Disturbance

i am a ca fianl student my age is 25 years i failed in ca final due to some reason like i dont have money so lots of disturbance from room partner like tat.i use to do job.my parent are not allowing to study they r asking me to job and i can have job of 8000 only i dont want to do job i want to study for next 4 months by which i know i will pass in ca final but i dont have money since last 2 years i have left home. we r a middle class family my parents have 8 acres land and always there is dispute betwn me and my family i want 2 ask now for the share in property so tat i can complete my study. is it correct to ask for share in case of inherited property......

New facts in divorce amendment petition

Dear experts,

I had filed divorce against my wife 1 yr back & thereafter my wife filed 498a against me & my family after 1 month of my filing divorce. Issue has not been framed. However I realized that some of the facts were not included in divorce petiton. Can I add these fact (petitions to court/ps) thru amendment petiton. Also can I add the 498a chapter thru my amendment petition.
Pls. advice & share any recent judgement on this from SC.

Settlement deed

Hi All,

It would be great if any body please send me the draft of the settlement deed with following facts

Facts:

1. 498A case filed by wife and now on settlement wife is ready to file application for quash in HC
2. Domestic Violence case filed by wife and now wife is ready to withdraw application
3. Wife ready to file mutual divorce in family court
4. husband agreed to pay one time permanent ailmony.

Property

Dear Sir,

My inlaws home was in the name of my Husband Uncle. The property he got was against a claim when they all came back from Pakistan.My father-in-law was not in Delhi during that time due to his that is why it got registered in his name. We have two floor in that house. Now the uncle and my FIL both have died and the property got transferred in my Aunt's Name. The house is freehold having 4 floors. Two Floors are with us and two floors are with her. She is willing to transfer our share to us. Please tell us what is the procedure to get this transferred in our name or my Mother in Laws name.

To get rid of tortures

Hi everyone it’s a problem from mah friend side. My friend (girl)is being tortured and being forced to marry on their parents will and she don’t want to marry and wants to study more . Her parents have closed her in their home and she is being forced by her parents to marry on their choice .they are giving tortures and they are biting her. She is being completely harassed. She wants to know what can she do now and what are the advice you will prefer .her parents are not in a mood to listen anything. They are only forcing her to marry. So please advice some law to be fired on her parents. (don’t think that she should discuss with her parents ,she is in love with other guy but the guy is not major and her parents know this that’s why they are doing this) and its an case of bihar

Divorce and joint property

I am married since 2002. We own a joint property in Mumbai, I being the first holder.

In August 2012, me and my husband filed divorce petition as per mutual consent. The consent terms been that I can purchase the property by paying 50% of the market value of the property to my husband.

I seek your advise as which will be the best way of transfering his rights in the property to my name so that I have to bear least cost on stamp duty and registration.

please advise.

Wife asking for relief through dv and crpc 125

Dear experts,
My wife had filed DV case against me in Nov 2011.The Hon court rejected her inetrim maintenace application (according to section 23 of the act) in Jan 2012 and she did not receive single rupee as maintenance.she filed revision case in session court for the same and same is still going on. In DV case, the evidence stage is completed for both the sides.
Now she has filed a crpc 125 case in family court for maintenance.The amount for maintenace and the case details are exactly same as that of DV case.My question is that is this case maintainable? Are there any citaions availabe to quash the crpc 125 case.Thanks in advance for your valuable suggestions.

Q. claim affidavit submission before final decree of divorce?

We have completed the legalities while applying for divorce by mutual consent. We have also been through the counseling and have been assigned a date for receiving the final decree of divorce after six months. The family court judge has asked for filing the "claim affidavit" during the final date of decree of divorce. So if you can let me know what does this "claim affidavit" means? (There has been no demand of alimony or maintenance from either side as both the parties are working and self sufficient, and there is no issue from the marriage)
