THE trial court has ordered me to pay 10,000 p m
the same was challenged in high court with a rpfc and stay was granted and was asked to pay @3000 p m till date and was paid
subsequently on oct 3 the case was dismissed
now
1 what case should i file in high court can it be a writ petition or second review petition
2 within how many days can i file it
change of circumstances
3 how should i demand her current matrimonial status since
the girl has got remarried secretly in a temple and has moved with her husband
i have neighbors who are ready to come to court and give witness [except this i don't have any other proof at the moment ]
now please advice how to proceed
moreover my s l p time limitation is also coming closer

The trial court has ordered me to pay a monthly maintenance of 10,000 per month when my salary certificate given is 6,000 per month
the trial court order has cited the reference of another case which is rpfc of smt tejaswiniv/s aravind tejas chandra
but the said case is also a rpfc which is not final order
my question is can the court decide my case based on another rpfc
please let me know

i was asked to pay 10,000 to my ex wife [divorce granted in 2008 by trial court
however
the learned judge fails to accept any stand of mine and he says whatever she says is true and whatever i say is false without any documents or basis
i had appealed saying my business is closed and i have been filing zero returns from 2007 and office is not existing now and i am working earning 6000 per month
he says the salary certificate is concocted and not true
he says ur business is existing [without any basis ]
secondly
she has not given any proof of my income till date but only claimed i have rental income and 20 laksh business income per year
court says she was wife and will know my income exactly
thirdly
she says she is a b e graduate only daughter with own house and is looking for job
the court has decided on its own that she likes to devote her time to family and will not got to work [which she has never mentioned anywhere ]
i want to know the basis of all these

my first question is
THE LOWER COURT HAS GRANTED 10,000 MAINTENANCE TO MY WIFE PER MONTH FROM DATE OF FILING WHICH IS JAN 2009
IN THE GIVEN ORDER THE JUDGE HAS CITED A RPFC OF SMT TEJASWINI V/S ARAVINDA TEJAS CHANDRA AS REFERENCE CASE
I WANTED TO KNOW IF THIS IS ACCEPTABLE SINCE THE REFERENCE CITED CASE IS A RPFC AND IT IS NOT A FINAL ORDER
The trial court has ordered for paying 10,000 per month based on a reference case of of SMT TEJASWINI V/S ARAVINDA TEJAS CHANDRA RPFC80 OF 2008
wherein the case has been filed again in 2010 in high court
The ORDER BECOMES A REFERENCE only when proceedings have been finally adjudicated and the order has attained finality
But in the said case it is only a review petition and the same has been filed in high court in 2010 hence it has not attained finality and cannot be taken as reference
can this be challenged if so in how many days is there any time limitation
since i had filed a rpfc myself and got a stay for 1 year and paid 30% amount
but the stay as vacated last month but this mistake was not bought to the notice of court since my lawyer had joined hands with opposition party
now i want to know if i should file a case in high court or supreme court if so can i use the above grounds of refering rpfc 80 which was not final order

I am planning to buy a house property in West Bengal from my own earnings. However I want to stay in this house with my younger brother.
Now I want to know whether my younger brother can ask for share in this property say after 10 years or 15 years on the ground that he was staying in the house for such a long period.
Is there any case law or provision in law which can favour my brother in asking for share in the said property which is registered in my name.

my client was got marriage 7 years ago and from the date of marriage till now there is no physical relation between them...
on the base of no physical relation my client get divorce from her husband...

The cause list available today at delhi district court website does not show our second motion that was filed yesterday The person at counter had said it to be displayed tomorrow in the list.Do they add divorce matters later also and may not be updated because of this?

My wife has cheated me,so we are filed 420 case against her,SO I am going to take divorce with my wife,what is the process? Suppose my wife didnt agree for divorce, then Court will give divorce or not.,if one side agree and another side is refused,then what court will decide?
And i have one year kid also,then how many years my kid under mother protection as per law?I heard some where it is 5 years like that.

we are two brothers and 4 sisters and my father and mother have expired the partition is not done yet. I have no children so does my share in my fathers property will go to my brothers male child
Divorce problem
Hi Sir/Mam,
I got married in 2007 after 10 days I came to my home because of the husband and his family.Immediately he approached the court for reunion and we filed for divorce but now he asking for divorce stating that I'm not good to be a wife, But I came to know that he is married with some girl and they have 2 kids. So I'm going for hearing, I don't know how can I prove him as a father to some unknown child. How can I prove it? I heard about this matter through his relatives as well as some mails says that. but he wont accept it. he is earning well but he says that he cant give any compensation since I have been waiting for more than 6 years. Can anyone help me?
