Sir,
1) Under which section and circumstances arrest is possible under DV.
2) Are there any ammendments in DV 2005 and 2006 recently in support of husbands.
3) Is there any punishment for false complaints.

Sir,
In DV act is it possible to get exemption in maintainance. (wife+child(less than one year old)).
The wife is highly qualified, UG+PG, but not working at present and residing in the house of parents.

I have question regarding Cruelty & Maintenace
I was married in year 2002, my husband is bank employee in a nationalized Bank, within couple of months of my marriage I was harrased, mentally tortured by my husband, fatherinlaw, motherinlaw, sisterinlaw for not bringing enough dowry. They complained that they have not given to my husband motorcycle, television, fridge, storewell, etc, so my father bought all these things and gave to my husband, during this period I was staying with my husband at a village as my husband is a bank employee he was posted there. My inlaws used to callup my husband regularly and compalin about my father and mother not doing enough in marriage. My inlaws used to visit us within 4 to 6 months, every time during there stay they use to complain to my husband about my father and mother not doing enough in respect of dowry and not giving enough as per there customs so my husband would get angry, provoked and would argue with me, make comments and taunts about lack of dowry.
After year and half of my marriage my son was born. I went with my husband to a village where he was posted. My father came to know about my state of illhealth and my mental condition he had an argument with my inlaws questioning why they are treating her in such a way, this didn’t go down well with my inlaws.
One day my inlaws came to place where I was staying with my husband as he was posted there alongwith some of the jwellery which was given to me by my parents and relatives. My husband and inlaws closed the door from inside and forcefully against my will compelled me to write and sign on a stamp paper that “my inlaws have returned to me my all the jwellery and they(inlaws) are going to open a joint account in my and husbands name and keep all the jwellery in locker”.
Not only this after that a video shooting was done by my husband in close doors whereby I was forcefully made to look as I if am receiving all the jwellery from my mothereinlaw and fatherinlaw i.e. my motherinlaw and fatherinlaw giving me the jwellery one by one in myhands, all things were done in close doors against my will, as I was alone I could not do much except to do what they forced me to do. Then they took all the jwellery with them alongwith the stamp paper and went.
Thereafter, I left my husband's home and went to my parents house. They(inlaws) are saying to everybody that I ran away with the jwellery, they are saying wrong things about me and creating a false impression about me everywhere, even writing letters to my relatives thus creating my wrong and false impression in the society.
Since last three years I and my son have been staying at my parents house.
I have following questions :
1) Can I file a maintenance application of my son and myself
2) Can I get the jwellery back,
3) As they have done the video shooting against my will forcefully in closed doors, how can they be punished by law and can that whole thing go against me in any way
4) What can be done to prevent them from creating my false and bad impression in the society which they still keeps doing
5) What are the legal options available to me in the present situation.
Please kindly guide me what can be done

I am facing divorce case u/s 13 1 (ia) under the HMA,1955 and I am respondent in the said case and defending myself without advocate.
On 29/01/2011 issues have to be framed. I was present in the court at 11:00 on same date and clerk said that case will be heard after 2:30, so again I reached 2:30 and waiting for my turn. After 45 min. when I asked clerk about status of case she said Petitioner has already taken adjournment.
So while framing issues presence of either or both parties is required?
Also when date is given I was not present, but earlier when I have requested for adjournment in past, I have been told to come after 2:30 when opposite party advocate is present. Can I protest for giving date in my absence when I was instructed to come again in past?

I tried to convince her somany times. But she never understood. She always compares her life with her sister who was married with a rich person. She complains to their parents in her favour. They know her attitude but they are supporting her and trying to threaten me to make her happy. Please give me a solution for this. Now she is pregnent. Still she finds the ways to fight with me, sometimes threatens me by saying that " You are not caring me, I will commit suicide". I cant live with her. Can you plese suggest me what can I do now.
