Hello to All Experts.
My query is :
What is the procedure and requirements for change of Advocate in family Court. I have appointed an Advocate for my sisters case but i now want to appoint a another advocate and to discontinue with the present Advocate who is at presently handling my sisters divorce case. What is requuired to be submitted in the court and whether any acknowledgement is required to be obtained from the preesent Advocate before appointing a new lawyer. What is to be taken care of so that it does not create problem in future litigation of the case.

Respected sir I have got divorce on 7 june 2011 under mutual Con. That time my X wife gave written statement in front of judge that my son will be remain with me ie father. She was first party. Now after some months she is forcing me to give my son to her my son is 3+ years old. I do not know why she is doing so. I am very afraid I don’t want to give my child to her. She is saying that she will reopen the case and because child is only 3+ years old. Court will give son to her. Please sir help me I and my parents love him very much and I can not live without my son I do not know why she is doing so. Plz help me I will be very thank full to all of you sir.

I got married 3 yrs back and my huband left house 10 months without intimating me when i was at my mothers place and when i reached him i found home i found him missing.I tried lot to find but all attempts were usuccessful.Later on i came to know that he has filed complaint in nearest police station that i had forced him to leave and that marriage was conducted dowryless which seemed to be his preparation for divorce case.Subsequent to that,he started sending me divorce notices and every attempt which we made to talk to him failed.My inlaws told my relatives who met them for reconciliation that they want divorce.
Later on ,when i filed a case in woman cell in March ,my husband didnt agree for reconciliation in cell in front of counseller and i then withdrew my case as i didnt wanted sepearation.
After that ,i met my husband at his office but he is not ready to come back.He just wants me and my family to meet his lawyer in his lawyers life.
Honourable experts,please suggest should we meet him in presence of his lawyer and that too to in his lawyers office.

I am Pradeep from Chennai. We had married my girl on 08th April 2010 under special marriage act.Am belongs to Hindu and my girl belongs to Christian. Both of the parents give opposition to our marriage. We live with our parents separately till 08/04/2010. Now we plan to surrender in front of the police commissioner and ask them to protect from our parents.
My queries are listed below:
Is there any problem arise when we are surrendering in front of commissioner?
Is lawyer required or not?
I have the marriage certificate with us for safety.
What are the other problems arises regarding this.
Pls clarify.

Dear experts,
DV case was filed in Dec 2010. In two dates, only reply has been filed. Mediation over without any result. Third date is coming in Nov 2011. Now I came to know, MM for my case has been changed. Could you please tell me what will happen now? Will there be any delay because of MM change?

Sir, i want to ask a question in regard of my friend whose x-wife lodged false cases on him and his family, she did 506 294,498 and DV the case took almost 4 years finally my friend & family won the case The cases were dismissed as it was not proved. My friend spent so much money to fight these cases, so he want to file for defamation against xwife, I request you to plz provide information on defamation case and how long it takes and is it worth to spend time for this kind of cases?

sir i was married last year december my wife hardly stayed with me for one month and went to her parents place without intimating me nor my parents now its hardly 10months completed she never returned to me whenever i call her she complaint me about my sister and mother though they are innocent towards her. in the period of one month she use to quarrel with me and my family on one issue or the other and also she use to take depression tablets every day which i dont know and when ever i called her to come and stay with me she make an issue of my mother and sister but as i am the only son to my parents i had lots of responsibility towards my parents abd my sisters and now i approached a lawyer and he suggest me to file restitution of conjugal rights.my doubt is that i stay in anantapur,andhra pradesh and she stays in indore,madhya pradesh is there any chances for her to transfer the case to her place where as the marriage was performed in my place only and last residing also in my place only. It clears that juridiction comes to my place only plz let me know clearly whether she can transfer the case to her place and if she transfer the case then what are the [possibilities to stop the tansfer of the case to her place plz reply.............

I am 40 years of age staying in a flat owned by my parents. I am staying with my parents, wife and son. I am suffering from paralysis of both the legs. Due to this I find very difficult to work and earn and I keep on leaving jobs and remain jobless for months. Currently I am earning around Rs10000/- pm. I do not know how long I can do this job.My wife is also earning around 7000/- pm. My wife wants divorce from me. Looking at my low earning potential and at times jobless for months together and paralytic condition, do I have to pay alimony to my wife after divorce. Looking at my paralytic condin and low earning potential can I request the court to grant alimony to me from my wife? Please advise.

Domestic violance
Husband has filed divorce. I gave complaint to police station on the tortures which i faced by him and inlaws. But since the civil case is pending in court, the police is not takine the complaint.
what to do?
