Stridhan to be returned to wife on desertion.

1. Ms X married Mr Y and deserted husband. Court declared her deserter and dismissed her maintenance petition. Ms X complaint U/S 406/498-A IPC against Mr Y stand dismissed.

(1) Can the husband file suit for mandatory injunction directing his wife to take the delivery of stridhan of wife?
2. Who shall be watchman to safeguard her stridhan by paying rent of house where items are kept of deserted wife? kindly answer the query by quoting any settled case law on subject. We specifically request that only that Ld. expert should answer who can quote case law on this to answer the landmark query please, submitted please.

lawyer cheating

my wife have left me and she is not willing to live with me. i went to a lawyer , explaining all the details, i sent her legal notice, asking her to come back. i have previously signed vakalat (green colour) and in two empty green sheets. but, her lawyer replied that she need divorce.when i approached my lawyer and said that i am not ready to give her divorce, he said that he can get me divorce without my consent, as i have already signed him the vakalat. he also threatened that i cant change my lawyer without his permission. he is pressurizing me to accept to give divorce to her. i came to know, he has been supporting my opposition`s stand. i have chosen a wrong lawyer. is it possible, he can get me divorce without my consent? how can i change my lawyer?

denial of registered marriage??-- very urgent

hi everyone.

i married a girl and registered the same without knowing to our parents. we lived seperate meeting only in weekends. after 8 months, due to a misunderstanding, my wife stopped talking to me and we were seperate. after waiting for 6 months, i sent a notice to her house, asking her to return to me. her family members came and asked to give mutual divorce, which i declined. now, they have sent me a notice that the marriage never happened and she has said that she came to register office only to sign for some other thing(for registering for a govt job).

i have photos we taken together and the messages she sent while we were in good touch . will it enough proof that we were married? i also have marriage certificate with me? after all this, can anyone deny that marriage is valid??

she is engaged to other person now and hence her family wants to hide all this, by stating that our marriage never take place.

in that notice, they said that i am blackmailing them and they will charge criminal complaint against me for the same.

we married july 2010 and now , after a year , she is acting as though she dint know anything about our marriage.

in between, if she happens to marry again, can i put case of bigamy against her?? will the court deny our marriage, as she is acting she doesnt know about the same??

walked out

Husband and wife have been staying in wife's govt alloted flat, on wife's insistence. Wife in the advanced stages of pregnancy (39 weeks) has left the house with her parents and gone to hometown against husband's wishes and medical advice (by air travel) on false medical certificate. She left house after husband had left for office, without giving him any prior intimation and has left the keys with neighbours. She
informed husband about this only shortly before flight was taking off. Husband's parents are staying in sister's house in same city and he can stay there.
(I)What should the husband do? (Ii)Does this count as desertion or being locked out? (Iii) What will be implication of taking the keys from the neighbours. for your information,her parents had been staying with the couple in her flat since last one month.

Court Marriage without consent of parents

I love a girl and she too loves me. We want to get married but her parents are not ready. My parents are ready for the marriage. So we want a suggestion on Court Marriage without consent of her parents. We feel that her parents, being Lawyers, can cause some problems for us in the post-marriage period. What all consequences can be faced after the marriage from her parents' side? Will it create any case of kidnapping or Co-ercion or will there be no such issues and we will get a smooth grant from them after the marriage? And even if they create a problem what measures can be taken from our side.

contempt of court

Pending cases-498a, Divorce case filed by me in lower court, Section 24 Maintenance decided against me.

Against maintenance judgment by lower court, I approached Delhi High Court and filed petition of CM (Main). The petition was disposed of by High Court with the direction to both the parties to go to Delhi High Court Mediation centre for settlement of matter (based on our request).

The mediation proceedings went on for six months and a settlement agreement was signed by me and my wife in presence of both the parties lawyers and Delhi High Court Mediator who also signed the same.

According to settlement I prepared the DD towards first installment as per settlement agreement and asked for my wife signautare for Divorce Petition of Mutual consent in line with agreed settlement.

Now more than one month is over and she is neither willing to sign the paper nor take the money.

My lawyer is asking me to file a petition for contempt of court.

Please advise whether it will help me and if so how. She is in governement JOb
