Hi,
I have a query. My girlfriend was forcefully married a month ago to her parents choice' boy. The boy also is also having a girlfriend and now both of them want to get separated.
1) So, is it possible to get divorce after a month of marriage. They both are Sikhs.
2) How long will it take as they want a mutual consent divorce. I have read somewhere that a mutual divorce can only be filed when both the partners are staying apart from one year???
3) Can the time for divorce process be reduced in this case??

Sec 26 HMA in a Divorce suit 13ia:
Case is going on
Is it mandatory for wife enjoin/implead kid as a party in IA vide sec 26 of HMA in a divorce suit .....or rather .......... kid be made as a party alongwith mother as a party and represented by mother...against the father who filed divorce suit?
Was that mandatory ever before?
Even Order of child Maint actually doesn't say anything like 'IA as per Sec 26 or so' ............
Order of child Maint is about to be assailed in civil revision vide art 227 of COI
Its puzzling like googlie as to why suddenly this Q came up? ..........
Is there any clear citation that child maintenance may be obtained 'for the sake of child only' under HMA Sec. 24 ALSO.
(which may not make it mandatory to enjoin kid as a party to such IA)
Puzzling part of the situation is that earning wife asks maint 'for the sake of kid'? (Then it becomes a clear case of HMA 26 and hence kid needed to be enjoined as aparty and represented by mother!!)

What happen if husband does not attend every court hearing till evidence stage. he is repersented by his lawyer. Would that go against him and how many date he can missing.
Any citiation, where judge allowed divorce due husband absense inspite of his lawyer available on court.

i get frequently posted from one place to other after 4 years
1. I have found out ,the case can be transferred from one place to other ,but not so frequently.
and in my case the application has to be sent to supreme court.because i being an defence office get posted from one state to other. and transferring of case from one state to other is within the jurisdiction of SUPREME COURT.
2.IN MY CASE we are only fighting against him proving that he has hidden our first marriage of 1999 in gurudwara and has wrongly filed for divorce under special marriage act based on marriage of 2001. in between we have filed c22 and c24 , asking for interim maintenance of my daughter and my expenxes of travel ,and expenses of case.
3. suddenly they filed to withdraw their petition and got orders passed without lettting us know .any way we fought against that and on 06 may ,the judge has recalled his order realising and stating that he has hidden many facts from the court. we have now filed objection against their petion .
4. our stand is : first the interim and C24 should be decided ,then the original can be contessted whether his divorce under special marriage act is right or wrong.
my query :
1. at this stage ,what is the future of my case .?
2.will i get divorce while fighting this case ?
3. i want to break my ties with him ,is there any other way ?

This is regarding my sister life battling issue:
She is married to her husband by special Hindu marriage act in the year 2002 at family court in Agartala, Tripura.
She and her husband is from Andhra Pradesh, caste wise she is SC (Scheduled Caste and He is OC - REDDY)
They were working together in the central government department at Delhi till February 2011.
She also given birth to a boy and his age is 3 years and the boy is with his parents in native and his parents have rejected to give the boy to her.
Due to the mental and physical tortures, she doesn’t want to continue further to live with him. Everyday he used to harass her by unparliamentarily words and torture physically. He had sent her out of the house in the midnights many times.He tried to push her out of the running bike while coming back from the office together. She suffered so much and sustained with all these issues for many years from 2002 to till now for about 7 years.
He abuses about her in unlawful words to her parents and relative in native. He is forcing her to live with him. He is threatening that he will commit suicide, if she doesn’t oblige to live with him. Presently, he is abusing and torturing to her parents and relatives about her over the phone. Now she is mentally disturbed and lost the job.
He is black mailing and challenging her that “ Let me see, how you get the divorce?”. That’s the reason he is not giving her document such as educational certificates, Caste Certificate, Marriage certificate, her dresses, furniture’s, Kitchen Utensils, LIC policies, both equally purchased immovable property in native,threatening her mother to vacate the house since the individual house (in a village) is in my sister’s name given by her father as a gift and her yearly earning from the crop land which had been enjoyed by her mother till now.
So, she finally decided to divorce him. But without the marriage certificate, she is not able file a case.Presently she is not working and living with him.
Please guide her how to get the divorce and the source to get the duplicate marriage certificate from Tripura.
A muslim divorced girl in kerala wants to marry subsequently and she got a divorce certificate from the mahall.For the registration of the subsequent marriage under the Special Marriage Act,whether she needs to submit the divorce certificate from the Wakf Board in addition to the divorce certificate issued by the mahall ?

We are Hindu, resident of Ratlam (M.P.) city my father in law left my mother in law and family (2 children ,one son and one daughter) 6 years back .He does not supports his family financially and has married other woman despite of not being divorced.
Since 6 years back children were small my mother in law had to take care of their studies and life, but now since she has settled her both children she wants a justice to all wrong done to her and her children.
My mother in law currently lives in a rent house as she was thrown out of house along with the children 6 years back and has no means of income or financial support from her husband.
What legal actions we can take against him so that we can have the justice for wrong done to us .
My father in law owns a petrol pump that was given to him by his father.
How can we gain right over the property as my mother in law and her children has equal rights over it
What action can we take against his second marriage and the woman to whom he has married as she is aware of his first marriage.
We tried going to police and complaining against him but since he is rich he use to give money to police man and get himself out of situation
Moreover apart from maintenance we want him to be imprisoned for 7 years in case of bigamy.
How can we achieve this.
What legal actions can we take against him without involving local police
What evidence are required to prove his second marriage
And what help can National Woman Commission can render to us ,in this situation, without involving the local police so that we are able to enquire and get correct evidence against him to present in court.
Since he is rich he is able to turn things in his favour ,what can be done to avoid this and how can we collect relevent proofs against him
