Husband is an indian & Muslim citizen and his wife is canadian mislim citizen. Both married a year back in india through muslim rituals, and both went back to Canada as the visa of husband was sponsered by his in-laws. Quite some time inlaws along with wife started harrasing husband. husband came back to india. Now he want divorce. which law will be applicable as the wife is canadian citizen and shariah law does not prevail in Canada? And what is the liability of husband. It is pertinent to mention here that husband do not have any property in Canada.

i am Akhalaque ahmed from Nagpur marraige on 09 may 2011. i have querries abour RCR act they are:-
1. benefits of RCR for husband.
2. if i fill a petition under RCR before court, after that my wife fill a case like DV, Dowery, divorce & furure maintance etc etc.in eyes of law whose is more safe from law point.
3.if suppose court give order to wife please stay with husband. if she denied court order then what will happen?
please give me detail solution for my every querries.

Dear All
I would like to seek your advice on behalf of my Friend, who is married for last 32 years. She is the mother of 3 children, all of them are well educated and in employment.
Her husband is in a govt job for last 35 years. Differences were there between them right from the beginning. He has been harrasing her and asking her and 3 children to get out of the house without any blame or fault. In this situation, what legal rights are available with her. Husband has one ancestral property and one self occupied property.
My friend has been facing mental cruelty for many years now, her husband has not allowed her to have any relations with her parents, who are no more now. He has been creating nuisances in the house every month. And now last week he behaved in a very rude manner by shouting very loudly and has asked them to get out of the house. When asked for any reason, he has no answers. Its been a mental torture for the family to live with him.
Please advice.

Can a 1 week pregnant woman continue to be pregnant, although husband dont want baby now?

I mean, I care about family planning but she don't care about it.

i am a 34 years married man & also have a 3 years old son.i want to file a divorce against my wife on the grounds that she creates disharmony in my joint family,use slang,beat my son brutually,expense unnecessarily.my family members are scared of her.she tortured them mentally in such a way.she even doubt me with each & every girl with my own sister,bhabi & friends.with her this suspicious nature she destroy my business place by blaming me with my lady assistant creating a scene there.she destroyed my reputation.now people mocked at me in neighbourhood n others.she is forcibly staying in my house.my lady assistant gone in the depression state & even attempted for suicide.since that incident i am not staying in my home.i am living out of station but still she calls me & blames me having relationship in out station & if i donot receive her calls ,she beats my son brutually.I want to file a divorce against her & get rid of her as soon as possible.please suggest the possible way.

Hi All,
The District Court passed order in favor of me on child visitation, to see the child at wife's house on holidays with prior information to her.
But the wife and her father vehemently refusing the visitation.
In the court order it is said that wife should co-operate and make such arrangements. The court also said the husband should not abuse or use physical force if the visitation was refused.
I fear that if I visit their place they will file one more criminal case to prevent the visitation
Please advice what should be done next? Is it contempt of court order? Should I have to apply executive petition? or modification of order.
How to prove to court that wife is denying the visitation?

Hi Xperts,
NO mariage certificate - NO complete 7 pheras, BUT my marriage was buddhist. FYI- I am SC.
Can DIVORCE be possible on ground that NO complete 7 pheras was done, and NO mariage certificate is there?
ADDED : my marriage was done however, with just 5 pheras. No marriage certificate is there.
ALSO : can my marriage be null on these basis
OR Whats basis can a marriage be null?

Can a women not listen to her husband for family planning?
I mean, my wife and I got married, however, after some weeks I got to know real her but it was late, she got pregnant, now she is not ready to listen to me as I want some time and space to know her more before I come to any conclusion. So I ask her that we can have baby later, but she is not ready to listen.

If I don't put any surname after marriage, what problems can be arised in future?
But when I will file the on line I.T. Return or might be will do any rectification in my PAN card or when I will apply for the passport, they will compulsorily ask my SURNAME, then what I will do? Whether I will not be possible for me to do on line return filing ????
