Custody

Today I spoke to my lawyer regarding moving an application for visitation of my 7 year old daughter in the same 125 case.

My lawyer replied that this court don't have powers to allow visitation, you need to move High Court. Then I requested him to file a custody case under G&W act. He replied that for a girl custody under muslim law you need to file case after she is nine years old.

Now I am confused that muslim law never came into picture in 125 case and regarding custody I need to wait for 2 years.

Kindly reply if you believe that fathers too, love their children.

Maintainability of perjury’s u/s 340 read with 193, 200 & 2009 of ipc in the decree execution court.

Kindly advice whether the decree execution court (RCR Ex-parte decree) in reply to Ld. Court’s show cause notice by the judgment debtor, a perjury u/s 340 Cr. P.C. read with 193, 200 & 2009 of IPC is maintainable against her false statements (documentary evidence available)? Can the decree holder file a separate petition u/s. 340 Cr.PC etc. and prayed before the Ld. Court to proceed the perjury petition first before dealing with the main proceeding to prove that the decree holder is innocent?
If yes, what will be the procedure and prayer before the Ld. Court?
