Counting of military service towards pension

i am a retd short service officer from indian army, Date of commission: 23/12/2000 Date of release:15/07/2007, length of service 6years 6months I joined central reserve police on 03/07/09. now in present service i am entiled for contributary New Pension System . my question is that if my previous military service is counted and taken as qualifying service for pension will i be illigible for old pension scheam. as i have to return the gratuaty which i have recevied during release from army.

I dont think so as at the time of your entry into your present job,only the contributory pension scheme is there.

as such any pension is based on your contribution alone.

since by the new scheme,a privilege enjoyed by the exservicemen are lost,some new compensation have to be evolved.

please write to the director general resettlement,army headquarters,new delhi for knowing further details if any in this regard

Dear Anil,

Since you have not joined new service after applying through proper channel by rendering technical resignation, your past military service won't make you eligible for old Pension Scheme under CCS (Pension) Rules.

The provisision exists for the cases where Government servants apply for posts in the same or other departments and on selection they are asked to render technical resignation, the past services are counted towards pension under CCS (Pension) Rules, 1972. Since the Government servant had originally joined government service prior to 1-1-2004, he should be covered under the CCS (Pension) Rules, 1972.

SO, your case does not fall under that category, as you had already retired from short service commission.

Sir as per your opinion if my previous service is counted its is of what importance to me as this was the only benefit a ex army personal was getting. secondly if they count my military service backwards i.e 6years 6 months from the day i joined my new govt service for all practical purpose my my date of joining new service will be dec 2002. which is prior to 1 jan 2004 . kindly suggest.

Yes,unless,some new instructions comes from the govt,your past military service is not going to help in the pension matters.

however for fixing grade etc your past service may help. this is also as per the practices followed by different depts.

as such,it would be of common interest to all such exserviceman,if you take up the matter with the director general resettlement,through some exservicemen organisations in your locality.

this forum may not be of further help to you in this regard.

Dear Anil,

There is a clear gap of 2 years in between the date of your discharge (15.07.2007) from your military service and date of joining the CRPF (03.07.2009). Normally break in service for one year is condoned by the Head of the department for allowing military service to count towards service and retirement benefits. However, you may try your luck by applying to your organization (CRPF) for condonation of break in service if you can get the benefit as a special case.

The main difference in your case is you had opted for gratuity compensation instead of pension,i.e. one the other

Could you had been in unorganized sector instead of Govt. undertaking,you might have got the chance.

However the doors are open for you in the new service,where also you will get the future benefits like other Govt. Sectors.

before 2004 you have joined a post which was pensionable. You couldnot complete pensionable service and joined another post of Govt of India.

You are entitled to court your service from 2000 after deposit of graduity.

Thanks i want to tell the whole story .
I applied my dept for counting my military service for pension and other benefits in this regard after verification of my military service from Army officials my deptt asked me to pay back the retirement benefits ie. the Gratuity amount with interest from the day i have drawn it .I did as asked for .Now 3-4 months back i got the final order from competent authority that MY service rendered in Army (6 1/2 yrs) will be counted toward civil pension and the intervening period of 2 yrs is condoned.The doc has been sent to pay account office for final order which is still pending and i am still in new pension scheme. I don't know what the deptt will do further.

Pls suggest
