Pf nomination

(Querist) 13 November 2014 This query is : Resolved
An employee whose wife has expired during his service had nominated his three children @33% for the purpose of PF. One of the children is 17 years old i.e. minor but he has not mentioned the detail of the guardian. Unfortunately the employee also expired during his service. The management can give the PF accumulation to the two children who are major @ the share declared by the employee.
Now the question is how to settle the amount due to the third child? I could not find any provision in PF Act. Any gudance ?

You can release the money to the minor once he attains majority - which is not far away as he is already 17 years old.

Dear Mr. Acharya,

I wonder to know why the form was not considered to be completed in all respecttts when the employee failed to mention name of the guardian in the prescribed column in spite of the nomination form clearly providing for filling in the name of the guardian, e.g., "If the nominee is minor name and address of the guardian who may receive the amount during the minority of the nominee.

In fact, being Manager HR(Legal), you need to tone up the efficiency of the HR team to be careful in such cases, as hurdles crop up only in the case of death of an empployee.

Now, as Mr. Anirudh has rendered correct advice, you may follo that and wait for the minor attaining majority.

But just think on the issue of interest on the part of the balance due beyond the date of death of the employee. Would you be able to allow interest, if claimed by the nominee on attaining majority, on account of this administrative lapse?
