My wife as a part of rituals have moved into her mother's house after the delivery and was supposed to return on the 90th day. My mother in law is not interested in sending her back and is creating issues. My wife is in support of her mother and have started talking very rudely to me and my family members. She is accusing me of a lot of things including harassment since 2.5 years, ever since we got married. I know it's just because of her mother she is saying all this and yes even my wife's childhood was difficult as her mother and father were living a seperated life. Her father doesn't have any stand or say in her house and all the decisions are taken by her mother. Her father is supporting us and has said that he has also been a victim of her mother's mental torture

A brief of my case is as given below My wife had filed a false 498-A case on me and my family (father and mother) in 2018. She had also left her 3-month-old son in the custody of mine in 2018. In 2020 her chief, she has accepted that she denied for her son in front of police and front of the family committee and denied to take our 2-year-old son in front of a judge in 498A. In her chief of 498-A case, she put so many allegations on my family and me. My father and mother are suspects in this498-A case by the police. Many of her allegations proved wrong by us. In her chief “She said that I (husband)threatened her to do suicide and I (husband) & family will make such circumstances that she will do suicide on her own” without any date or time. Now in chief of her family (father and mother), they have also added more allegations on me and my family and also alleged that her daughter could do suicide as her husband said that I (husband)threatened her to do suicide and I (husband) will make such circumstances that she will do suicide on her own” without any date or time. All these are false accusations made by the family and their relatives (Father and Mother) because the verbal allegation does not require proof in courts. My father-in-law and mother in law they are also repeating the same thing in their chiefs. All these are false accusation are verbal allegation does not require proofs in court. (Father in law and mother in law cross yet to be done and it got delayed due to covid -19. I am in a serious dilemma Kindly advise me that what should I do now and how should I proceed in my case further. How can I prove my innocence?

My grandfather left his property to my grandfather in his will, which is now in her name after NOC's from both my father and his sister.

Hello Everyone,
My name is Raj Bhartiya (25 years). I'm an IT professional staying in Bangalore. I want suggestion on how can I proceed with my parents separation as my Mother's life has become a living hell. I cannot afford the charges as I'm the only one working at my home in order to take care of all the expenses of the house and my siblings education.
My father has not been providing any financial support to the house for almost 2 years now and he doesn't even work or has the will to work anymore. He drinks everyday and verbally abuses everyone including my younger sister who is just 13 years old. When I'm not at home he threatens my mother saying that he will kill her in her sleep and abuses her in a way that I'm ashamed of even typing those words here.
Yesterday night i.e.. 16-04-2021, when things got out of the hand I had to call Police in order to resolve this but eventually even they couldn't do much as he was completely drunk and was not listening to anyone.
I fear the safety of my family. Please suggest me what I need to do? Also please do suggest me how can I take custody of my younger brother(17 years) and sister(13 years) as their future is at stake and I do not want my Siblings future to get spoiled.

there are 3 brothers to a father . property shared between brothers and fathers . so 4 equal parts . one part out of 4 was given to father .
now father is not alive .
does elder has full control over that 4th part ,after his father death ?
so elder brother can give or may not give that 4part to these small brothers , right sir?
or does 4th part also should equally share between brothers after theirs father death, legally and mandatory sir? Thank you sir.
Time limit for filing appeal in a divorce case
What is the time limit within which a divorce decree holder has to file an appeal in the high court?
It is thirty days or ninety days?
The Section 19 of the Family Court Act says it is 30 days whereas the Section 28 of the Hindu Marriage Act says it is 90 days. Which will prevail?
Or can the party elect one among the two Section and file his appeal as per his choice?
