Hello,
I belong to a very disturbed family.My father is an alcoholic and domestic violence is a daily scene at my house.I have a brother who is 15 years old and studying in 12th class.
My father frequently beats me and recently my brother and I resisted him ,he forced us to leave the house. Now, we are living with my grandparents. I am 20 years old and in my final year of graduation. It would take me some time to get a job, my brother has a career ahead and I am right now not much capable to pay all our expenses. Our grandfather gets a meager amount as pension. Can we take law help for maintenance of at least my brother? My father and mother both are on a government job.Please suggest.

A wife has been awarded monthly Rs.2000/-maintenance from her husband by the court in 2010.now she wants to to file a petition for recovery of all the arrears.But her lawyer saying that only for the last 11 months she can claim.For the balance arrears wife has to file a civil case for recovery.Is it true.kindly advice in this regard.Any Citations in this regard most welcome.THANK YOU.

After permanent alimony in divorce can pending suits of 125 crpc and DV ACT continue.

wife living separately from husband for last 12 year with his son.during this time she never file any application for maintenance and no proceeding has been initiated by husband for divorce also.son is in 12th class. now she want maintenance for herself and for her son (18 year) for his higher study.husband never looked back for last 12 year.husband is earning about 1 lakh per month. however wife also earn about 30000 per month, Can she claim maintenance for herself and for his son for his future study?

I have number of pending suits in U.P and Punjab.The suits are u/s 125 cprc,DV act,406,498A ,3/4 Dowary Act and divorce.The divorce suit is pending in ALLAHABAD HIGH COURT.Can a desision of dissolution of all the pending cases in various states can be passed while deciding permanent alimony by allahabad high court.Has any such decision has been passed in past.Please quote it.

I wish to understand the procedure to apply for divorce in case of contested one.
I want to separate since I am the victim of physical and emotional abuse. How difficult is the divorce like and what can be the maximum duration?
Also,till the time divorce is going on, am I not free to be with any other person.Will that be adultery?

i am living in TamilNadu. My wife is living in Bangalore with my 9 years old son. We are not in touch for last 2.8 years.
My wife filed 206A against me and my mother when we were living together in bangalore. I got job in chennai .So I left bangalore (infact she forced me to vacate the house from where we stayed together).
Just 5 months back i applied for divorce in my hometown where we got married(TamilNadu).
Court sent divorce notice to the bangalore address 3 times. Its almost 3 hearing are over . She/her lawyer didnot appear in court. Even my lawyer sent a personal notice as per court order. but it got returned saying that no addressee found in that address.
She apporached my parents after getting/rejecting/seeing divorce notice.So i am sure she is living in same address.(my lawyer is saying postman is playing by getting money from my wife).
Now the status of my divorce case is "AWAIT". and the hearing is Jan 18th.
My lawyer is saying he will ask court to send the divorce notice to my wifes office address.I am not sure about the office address, still she is with same company etc...
I am sure one more notice and one more hearing. Nothing will happen.
Is my layer correct? Is he following the correct steps?.
What should be our next approach. Please advice me.

Hi, two years before i got married, gifted baby boy on 2011, at the time of second pregnancy doctor confirmed i am suffering with HIV, but my husband and Kid both are negative. when we went CD4 test they confirmed it's in advance stage i need to start ART quickly and i started. after some doubts expressed by doctors, my husband enquired about my father detah. finally he came to knew my father died with HIV in 15 years back, and my Mother also having HIV since seven years.
frankly i have no idea about this. he requested my family and relative to have meeting at that time he abused my family and relatives. but he never shares about this to his family.
before marriage he told me he has a planned to marry some other girl but it did not work. but after marriage also they both talking each other regularly ( i have his telephone bills), i have seen he dropped her near our house several time. our house owner also told confirmed same. i am sure he and his lover injected HIV to me. because when i take his lover name he gets angry and beats me badly. this happend more than 10 times in my marriage life.
three months back we both had disputes and i came to my native place,i have taken all jewelary which is mine becasue we made those at time of marriage. he gifted some arnaments to me and kid but unfortunaly those also came with me.
he filed the case against my family about cheating.
he filed case for child custody and divorce.
i don't want to give child because i have no trust on him, what if he will marry his lover who will take care my child, i discussed some doctors they confirmed HIV is not a transmitted decease.
last three months he is not paying anything to us. did i get the maintenance if i will give divorce. how much maintenance will come. as per his payslips his salary is 30k per month.
which case i can file what are the sections will help me.

Kindly advice me of any possible legal ways to be cast off from my own family on my own will. I wish to be separated from my family (including my sisters and everyone that is related to me).

Sir, A Sunni family in India, A Grandmother is survived by only a daughter and her only son predeceased her with a grandson and a daughter, what is the share of daughter, as we know orphaned granchildren are not entitle for any share, Is there any exception if a grandson is there, Any share for grandson or he is completeley excluded even if only a daughter/aunt is survived ?
