Dear Sir,
I would like to have your expert advice as to the subject of alimony and its tax implication. The person who is paying out the alimony in lump sum to his wife at the time of receiving the decree from the family court, is he entitled to have benefits as per the present income tax rules? In short,is the amount paid out as alimony in lump sum is
deductable from the taxable amount. Request your views on this at the earliest.

can i discontinue my ITR and submit income certificate
if i show my income in ITR for 2013-14 80,000 PA
will it be considered last ITR also like 202-13 for 1,76.000 PA and 2011-12 for 1,,60,000

Respondent has applied to get registered copy of documents filed by applicant in family Court. After reading application of requesting registered copy, the staff person of court told to respondent that Court can give only regd. copy of ‘list of documents’ as it is EXHIBIT documents and not give regd. copy of ‘the documents’ as they are MARK documents.
Que: Is it rule of Court that Court can give only registered copy of EXHIBIT documents only and not give registered copy of MARK documents to parties?

Request your help in understanding how payslip is read for a salaried person with no other income , in maintenance cases.
Salary has different components like Basic,HRA,basket allowances,medical allowances,PF,gratuity,performance bonus..
A careful reading of all this shows that apart from basic salary,everything else is expense / not confirmed.
To simplify it further, HRA goes for rent,medical allowance to meet medical expenses,PF n gratuity are social security savings instruments, performance bonus is not sure and like a lottery ticket which I may get r not get (specially with court cases ,performance will come down) and basket allowances which again are expenses like car maintenance, fuel,LTA,phone.
So,essentially it keeps the basic left at disposal.
With this argument, can affidavit for income be given as basic alone and then court be asked to calculate maintenance accordingly?
please share the pros and cons of affidavits & argument on these lines.

I am looking for a legal solution. Its a high time for us. We are very much annoyed because of our Neighbour's behavior. The main cause is jelous. Our neighbour's wife is so much into it that she tries to find ways to have arguments with us, She is such a nuance in the way she uses foul language. The verbal rebuke is so worst that I can't even type it here. We have a recording of her verbal abuse to my family and have aready reported the incident to Police. After which it stopped for some time. Now after 3-4 months past she started all over again. To give you a better idea she say all possible foul words and keeps spitting them 24/7.
The pathetic thing is that Police is taking
no interest in the matter, they are trying to avoid it.
For the first police called and gave them a warning, but that doesn't seem to have any effect on her.
The matter is getting worst.. We have audio recoding of her abusing us which we had already presented to the Police. I wan't to know how to get legal with this. I really want to teach her a lesson.. I have proof but matter is in no audio session recorded she takes any of our name. Could this be a weak link or I can still proceed.
I need a clear solution. Please consider the facts.
1. On police suggestion we lifted adjcent walls of our house which fall towards their home. The same was asked to them but they never obeyed.
2. We have audio proof (many*)
3. She say all wrong stuff about us to other neighbors to gain there confidence. Which few of them have already realized and try to stay away from her (most of the neighbor don't even allow her to their home).
I would re-assert. I am looking for a proper legal remedy so to quite her for a long long term.

Eventhough we didnt get court summons in our 498a case, we approached one lawyer and filed Stay petition on chargesheet. Finally after 1 year I was told by my lawyer that we got stay for 6 weeks only. More over my lawyer is saying to me that we need to keep on lodging petitions for every 6 weeks once, for extending the Stay.
As I didnt understand this concept. my lawyer is not giving enough information or advises.
Can any one here in the forum, explain me the process and advise me on the next steps of how to proceed with this 6 weeks of HC stay?

I got married in 2012 march. Till my husbands relatives were there at home after our marriage for other cermonies he was behaving gud with me nd shared the same room once they left he started sleeping in different room and stopped talking to me. Latter, I was asked to go to my home and come back after, as his brothers family is coming from US nd they dont have a room to sleep as one room was occupied by me, one by his parents and the other room by him.
Now, we both want to file for mutual divorce but I want future security as well with mutual divorce.
My query is can ask alimony with mutual consent?
Please answer this asap, as he alongwith his family going to come today to my home for signing mutual divorce papers.

Dear reader,
I got married in dec2009,marriage happened in the very simple way without dowry, as i was working in Qatar at that time, i stayed only 20 days with her at my home. My widow mother and my wife use to stay at my native home in India,as soon as i went, my wife starts abusing my mother on her silly demands of sending her daily to her mother place and demanding to allow her to speak to her ex bf. as i am physically handicap(suffering from polio) she use to comment me on my physical status, after i left she started abusing my mother about my handicapped condition, alternative days she use to lock her in a room and threatening her to commit suicide if her demands are not fulfilled, after 2 months she left to her parents house with her bf, where she delivered a baby boy, in april 2011 she file a complaint against me and my mother a local women cell where they insisted my mother to call me immediately, after that they file as filled an FIR (498a)against me and my mother on june 2011, we consulted the lawyer, as all the charged mentioned are false, he advised us that we should request for the fair police inquiry.My mother requested the local SSP for the fair police inquiry against the logged FIR, the result of the inquiry is in our favor, in the report given by SSP its mentioned that mother is innocent and her name should be withdrawn from the FIR. As in the meantime i have changed my job and now working in Dubai and did not went to India,after my marriage visit. in dec 2013 my mother requested to DIG(Border range) for the fair inquiry against my name in FIR. April 2013 we got the inquiry report for from DIG office mentioned that all the charged on me are false and i am innocent.
as my mother is alone back in India and not knowing much abt this police issue, she visited the police station many time with the RTI signed inquiry report but they did not took any action, now they have asked my mother to case has been given to court and i have to present in court otherwise they will declare me as PO.
My lawyer is saying that inquiry by the police (SSP & DIG) wiil not be considered by the court.
Please advise how can i save myself and my mother from this false case, can i appeal for the quash in HC on the basis of these inquiry reports?
Being the only son and only one working hand in the family i want save my job as much as possible.they are threatening me to seize my passport as soon as i land in India.
My passport is going to expire in 2015, can i renew it now from Indian consulate in Dubai? as i worried they may do the inquiry for the local police station.
please advise any way to save my old mother and my self from this disaster case, if possible advise my any good lawyer in Punjab HC to whom i can consult from here.your urgent reply will highly appreciated.

If person gives false statement with proclamation in court, after that person gets caught with his/her falsehood, what can be a defense?
