Mrs. A has been harassed by in law and he has been thrown from the matrimonial home and thereafter she filed a complaint in CAW cell against her husband and there after the husband called in caw cell and copy of the complaint has been given to him.
in the complaint Mrs.A alleged several allegation against her in laws but she also wrote that she has not apprehension but sure that her husband has illicit relationship with her bhabhi (sister in law).
thereafter to blackmail Mrs. A,the sister in law has filed a defamation suit against Mrs.A for defaming her in the complaint which has been filed before the CAW Cell.
the complaint of Mrs. A is still pending with the CAW cell. now my question is whether the defamation suit is maintainable or not? what kind of defance Mrs. A can take in the defamation suit.
please advise me. i will highly great full you.

Hi
My sister has already got an ex-partee divorce from NRI.
NRI family is absconding and living in Canada.We have put FIR against them for this cruel behavior. However, no action has been taken by the M.P. Police.Infact, this case is already going on in district court.
I am wondering if I can file RTI to get a clear position on action taken and the reason for delay.

Can family court order/give date for settlement during evidence stage without request from both/any of the parties? Who will be the in-charge, counselor or judicial member, of settlement process? Do I have the legal right to object if petitioner comes with her relatives to support her during settlement? If settlement fails, will the whole conversation / points noted be sent to judge?

Hello,
I’m Asghar Ali and from Bangalore (India). My age is 30 and I got married 2 years before. I’ve a daughter who is 1 year old. 3 months before I had an issue with my in-laws. My wife was ready to come along with me on the day of quarrel; however, at the same time her uncle spoke to her something and said she’s not ready to come with me, so I left her over there. After one week when I had been to my in-laws house to bring back my wife and kid the house was locked. Immediately I called to her uncle but her uncle denied telling me where are they?
I spoke to her uncle once again and told me that my wife is angry with me and she’s not ready to live with me, hence, she has submitted the petition with local Jamat seeking Qula (Divorce).
I tried reaching my wife but her mobile is switched off from that day and her family is not allowing me to meet her. I tried reconciling with her uncle but they are not ready to talk anything except in front of Jamat. Jamat hasn’t called us yet and I’m not sure when are they going to have this discussion.
Now it more than 3 months, I desperately need of my wife (by emotionally and physically as well), in this case can I go for second marriage instead of waiting for her. As per Islamic law there is no approval required from first wife for second marriage. If I can get second marriage, what and all the procedure I need follow (like getting fatwa or other documents for second marriage).
Please suggest me the best at the earliest!

Under DV case, if defendants shared household, but some of them are not coming on hearings ,what action can be taken against them AND HOW?What abt NBW?

it is granted by local court.. my case is filed at sojat city rajasthan.. please tell me if i argue in court that we are proceding towards settlement with the opponent party.. will court grant me another date.. see i dont trust my lawyer and opponent lawyer.. they are asking for money unnecessary..

i want to know what happens if i delay in paying maintenance amt on time... i have lapse 2 court date... what would be my next step... if i dont have money...or what happens if i still dont pay by month..

Respected lawyers,
Wife with her father filed a 498a,406, 420, DP act sections .
After 3 or 4 months again they lodged a DV case asking for a Compensation in a fast track court.
Why they filed DV petition after 3 months asking for compensation?
My question is why they are not applying for Divorce and claim for compensation?
Do I need to apply for a divorce? or
Shall I wait for them to file a divorce too?
Need your lawyers help to understand or to expect the inlaws next steps and their intentions?
