Query Regarding Adoption

Mrs. X (alone lady) aged around 85 years wanted to adopt a daughter whose DOB is january 1996.
the girl is the daughter of X's Daughter.

tell me can mrs. X do so?

Will Married daughter have equal rights if father willed the property, Bank balance, PPF account to his son?

I am from Mumbai hindu family and my father had got some property , Bank Balance, PPF account in his name and my mother name and he had shared and whole of the property , Bank Balance , PPF account , Jewellery which he had made is written in his sons name. can i make a claim,. the will is registered. .my father has one son and three daughter(me). Moreover Son is staying in USA , I look after my parents and we brother and sister are Twins and just see the difference

can i get some advice from professionals., How should i approach to my parents and get things reverted in equal ratio to all.

Can husband claim back gift property?

Got married under Hindu marriage Act.
My husband gave me gift property in 2008, there is no written agreement that it was a gift. We had a domestic violence dispute in 2010. Now my husband is claiming in the court that I falsely got the property on my name. He is saying that he bought the property in 2008 and he was not aware the property did not get registered in his name ( as he was out of country when property got registered, he paid for it through a draft in his name ) but in the wife's name. He is saying he only found out that the property was not registered in his name last month, he is lying as he was aware that the property was registered in my name, it has been 3 years since the property got registered. Can he claim back the gift property using this argument? how do I prove he is lying, is the fact that property has been registered for 3 years enough to prove his lie?

In reply to Mr Amit Minocha's reply on "Better go for quashing if you have strongest grounds."

Please have look on strong and weak grounds on this case ...

Strong:
1) I have all strongest grounds as I have not done anythings wrong except we made a fight on the morning on my smoking habit and both of us kept in separate room.The accident happened on noon.
2)Postmortem report said suicide by hang.No others hit mark found.

3) My parents were not staying with me.They are staying on my native place.

4) Even 1 day before my in laws made FIR my neighbor handed me over to police as my in laws home is one night stand from my staying home.Exactly next day of accident they made FIR and we got arrested.

5) Even in FIR/charge sheet it is written my parents were not staying with me.

6) My in laws tried to highlight (as per FIR and charge sheet) that I asked for 100000 to purchase a new flat.But real fact is that I already booked one flat few day back form the accident day and made some payment through cheque.As per my bank statement I have sufficient balance on the accident day.
7)In FIR they have written that they have given my a lot things on dowry.Real fact is that I am strongly against the dowry still now and I have not taken not a single things from them.After the marriage I have purchased lot of the house appliances from my own and have all receipts.


Weak:
1) While she made suicide I was present in the house but in separate room.
2) No suicide not found.
3) No diseases with my spouse others than the short temper.We where absolutely happy family if we ignore just few hours.


on the above main points can I go for quashing to HC and what is the right time for quashing? Please advice.

125 crpc

court have awarded 4000/- as interim maintaniance. 7 executions of Rs. 2.84,000. the main maintainance petition is D.E. stage. Can i filed my ATM's statement which shows my salary as my employer does not issue salary slip. will it benefit me as my total salary is 5900/- P.M. my lawer's says it wont effect the final order as the interim 4000/- has been fixed. and in final order the maintainance amount wii enhanced. advice me should i to go to with my lawyer or i submit my ATM's statement.

Plz help me, need urgent advice on filing FIR

Myself , married in july 2010.

My mother in law has thrown me out of her house within a month of our marriage, my husband didn't help me at all, my MIL completely controls him and my husband is scared of his mother, and my MIL doesn't want me back, from the last 5 months iam trying hard to save my marriage, tried counselling, sent messages, phone calls emails, but no response. my MIl is forcing my husband to file for divorce and get seperated from me, she keeps saying him the same, i got to know this from my husband's relatives. My MIL is not ready to listen to any relative , she is adament to break this marriage. My MIL has harassed me alot, and i think she wants dowry but she is not saying directly on my face, moreover she curses me whole day that her son is handsome and she did a mistake that she choose me.

Atlast i had to file a maintenance case under 125 crpc. Summons were issued, my husband accepted the summons, and when police went to their house with summons, my husband and inlaws told them that they will appear in court and they don't have any problem in accepting me back. And they had signed the summon papers and gave the summon copy to police. Then on the following date of hearing , my husband & inlaws didn't came, they were absent. Altough their home was locked, and they had told their neighbours that they are going for a case hearing. Before that he had escaped from accepting the summons, by tricks, and due to this my case dates extend, and i keep going to court . 2 hearings havebeen passed. But now i think they are cheating & fooling me. From last 5 months iam trying so hard to save my marriage but now i feel these people are just cheating me, iam shattered . They just don't want to come to my place in court or accept me back, and now after all this i cannot stand my MIL, because she is a threat to my marriage. They are inlficting nasty alligations, iam getting disgusting calls on my landline, from pco's abusing and all.

Now i want to file a PWDVA & i also want to register F.I.R, for F.I.R i have ample proofs, and consent from police station ( From city- where my husband resides) in written that i should file FIR against my husband. Because i know he will continue to make me fool and won't appear for PWDVA summons also, as they are constantly cheating me. So i will file FIR, Now i want to ask what happens after Filing FIR, can my husband still escape himeslf from appearing in court even if i file an FIR ???

He will be arrested or not ??? please tell me
