Namaskar. I have querry regarding property. If u have time pl. do reply.
Father inherited property from his father. Some of these properties were partitioned between father's mother,father,sons, daughter and wife.
QUERRY : 01
What is the status of the property received by the father in partition ? Will it be regarded as individual or HUF in his hands. If it is smaller HUF, can his sons & daughter receive share in it ?
After the death of his mother, father received the property received on partition,( as mentioned above), by his mother, being the only heir ,and got it registered in the revenue records. But the income from the said property( rent and agriculture) is being shown in the return of income tax under HUF status since many years.

Now if the partition of the property received by the father from his mother is to take place what will be the status of the said property as it is being shown as HUF property in the income tax returns from past many years. Will the said property be regarded as INDIVIDUAL or HUF according to the Hindu Succession Act in the hands of the father ? Will it be regarded as individual property blended with the HUF property ? Sir, are there any decided cases ?

Hi, I have recently engaged with a girl.(last month, no marriage yet).
But the girl behaviour as well as the family behaviour was not good and I decided to called off the marriage. Also, the girl has great aspirations and all and she may not adjust with me and my family.
Now, the girl's family is harrassing us and threatening us to file case under dowry act.
We have not asked for any dowry. However, during the roka ceremony (kind of engagement ceremony) we received certain gifts, which is normal during hindu ceremony. We also gave certain items to them.
pls let me know
1) whether they can file a case under dowry act.
2) what action should I take now
3) should I get an anticipatory bail for me and my parents
Both the family are in different states.
Pls help me in relation to both dowry act and IPC.

My wife has deserted me along with my only female child (2 yrs 5 months old)from last 6 months. She might lodge DV & Maintenance against me in near future. I want my baby back. Dear experts,
i & My wife jointly filed a divorce petition in family court with the help of local lawyer.Petion was enclosed with alimony agreement also.it is a year passed ,my lawyer doesn't say any status of the case.once he said that the memo was filed for tranfer of case to our region mobile court and after many days he was telling one identity proof to be attached with memo. i was fed up on this type of delay and i want to change my lawyer.wht steps can i take further to change the council.I paid full fee.Is this a genine delay wht he states.wht is time limit to transfer the case from family court to region local court.till date he says that the case is still in family court,My lawyer is not telling case no also.
pls help me out.

Sir, I have two daughters and i am a hindu by religion. My youngest daughter got married to a muslim and i am not aware whether she got converted to Musilim. After my demise I want that my youngest should not inherit my property by staking her claim as a legal heire. Is it possible legally. What action are to be taken by me to achieve my goal. All the property was earned by me only.

i got a house property settled to me by my mom on 11.7.2010 which she obtained thru a family partition towards her father's self earned properties who died interstate,alongwith her surviving brothers. Now, can she make any rearrangemnt of the said property without my concern influenced by my other heirs

My mother expired without making will.We are three heirs ie: myself(only son ,married and staying on said house property),My Father(again staying on same house),and My sister(Married and Staying with her husband and family) all three are registerd on 7/12 extract as legal heirs by Tahasildar.I have two questions 1)Can my father sell our house without my concent 2)Can my married sister force my father force to sell our house to get her 1/3rd share ?
No Ojbection for passport of child of divorced parents

The father is in custody of the child of 8 yrs. He wants to make the passport of the child. The parents are divorced. The passport office has asked for no objection letter from the mother. She is not obliging. Can you pls let me know how to proceed in this case. this is urgent.
