Please help...
My sister's death was January 24 this year. She were living With us the last 8 years with their 2 children. one is 8 years old and another one is 11 years old. Her husband died 9 years ago. Since then she was residing with us. Now his brother-in-law is threatening us to put a case against my parents, that we haven't care about our sister. My sister was a patient of AIDS & we got to know this just before 2 months of her death. Her husband was also suffered with AIDS but her in-laws never told us about this.
What can we do in advance to procure this.

Hi,
Please could you advice me on the following.
I was married on 21st Jan, 2011 in Coimbatore. The age of the girl which was told to me and/or guardian is 15/07/1982. I am working in Chennai and the girl stays in madurai along with my parents. She was staying there as I was sorting the place of stay for both.
We had stayed together only for 15 days. It was an arranged marriage and the the marriage has not been consummated yet.
I discovered from the certificates of the girl that the actual date of birth was 15/9/1975.
This makes the girl 5 years elder to me. The girl and the her guardians had concealed the real age of the girl. To add to this the girl has also applied for the new passport with the fake date wherein she already had a passport with correct date of birth.
Once I have known this truth, I have dis-associated from her. I am thinking of filing a case of nullity of marriage on the grounds under section 12(1)(c) of the HMA. Me doing this becoz, had I known the real age, I would not have given the consent for marriage.
Please advise.

an elder daughter of a Hindu Nair nuclear family married without the permission of her parents.the parents distributed all their properties to younger daughter.including their ancestral properties.have any right for elder daughter to acquire the share of properties ?

Dear Experts,
My wife did not return from her maternal home after going there to write PG exams. The reason - Her mother and sister believe that I am doing some black magic to pose problems to the physically and mentally. My wife too believes them and staying away even from our only son of 5 years old. Our son is with me.
I want her to come back and lead peaceful life. About 4 years ago, my wife's sister and her husband had taken gold belonging to my wife ( major part was given by my in-laws and rest by me to her at the time of wedding). They have also taken about 10ogms of gold belonging to my mother. They had taken the gold pawn it and get some money to save their failing business. They have never returned the gold.
Now my wife started living in her sister's place almost like a maid servant. She madly believes her sister and mother regarding the black-magic claims. I am not able to convince my wife out of this. Legally, what are the options to get her back or at least get the gold back to have a security for her life?
I am ready to pay maintenance if she stays away from her sister and mother as they will take all the money and enjoy.

Ours was a arranged marriage and we are residing in india .My wife has filed a domestic violence case against me .I was from india and my wife was born in india .After about 2 years of marriage i learnt that my father in law was born in the year 1933 in pakistan and but natural he has to be a pakastani citizen who came and settled in india most probally . How can i persceute my wife for giving the wrong information to me at the time of marriage .What are the laws for this .

anyways, as stated, I need a specific Indian/Hindu law that would show that the children of a hindu couple would take the FIRST NAME of the FATHER as their MIDDLE NAME and not the mother's maiden name.
this is in relation to a case forwarded to my office where an Indian/Hindu couple, residents of the Philippines, wants to correct the middle name of their child which appeared in the Philippine civil registry using his mother's maiden name.
Please advice sooN!

1) The marriage is performed by a wife by giving false certificate.
2) if the wife files 498a and DV cases, can the evidence of fake information given by wife be used in above cases.
3) Because the authenticity of the marriage comes under question. Can it provide relief in above caes.
advice on marital problem
I got married on 6 dec 2007 and we belong to hindu community. Soon after marriage my husband insisted that i giv my jewelry to my mother inlaw which i did. we then moved to bangalore(me and my husband)to the house which is in my mother in laws name. She used to visit us for about 20 days and always slept in our bedroom with us even though there was another bedroom available for her. She also complained about me to my husband all the time which created fights between me and him and he has also hit m about 4 to 5 times. Things were then fine between m and my husband and we decided we can have a child. But his medical rports showed low sperm count and hnce we had to do IUI and was done with my husbands sperm sample. the copy of consent letter is with me. The i concieved and after 3 months of pregnancy my husband suggested i come back to blgaum where my inlaws and my parents both stay. i initiaaly went to my inlaws house but was not given propr treatment. I was not given proper food and was forced to eat maggi most of the time. Then my husband suggested i stay with my parents as his mom was not able to take care of me which i did. Then my husband started fighting with me late at nights on the phone and messages. It was my 9th month of pregnancy and at 2 in the night my husband called and fought with me saying i dont behav well with hismom and gave me lot of bad words to which i too gave badwords to his mom and him. afte that h came for the delivery and was fine. he also visited me a couple of times and also the naming ceremony. in oct he was to tak me home with the baby girl but he refused saying i fight and give him and his mom badwords and showed the messages to my dad. meanwhil i lost my mom but he didnot attain the last rites nor was taking my calls. my family mmbers trid talking to his parnts but they said i was not to step in their house. I then found in feb2011 that h was having an intimat chat with a girl who is maried and seeking a divorce. I went to mt him in bangalor but h didnot take me and daughter home. now he is again not taking my calls but theatened me to divorce and said was just waiting to know if i would agree for mutual which i said no. he then threatened me sayingthat his lawyer would create false poofs against me to gt him a divorce. i want to go back and try solving our problems as we have a child in question. please advise me how to go about it. what are my chances in going back home. I have not recieved any notice to this date. Please advice me. Thank you.
