Can you please clarify how the leaves of contractual workers can be compensated in their monthly wages (casual,earned & national/festival under Punjab shop & establishment Act) in terms of % as bonus is included @ 8.33% subject to Rs.3,500?

I need clarification as to which law is applicable for drivers who are working in the factory through contractor
Factories Act 1948 or Motor Transport Workers Act 1961 or Motor Vehicles Act 1988 and what are the provision for working hours of drivers

I was working in central government office(Archaeological Survey of India) and now i joined in ESIC after technical resignation. My application was forwarded through proper channel and i was relieved on technical resignation. Whether I will get lien in my parent department. and also the procedure for applying lien. My past service is not counted in my present department and it is under process.KIndly inform the rule also

my father has given property on rent to bank.now his income exceeds the limit for rental income and therefore comes under service tax bracket.the agreement with the bank was signed about 8 years back and there is no mention of payment of service tax.now is my father entitled to claim service tax from the bank i.e user and pay it to the service tax department or is he supposed to pay from his own income my father is a senior citizen and a retired defence personnel has no other source of income except pension and rent
a co-op bank(employer) is not relieving employee on resignation without giving any reason or notice. it has been 9 months after resigning and till date i have no communication whatsoever on acceptance or otherwise. the salary payment has also been stopped from the subsequent month of resigning. I have given 4 reminders and no reply for that as well. the employer is due to me for gratuity, leave encashment and other benefits.
what would be appropriate step? kindly guide. also provide me with advocate contact details from bangalore.

Dear Sirs,
Ours is a establishment in MIDC, we are partly into manufacturing deploying only 03 persons. we have service activity on going in the same premises and hiring activity, in total we deploy around 44 peoples,
03 in manufacturing, 32 in Hiring and rest 09 in services department, are we required by law to get a factory licence.
Kindly advise.

A helper in our factory joined on 1 August 2011. On 22th August, 2011 he suffered an accident in the factory due to his own fault and he broke his hip bone. The company initially got him treated in a private hospital and bore all the immediate expenses and later he was referred to the ESI where he recovered.
He was on medical leave from 23 August to 11.02.2012 and was drawing salary from ESI. He joined duty on 12.02.2012 but was acting very rough with the management. He was dismissed from service on 28.02.2012 as he was no more required for the job he was kept for. He worked a total 38 physical days and in our company record he had completed 212 days(ie. from 1.8.12 to 28.2.13).
This workman has filed a case in the labour court claiming full back wages and reinstatement on duty.
Please tell what benefits he is entitled to. He has not completed the mandatory 240 days to receive the retrenchment benefits. The company had also paid him about Rs 30000/- advance for running his home expenses when he was not in a condition to work. He has not acknowledged the help given by the company in his plaint.
Please express your views.

I don't really have a copy of the order of supreme court of India judgment , regarding the LPG subsidy so i am a bit confused about Weather it is compulsory or Optional to link your aadhar number with the LPG Distributor ,kindly clarify my doubt..and if possible kindly give me a copy of he judgment of supreme court of india thank you.

Bank refuses to give employment because of pregnancy
I Meenu, got offer of appointment for the post of officer scale-I in a nationalize bank . so i resigned from my current job which is the clerical post in some other bank and the bank relieved me. so I submitted my joining report to the my new employer(bank) but they have refused to accept it verbally because i have 22 weeks pregnancy. on next day bank received only my medical reports without taking joining report and asking me to take extension from joining but i refused that because i want to join. after 3days bank sent me a letter saying that i can only be able to join bank after 3 months of my delievery(my expected date of delievery is in mid march 2014) and also for the post of officer i am not medically fit by mentioning that my current job profile also required some kind of field work like meeting custmors, farmers outside the bank etc. After that I sent a reply to the bank that in present condition I am able to perform all the works as prior to this I was already working in a bank as a clerk for which some times i performed field work and i was doing that very well. but the bank has stick on his decesion. Me and My husband is totally helpless as i seems to unemployed for the next 8 months..PLZ-2 HELP ME...... ..
