What is the rate of stamp duty payable in state of Punjab on execution of gift deed in respect of property being gifted by sister to brother?

Partition and Will

Sir,

My sister got fabricated will and I have challenged the will in the Court and My suit for Partition was dismissed only on the ground of mutation without scrutnising the Will. Now the case is in the High Court. My sister constructed the House.

How the court will decide on the partition.

I have not asked for probate in the lower court but now I asked for probate in the High Court whether the will is decided by the High Court or lower court.

Respected sir,
i want to know how a will can be executed what is its legality. is there any speical provision regarding will in the law.
please guide me how to execute a will in resect of agriculture land situated in Haryana in favour of sons only so that it cant go to the the doughter of executants doughter.
is it sufficent to put thumb impression/or signature of executants on a plane paper so that sons of the executants use it when they need of it.

divorce

i want divorce from my husband and maintenance for my child who is 3 months old,my husband does not earn at all from past one year and gave me mental torture from the day we got married.and my father in law insults me every now and then in front of people.he sends all abusive messages to my dad and me on our mobile.and now he is linking me with my friends that i have affair with them.he used all my money from the bank for playing gambling,and never came home on time.and tried to commit suicide many times,and robbed my gold also to play gambling,i want justice and the custody of my child please help.mahi

Maintenance

Wife wants to file case under DV Act, 498A, divorce. Wife is professionally qualified and is working. But her earnings are almost one-third of her husband's earning. Say if she is getting 5 lacs per annum, her husband is getting 15 lacs per annum. Is she entitled to any maintenance / relief in any form from her husband in any of the cases. If yes, under which section and how much?

RCR after Divorce! Is it possible?

Dear experts,
My friend got divorce in lower court after 1year judicial separation. He is paying monthly maintenance.The wife side went for appeal. The case is pending in fast track court for 6 months. In the mean time now wife filed RCR. Is it possible to file such a case? What can we do to get divorce quickly? Please help!

Divorce U/s 13B

Dear Sir,

Thanks for your reply.We submitted the citation given by Mr Manohar and our lawyer also argued on the same.But the judge was not convinced and said that as per the latest SC judgment no lower court has the right to waive of statuatory period.However the judge( in My case)reserved the judgment next week.

I do not understand the SC judgement.When we have mutually agreed to terminate our marriage and the court not waiving of statuatory period,both the parties have to undergo a lot of mental presuure inspite of them not able to reconciliiate and they cannot decide on their future life also.

My point is can't anyone challenge the judgement??

Also i want to know if statautory period is granted do i have to pay maintanence to my wife???

In DVC case what procedure is to be followed in the court. Civil or Criminal?

Is there a possiblility to pray for amendment of complaint for inclusion of any oversighted omission when criminal procedure is to be followed?

Tenancy rights

Property is in the name of the mother. The size of the plot is 75 feet x 70 feet. She has 3 sons only. The eldest son occupied the property first from 1983 to till date and took access to 60% of the ground place with house on it. He has never paid rent to my mother, but shown bogus entries of rent paid in his businees accounts. Now he is claiming tenancy rights. The mother is interest in giving all equal share of 25 feet x 70 feet. But the eldest son does not listen to the mother and others are deprived of the share, as he is reluctant to vacant.
Can he claim tenancy rights ? Please advise
