interim relief to wife

dear expers i have a simple query for wife vs husband

in many tax laws payements it is possible to pay the amount under protest which alwyas recoverable

in such kind where a court grants interim relief to wife can ushband deposit the same amount with protest ?

is the all amount will be recoverable after acquital from her? if the above anser is yes.

iam from tamilnadu.
here property mentioned as scheduleA,B,C.schedule A is house,B is shop,C is another shop. unregister will made by father to 4 sons and 3 daughters. here schedule A,B are belongs to 4 sons and schedule C BELONGS to his wife, after his wife the schedule C goes to 3 daughters. father died,mother died in 1996,partition held.all the daughters sold their share on 1998. now 2010 the daughters filed partition suit to pray equal share.
here 1st daughter purchase one vacant site from one of his brother by sale deed from his share.
now all the 3 daughter file partition suit to equal share.
in plaint they never mention the partition and sale made by 3 daughters.
they include that sold property and claim equal share.
TELL ME WHAT LAW SAYS

d v and letter sent by both parties

wife filed d v case suporting some false letters
husbond poruduced all the letters which are totally true as evidence that father of the wife has demanded some money and a false allegation of ornaments of wife.

but while discharging interim relief court made a statement that both the parties has produced some letters which are of no use.

can court rejects the letters as evidence before argumnts of both the parties on such discharging interim relief?

will it be point of appeal?

Sec-9 and Sec-13(Divorce)

Respected Sir,

I have filed Sec-9 in Aug 2008 at the court of Civil Judge (Senior Division), GHAZIABAD while my wife filed divorce in May 2009 at Family Court, KANPUR NAGAR. So Is it any possibility to bring this case at GHAZIABAD by any "hook and crook" tactics by law-point?My Sec-9 is Stayed by ALLAHABAD high court through Transfer petition filed by wife, while I am compelled to go KANPUR to attend the date of divorce while I am NOT able to start any
job having present jobless condition.
With this she already filed the 3 more lie criminal cases 125 cr.pc. in May 2008, 498A in Aug 2008 and Domestic Violence Act in May 2009.
This is the request to the UP related case's lawyers.....................
Please give me the sincere advice to take strong further action to humiliate this abusive-personality lady.

Interim maintenance

Dear all,

Can you please help me on the following matter.

Husband ITR shows : total income 13,35000
Tax payment+deductions; 450000

Total money in hand: 900000( approx)

He pays to his wife and child( separated) 2 68000

Now wife wants to request for enhancement of maintenance as she is not able to make to with 20,000 per month. Do you think she will stand a chance, looking at the income profile of husband and the fact that child is studying in higher secondary school and incurs other expenses like private tuition,extra curricular activities etc.

Please give your opinions....

Fate of adopted child

I have recently filed a divorce suit against my wife. We have been married in 1991 but remained childless due to primary infertility and chronic depression of my wife. In 2009 , we adopted a baby girl from a private adoption agency in kolkata under CARA. My wife left her matrimonial home on 16th April 2010 to stay with her parents and is still there. She took my daughter with her. I love my daughter very much. In the divorce petition, I have asked for her custody. She is currently 1 year 9 months old. Is there any possibility that if the adoption agency comes to know about the divorce petition, will they take back my daughter ? Or, will she be treated as a natural born child and given accordingly to one of us ? Her adoption was duly registered in March 2010.Pl. clarify. I am very much attached to my daughter and never, ever want to lose her.Please help and guide me.

Case File

Parents declared in news paper regarding no relation with their son & his wife, as they are residing seperately from my parents approx 7 months even after brother's wife include the name in DV cases of my parents
My query is :-

i] If she is residing seperately & parents also declared NO RELATION then how she can do this,
if no kindly ask on which act we appose this DV case or it is helpfull to protect from such false cases.

ii] Brother's wife residing with someone / parents since last 7 months, and she is not coming back, Can we file any case if yes kindly guide

iii] Our Section 9 case she is also not attending since beganing , can my brother file Divorce or any other cases against her.

Religious website preaching bigamy

One of my acquaintances got married to an Indian (Hindu) Dubai resident in 2006.

She stayed with him for 7-8 months after which she came for a 2 month holiday to India.Since then she got deserted by him as he changed his jobs and addresses but never informed her.3 years later she discovered that he had put up his matrimonial profile in a very famous religious Hindu website,where he gave his marital status as "separated"
So she wrote the owner and also sent her the marriage certificate to prove that she's married to him.

But the owner was very rude and sided with this man even without knowing him personally.She investigated this matter by just asking him the truth,and obviously he will never say that he deserted her.So he gave a picture that he is living separately mutually with his wife,and that his family was harassed a lot by her.The owner just believed him and refused to remove his profile.Rather she harassed the already harassed wife by lecturing her that the wife has to be submissive to her husband at all costs.If the man deserts her,she must have provoked him.Even if he's faulty and deserted her, the girl should not live with her parents but like a destitute in some religious city like Haridwar and let her husband remarry(even without a divorce) because Hindu religion permits it.If she wants to return to him,she must bow down to him(no matter how cruel he is) and seek his apology.And if he deems it fit,he may/may not call her.

Rather she also forwarded all these lectures to this husband,so that he also realises that he's not faulty in posting his profiles,and that Hindu religion fully supports him.

Can the wife sue this owner for using such words,and preaching bigamy like this?And for also refusing to remove his profile?


The owner,though Indian lives in USA.

Please suggest what action can be taken?
