Company paid productivity and loyalty bonus thru salary and IT has also been deducted and paid to IT.
On resignation, they want to deduct the amount paid under this Head with retrospective effect.
I hv requested them not to deduct. There is no agreement between the Co and me to this effect. Their 2nd circular does not state that money would be recovered.The period of the first circular has expired.
Even if a circular is issued today , it would not be retrospective. If it is then, my letter is before and has to be given weightage.
If the Co deducts then, can I go to Labour Court and or fight in Civil Court.Parallely or after LC.

Hi,
I have a query on gratuity . I have worked 4 yesrs 9 months in a company of 6 working days per week . The duration was 17th Sepetember 2008 to 25th june 2013( total 4years 9months 8 days). Company was limited organization.
Could you please tell me wheather i am eligible or not ?
I approached my Previous company HR person ,What they are saying that they are linked to LIC related to Gratuity Payment. So as per their policies you are not eligible. Please clarify I am eligible or Not.

I LIKE TO KNOW IF THE DEARNESS ALLOWANCE IS MANDATORY WITH SALARY I.E. WHETHER EMPLOYEE HAVE LEGAL RIGHT TO GET D.A.?

Sir,
I worked in central government from 1996 to 2011. Thereafter, in January 2011, I got selected in state government in a gazetted post which is equivalent to Rs.15100-39000 (Grade Pay Rs. 6600) scale when compared to central government 6th pay commission scales. I have availed pensionary benefits on pro rata basis for the service rendered in central government. I joined state government on the very next day I got relieved from central government, without any break in service, and since then i.e., January 2011, I am rendering service in state government and now covered under New Pension Scheme.
Now, a post in the Information Technology cadre in Pay Band-3 with Grade pay of Rs.7600/- is notified in central government which prescribes the following requirements.
(i) 7 years of IT experience.
(ii) 5 years service in Pay Band-3 with Grade Pay Rs.6600/- or equivalent grade in parent department.
My doubt is since I have taken retirement benefits till January, 2011, will the first requirement of 7 years experience will be satisfied. I have no Break In Service and I availed pensionary benefits as I had the option to avail that.
My new department in the State Government has Service Book from 2011 onwards, and the earlier Service Book till 2011 is closed by the central government as I availed pensionary benefits.
In the Application Form while applying for the IT cadre post in central government, I had filled all the service particulars starting from 1996 to till date, and my present state government department has put stamp certifying that all the details are correct. However, state government department has no service book of earlier service.
I could not think much while applying and applied in a bona fide manner. Please guide me will it create a problem once I am selected and joined in central government.

Sir, I am a central govt. employee as a post of clerk grade. Now, I qualified in higher post exam ( which, I have not informed to my parent dept) .So, can I go for interview without intimate my parent dept. and what about my pran card if i got selected.
Please help me sir.

After getting transfer from branch in June salry less credit 13000 and asked for they told special allowances given more now it is adjusted then Jul sal credit actual amount correctly Aug sal deduction 10000 again telling special allowances I asked previously it is settled again telling same reason we will check tells in head office and added 4000 rs still 5000rs pending but not response well they will add next month like simply telling what to do sir

I resigned a central government job after completion of 1 year of service. However the probation period is of two years. I joined another job in central government on the same pay scale. Can I join my previous job? There is no break in service and it has been 1 year since i resigned.
I am a confirmed employee (after completing the requisite period of probation) of autonomous body (AB) under MHRD. I have forwarded my candidature for selection in other AB against their advertisement through proper channel. While forwarding my application, my employer stated that "in case of your selection, you will have to resign from the post you are holding", which is written for administrative reasons as per OM No. 28020/1/2010-Estt.(C). Now upon my selection I have tendered my resignation with the request to grant me lien (As learnt it is a right, which is enjoyed by all the confirmed employees), but my employer citing the reason of manpower crunch is denying granting me lien. As I could learn, serving an institute with 6+ years, an employee's loyalty needs to be paid better way and that's why the GoI have framed policies for service matter. Most of the times, these service matters are followed properly by all the ABs, but there are some who enjoys the authority of misinterpreting the same. Coming straight to my query, I may like to put the same as under
"Whether an autonomous body (which follows the rules of government on all service matter) has the discretion to not grant lien to its confirmed employee upon his selection in other autonomous body for higher post. Can really granting lien be denied by the institute citing the crunch of staff? Is it not a violation of fundamental right?
I believe such discretion has been given to the ABs with the aim to look for the welfare of the employee as well as other stakeholders, not to harass the employees.
It would be of immense help, if you could enlighten me with the positions so that I can have some peace of mind.

Hi Around 1 year back i resigned from my organisation and the notice period over there is 3 months. i served 45 days notice period and remaining 45 days will be settled by money they told me for next 45 days you have to give Rs 40300 to get the reliving letter, but i was not in a position to give money at that time , i told them that i will give money later when i have. In between i joined an organisation and told them i dont have relieving letter, they are ok with that so i joined , now i have money and i am ready to pay the full amount but HR team is saying your case is closed we can not give you reliving document...is this legal or is their any way that i can get my reliving letter, please help i dont wont to ruin my 3 year experience, i need to join new organisation on 31st Aug 2017 please help me.
Resigned due to medically unfit
I had given resignation due to continuous mental stress that made me severely ill.Company asked me to serve notice period .I told I am unfit as soon as I will recover will serve notice period,but they send a notice for payment of 2 month salary. But working conditions were very bad I am a women and we're asked to work till 10 pm , due to more work load and insufficient staff.can I go to labor court and file a case against them ,one more thing they are not giving increment they says that u left the company so you are not eligible for that.
