About 4 months back my husband and inlaws throwed me out of my matrimonal house,The same day they took my jewels too during day.married for 1.5 years nowmarriage consummated after 11 months as hubby had anxiety issues Around a month later a alliance came for my brother from my hubby's side and it was in initial stages. MIL didnt like the proposed girl's mother so and so we dropped the alliance.she MIL kept suspecting we are proceeding with alliance and poised my hubby's thoughts which made him avoid me. He said no conjugal life for 6 months till he is sure we marry another girl for my brother. This affected me a lot after almost a year of waiting this is what I get. He even stopped normal relationship and conversation with me and I became so much depressed as if a blind getting sight for a day and lossing again. It was that time my mom came to our house to give gifts for a occassion and left the house. on her way she made a courtesy visit to the proposed girls house and unfortunately my MIL saw that. She induced my hubby and made him shout at me and she also shouted and throwed me out of house. My hubby even threated to divorce when I was thrown out and I gave a 498a complaint in the local police. Police gave 3 rounds of counselling and my husband said he is upset cos i went to police and he needs 6 months time to recover. It has been 4 months now and my husband has sent a divorce notice on grounds of creulty saying the 498a police complaint given by me has given him and his family mental torture and he needs relief from this marrige.
Pls temme, does a complaint at its initial stage without FIR followed by counselling for about 3 months contribute to mental cruelty. Does the court consider this as a serious case? or is it something gona turn into my favor as you might have seen in the above posts that it was he who pushed me out of the house in mid of night and made me go to police and he is tilldate not acquitted on my request police is just trying to reconcilliate?

I was got married on sep 2006 in oct 2008 my wife left me & filed sevral criminal complaints against me, & she also filed petition in maintenance act 125 Cr.p.c
In said case i have given income tax return for the assessment year 2004-2005 in which i had shown my income as Rs. 19.560/- per year as my income prove. finding me income tax payee court has taken my income Rs. 5000 to Rs. 8000.and court order me to pay Rs. 1200 to wife and Rs. 800 to minor child as intrim maintenance allowance and i am paying regularly.
QUERY;- IN final order court going to increase the monthly allowance amount. what would be the amount

My mother in law is widow, she is above 60 years old. She have four child 2 son & two daughter all are married & both son is elder then the daughter. Both the daughter are well settled in their life and both the son are living on rental flat. Mother in law was having house in chawl at sion it but sold that in 12.50 lacs and buy house in chembur in chawl at 13.50 lacs and now it costs 20 lacs. Property is on mother in law's name.She is given that room on rent and she only taking rent& staying with yonger son in rental room after elder son got married approxmately since 9-10 years & elder son is not at all look after her since then not giving any money or nothing. Now my mother in law made a will in which she mention 70% of yonger son & 30% elder son in her property.But in that case if we dont want to sale her flat after her death then it will goes to which son. actualy yonger son want that her flat after her death and ready to give some of amount to the elder son. Is this can be done even after she had made a will or should we make another will antdwhat we should write in that. Also i want to know what are the rights of her both the daughters in her property.

Ld Counsels,
Wife deposed about the lack of interest and refusal for co-habitation. Will that be a proof for the allegation of impotency of the husband.
There is no specific averments on impotency except for the above statement regarding co-habitation.
Please clarify.

Dear seniors ,
Iam appearing for an the respondent husband for 125 crpc filed by his wife as first petitioner and his daughter aged 1.5 years as second petitioner.
Facts :
The respondent is an regular college MBA student and at the time of marriage he was preparing for the entrance examinations for the MBA and some GRE examinations .His marriage was solemnised in the year of 2008.At the time of marriage his wife parents knows that he was studying and he was not earning ,looking the family background of the respondents family they gave there daughter to him for marriage .His wife was employed at that time of marriage and she was earning around Rs 15000 pm and she is also an Mcom PG. They were living seperatly for around 2 years ,because his wife had deserted him when she was in the third month of her pregnancy .A lot of talkings and compromises were held by the respondents family ,but all are failed and his wife refuses to come to the matrimonal home after the childs birth .Finally on sep 2010 his wife filled the maintainace petition of 125 crpc and claming rs 20000 for both the petitioners .
Questions :
1.) At present the respondent is studying final year MBA in a regular college . Can i submit the Id card and the exam hall ticket, Fees paid receipt of the college to the court .
2.)Can i get some good citations for this case which is accepted by the courts .In this website i have found so many citations of different courts favouring 125 crpc against the men .But it have all mentioned the CC amd MC no .Can i give these citations to the court ,will it be acceptable by these courts or they require AIR case no ,because this case is going on the Family court of Chennai.

Sir 5-6 yera Back we loved eachother and after 2years we got rigister marreige but she dint stay with me from the day one but we use to meet every weeak she use to come to my home becoz she was stadying that time she told me after
my study i will come to ur place but after Exam
she startd teling if my dad send me than only i will
i tryed my best to get my wife but no use now she
is asking Divorce but i am not ready to geve i just

Hi,
My inlaws home is in karnataka and my wife like to visit them once in a while. My father in law died before our marriage. When she visited, the other unmarried sister get upset and ask my wife to leave the home with reason saying that my wife is married now and married to a different subcast person. And mother in law supports the other daughter. So I wanted to know about daughter's right in her parents home after marriage. Can they ask her to leave ligally. Note that the home is self earned by my mother inlaw. Is the right in dwelling place for woman becomes nil after marriage.

sir i am in luv with some one from last one & half year. hum shaadi krna chahte hai but ladke ki fmly ne bht force unke feb main engagement kar di hai. or wo khush nhi hai.unke relatives bol rhe hai ager wo rishta todenge waha, to unke in-laws dowry case kar denge, actually his belongs to patna.. we both r working in delhi. or wo nhi chahte waha marriage krna... hum kya hare...aisa possible hai kya ki wo log case kar denge or inki fmly ko jail jaana paega...plz help us...hum 2no shaadi krna chahte hai..
High Court Stay Order on Family Court Judgment
Hi,
I got the divorce on 30 Nov 2010,after fighting it out for 4 years in the family court.I applied for certified copy on 7 Dec 2010 and I got the certified copy of decree on 24 Jan 2011,my query here is from when is the actual appeal period counted.My ex husband has made an application at the high court to get a stay order on Family court judgement and decree.There is a property and streedhan issue which is pending ,Though nothing is specifically and directly mentioned about the divorce in the application the subject says"application for stay on judgement and decree" does that mean the stay order application is also made for divorce.
We have decided to go in for settlement, and the application is not yet accepted by the high court.So does my Family court judgement valid.Please reply..this is little urgent
