Gratuity

Dear Councels I am working in a private limited company for the past 8 years. Planning to quit. There is nothing mentioned in appointment order or review appraisal letter about gratuity. It just mentions my CTC amount. Pay slip also does not mention about gratuity. Heared from my senior staffs and HR that my company does not provide gratuity. Its an ITES BPO employing over 1000 staffs. Please advise my options if in case gratuity is denied.

Modification in bond money

sir/
i have joined coal india limited in 2010 with a non judicial bond.
the condition of bond was "to serve the company for minimum 50 months or to deposit 50000 in case of quitting the job.
after that in 2012 company change the procedure in its board meeting and increased the bond money to 3 lakhs or minimum minimum service period of 5 years.

upto july 2014, those who joined the company with bond money of 50000 or 50 months and resigned, they need not to pay 3 lakhs.
but in august 2014 company issued a circular stating that whosoever resigned the from company has to pay 3 lakhs or serve for 60 months.
i have submitted my resignation in july..
now my query is
--1-is it mandatory for me to abide with changed bond conditions as i signed only on rs50000 bond.?

2..can i have a legal stand regarding how can a bond be changed and which is against my fundamental right i..e freedom of liberty?(that company can do whatever it want even at the cost of someone liberty).

3..even if i m in notice period ..will i be bound with new conditions.

4.what will be the consequences if i leave the job without following the new bond condition.?

5. if i did'nt able to get the NOC from my company , will i be able to join another psu or central govt job?

About employment after resignation

i worked with idbi bank (public sector bank) for around 1 year and resigned from there due to further preparation for civil services .
in reliving letter of idbi bank they put a clause that

"CAN NOT TAKE ANY COMMERCIAL EMPLOYMENT UPTO 2 YEAR FROM THE DATE OF RESIGNATION FROM THE BANK"

IN THE RESIGNATION THEY DID NOT DESCRIBE ABOUT THE TERM COMMERCIAL EMPLOYMENT .
BUT AS IN IDBI OFFICERS RULE BOOK ITS ABOUT EMPLOYMENT WITH PRIVATE ORGANIZATION NOT FOR GOVERNMENT ONES.

BUT I AM TENSED THAT WHEN I WILL GO TO JOIN NEXT GOVERNMENT SECTOR JOB AS MAY BE
ANOTHER PUBLIC SECTOR BANK . THEN SHOULD I HAVE TO TAKE PERMISSION FROM IDBI (ALREADY RESIGNED) . OR ANOTHER PSB CAN ASK ME ABOUT PERMISSION LETTER FROM IDBI AS IDBI DID NOT DESCRIBE THE TERM "COMMERCIAL EMPLOYMENT " IN THE REVELING
LETTER

Notice period waive off

Hello Expert

I am getting a better carrier opportunity somewhere else and I have served I notice period of one month which is ending on 8th Sep’14.

I tried to negotiate and request a lot with management to relive me as this opportunity is crucial for my carrier but no one ready to listen here and also they have hold my salary and I am struggling to fulfil my daily needs.

My employee contract document says that there is provision to serve a notice period of three months but nothing have mentioned in reference to hold the salary.

Kindly help me so that I can found a humble solution.

Thanks in Advance.

Notice period related

Hi sir,

I have worked in an advisory company few months back, and then I was on a medical leave but I don't have any medical certificates. I have informed that I am not well and suffering headache for which I am unable to take calls for long hours. The leave was approved and after some time I got a call from the company regarding joining, then I replied them that my condition is not OK to take calls I need more leave. They told me to send mails for leave extension or resign.I replied that I will come to the office and discuss the same.
On 2nd September I got a mail that I am absconded by the company and I need to pay the penalty amount of 50,000 Rs.which was only 4 days after the discussion and in between there were Sunday and Ganesh Chaturthy.

I replied the mail that I was out of the city and am ready to serve the notice period but under a different manager as there were several HR Issues.
They replied that I can't Join.
Now they have send me a legal Notice claiming 50,000 Rs. as per the employment contract.
My query is, how they could claim me the penalty without giving me any option to serve the notice period and how they can abscond me with out giving me any warning letter or email?

They have not paid my last salary of 22 days as well as my PF.Please let me know What should I do now?
