement for obtaining the license for contract is on totality basis or establishment basis.
e.g. A contractor provide 10 workers to Altd &9 worlers to B ltd. He is not required to get license but what if he is providing 21 workers to a Ltd and 25 to B Ltd. Now the contractor is required to get one license for 46 workers or two different licenses as per the establishment basis.

Could you please guide me what is the meaning of " Punishment - Stoppage Of 03 Incerement with cumulative effect"



In above statement what is meaning of " With Cumulative effect " ?

Pf registration

We un'stand that PF registration is compulsory if the number of employees is 20

Now the clarification required is..
if the manufacturing company having employees over 20; but where all the employees are drawing over Rs.6500/- a month, which is the prescribed limit by the act.

More over now the inclusion is for a person drawing over Rs.6500 is optional.

Now does it required to be registered since there is no contribution either from the employee or from the employer..

Pl. advise and comment.

Esi registration

We un'stand that ESI registration is compulsory if the number of employees is 10/20 as the case may (using power or not)

Now the clarification required is..
if the manufacturing company having employees over 20; but where all the employees are drawing over Rs.15000/- a month, which is the prescribed limit by the act.

Now does it required to be registered since there is no contribution either from the employee or from the employer..

Pl. advise and comment.

Ex-servicemen benefits bp sharma

An Ex-servicemen applying under ex-servicemen category in Bank A ,B and C respectivily. Selected in bank A under General category and joined under probation period and selected in Bank B and C under Ex-servicemen category.

Whether he is eligible to avail to the same status on re-employment in Bank B and C after regisnation from Bank A.

I seeks a revelent case law which defines "probation period" , "Age Relaxatin", "Ex-Servicemen benifits availed in Bank A and can be availed in Bank B and C" and examining on the re-employment of ex-servicemen in Bank B and C.

If Joins Bank B or C and Bank terminate a employee after 8 months of probation then what is HRP Policies,Legal policies, re-employment policies.

If any person re joined under section 17b of id act and he is again problematic forus

Dear Sir.
under section17b of ID Act one person came to our factory.Now again he is problematic to us.He is a active member of BMS Union.One day he entered to my cabin and abused as well as threaten to me.it is regular practice with our officers .can you suggest what to do with this type of person ?

Form 19

R/s,
Company was wind up in which Mr x was appointed. on filing form 19 to epf office, they returned with objection that official liquidator's sign not attest. but sign of Bank manager duly attested.Thanks

Limitation period

Dear sir,

Can now in 2011 a writ /LPA be filed in High court on the basis of documents related to service matter which was dismissed in 2005 by hon,ble court as other party misrepresentated the facts thus gets favourable order by playing fraud with the court.Now i hv received documents under rti act to prove my case beyond doubt.
I understand in writ limitation does not put any bar provided there are documents to prove the delay.I can plead that i hv received documents only in 2010/2011 so belted writ should be allowed.
Please advise.
