Dear Experts,
I gave a exam for a post in a Central Government Organisation.I have done extremely well and was expecting a score of above 85 - 90 (out of 100) and was confident of clearing the exam unless the cut off goes more than 90. But in the written result my name was not available and I was shocked to see the cut off at 70. I am 99% sure that I would have not scored even less than 80 as there was no negative marks.
I filed an RTI by the end of September seeking copy of my OMR sheet, question paper, official key and detailed marks of all the selected candidates. But even after 45 days of receipt the PIO didn't provide the information which sought. I tried to contact the PIO via phone and mail to know the status by all my attempts were in vain. I already had doubt that something has gone wrong and now the silence of PIO in giving the information doubles or even confirms my doubt.
As I didn't receive any reply from the PIO, I have directly filed an appeal to the CIC to direct the PIO to provide information and punish with fine for his negligence.
Now my doubt is,
What if the PIO mentions that he sent by normal post which I cannot prove that I didn't receive unlike speed post or register post.
The interview falls in another 10 days and the decision from CIC might take a maximum of 90 days during which the entire process of recruitment would have completed.
Thirdly, the organisation is in Hyderabad. Can I file a writ in Chennai High Court? or should I have to go to CAT instead of court?Should it be filed in Hyderabad only?
I will be thankful if the experts provide me advice about how to proceed further and whether I am on right track.

An employee whose wife has expired during his service had nominated his three children @33% for the purpose of PF. One of the children is 17 years old i.e. minor but he has not mentioned the detail of the guardian. Unfortunately the employee also expired during his service. The management can give the PF accumulation to the two children who are major @ the share declared by the employee.
Now the question is how to settle the amount due to the third child? I could not find any provision in PF Act. Any gudance ?

In terms of the Bombay Shops and Establishments Act, 1948, standing order is applicable to establishments having minimum 50 (and 100) employees. Please explain why standing orders are not applicable to the Indian Subsidiary? In case any notification exempting the applicability is available, please provide the same.
What standing order is referring ???

Hello Experts,
My uncle Mr. Vishwajeet Sarkar works in public sector. His spelling of the name was Biswajit Sarkar during his joining some 30 years back. After joining for last 25 years he started using the current spelling i.e. Vishwajeet Sarkar. Even the firm's promotion letter, pay slips have his current spelling Vishwajeet Sarkar. However he did not made any affidavit for the same. His all identity proofs, PAN Card contains the new spelling Vishwajeet Sarkar. However his PF account is on the old spieling Biswajit Sarkar.
What can be done to rectify this? What can be the process?

Sir I was appointed for counsellor in an institute. But they made me do some other work. They found some clerical mistake in my work. My boss fired me without any prior notice. Said that they will not release my salary and security money. They made employees work on Gazette holidays. They have not given me PF number and ESI card. I went to police station, my boss said they'll release my money and now they are not responding.
What steps should I take? ?

I am serving two month notice and its getting over in 17/11/2014. What short of action I can take if institute will not relieved me on 17/11/2014. Please give me suggestion.

i am english teacher in delhi govt school since 3 years..(DOE)

this incident relates to my school's science lab..
3 days back i sought permission of my school's lab assistant to sit in science lab to do some english based activity with children which needs concentration.this activity will fetch them marks.science lab is located in a quiet area of our school and so i chose this place.all other areas are full of children's noise who are mostly out of classrooms.
lab assistant left school a little before closing time and so he requested me to close lab after doing my activity, when school closes
so,after finishing the activity,i switched off fans,lights and locked the lab.then i handed over the keys to laboratory incharge(female teacher) who was still in school..
on all other days only the lab assistant or the lab incharge (female teacher)close it, & also open it in morning.but on that day this work was assigned to me since i was doing this work and the lab assistant was also not in school during closing time
however i made a mistake.i forgot to close windows.so for 2 days(holidays) they remained open.fortunately,the open part of the windows are secured with strong iron grills.so no tresspass happened.nor did any mice or cat entered because the grills have v.little gaps b/w each other to allow any animal inside.
but today my vice principal issued me show cause notice to give written explanation for this carelessness,even though i had apologized to her orally.
now how am i to defend myself?
PS-My vice principal was on leave for many days due to medical reason,including on this day when this incident happened.she returned only today and issued this notice in the name of school incharge who takes care of school in absence of vice principal.

This is for one of my friends, his team leader is mentally torturing him, he does not give him leaves that are allotted to others, behaves with him in a diffrenet manner, dominant as he has all the data to prove him correct etc, can this be reported to police?
