Still any maintenance applicable?

Dear All,

One of our Client(husband) got ex-parte for maintenance suit.

In the maintenance suit wife claimed interim maintenance and maintenance till divorce, mean while divorce suit also got ex-parte.

But still husband is willing to reunion, no 498a on husband.

As it is a love & arranged marriage, husband till date is writing/wishing(greeting) his wife for festival, birthaday, marriage anniversary and other seasonal greetings.

RCR was also filed, adjournamnets are going on


Note:However the parents, family members, relatives and some neighbours of the wife, constantly interfered and attempted to poison their marital relations by carrying tales, to the wife against husband.

Since husband's family is a joint family and the entire family is managed by husband's mother this created more mis-communications, misunderstandings by the mother of wife(husbands aunty).

This is the actual at play due to constant back-biting by these evil elements against wife about her individuality.

In such a vitiated atmosphere, wife fell prey to their machinations and became a tool in their manipulative hands.


My question:
Still husband has to pay interim-maintenance and other charges till the time of ex-parte decrees (maintenacne and divorce) as husband really want to reunion.

about divorce

dear sir,
i want to know if husband or wife had a past relation with someone else and it has been completly over before marriage then on this ground husband or wife can take divorce without other's consent plz help me

In 1950(PARTITIO OF INDIA AND PAKISTHAN), 20 acre of agriculture land was allotted to my uncle on concessional rate he has paid cost to govt in1960. At the time of allotment the member of my family was my grant mother, my uncle, my father my boa(father sister) A s Karta of family the land was allotted to in name of my uncle our families are living separately since 1956. my uncle is selling the property .my father claimed the property share in court of SDM in1974 but suit was declared not in our favor . Can I file suit again for claiming share in property Pl advice me. Stop him from selling the property

officially engaged to a girl.Now want to back off due to temperamental differences.Girl filed sec 420,406 and 34 IPC.On bail now.Girl alleged that we took 2 lacks as dowry at the time of engagement.Whether the case sustain?any case law?Plz

family dispute

I have my Saru, wife's jijaji, and my Saru's father expired recently, and, now aunty, Saru's mother, is residing with him, Saru

But the attitude of aunty towards my Saru and his wife alongwith his children are not cordial and she is detoriating the image of my Saru in the area he lives

the will of deceased uncle is not being made available to anyone and in such circumstances aunty is unduly pressuring my Saru to sign blank stamp papers which may be utilities by her any time

Now since the problem is with relations which are not heath , I seek advice from you all as under
1. Can the will be made available, if it is registered and if yes how
2. Can the dispute be solved since things are very unclear that aunty wants to live her daughter or son
3. The dispute be settled and aunty's unrest many be settled how

Suggesstion under 24 HMA

hello...

I am having matrimonial dispute with my wife. Court fix the amount of Rs.2500/- per month under 24 HMA. For the past 1 year I am regularly paying this amount.
(arrears not yet completed)


She is an advocate now.
Can advocate wife can claim maintenance, as I have no proof that she is in practice.
But she is register with BAR council.

Probate of Will or Gift Deed?

We are 2 brothers, father and mother deceased. I lived with mother and father in mother's flat. Brother lived outside. Mother made a will and bequeath her flat solely to me.

Is probate of will the only option?

If brother gives his consent, can I go for gift deed (without citing the will) in which he gifts his share (as per succession act) to me?

Which is the cheaper and faster option?

re: partition of father and partition claim by my brother

sir,
in the year 1995 there was written partition(not registered) between my father and uncle and some property came to my father shares and some goes to uncle. propertys came to my father shares in that some property was in my brother name but my father is not transfer this property to his name as per partition deed because it was in the name of his own son and father was confidence that it is in his own son name and therefore they have not transfer this property to his name and kept in my brother name. but sir, my brother 6 months ago transfer one property on his name to his mother-in-law name . which was actually purchased by my father in 1981 in the name of my brother when he was only 6 yrs old and after 1995 partion between my father and uncle this property came to my father shares. and after we came to know that he has transfer this property in his mother-in-law name we (means my father and my yonger brother) filed suit against a my brother claiming the null and void transfer and cancellation of sell-deed. because this property was purchased by my father in the name of brother when he was 6 yrs old. but,in written statement he said that at that purchase time my grandmother given cash money to my father to purchase this land and a before the death of grandmother she told him that i have gifted this land to you. sir,can it is possible ? when in registry it was mention that his guardian is his father and at the time of purchasing this property my brother was only 6 yrs old and all money was paid by my father only. wheather he is having right to sell this property saying that it gift given by my grandmother and it is my self-acquired property? and in 1995 partition between my father and uncle this propertypls came to my father share then can only my brother is having his name on this property having right to sell without the consent of father and borther ? it should trated as a ancenstral property and everyone is having right on this property including my father,mother and my younger brother then my brother is having right to sell this property to his mother-in-law name ? give your valuable suggestion and direction and also give any case law related to this ......
