Change of advocate

Hello to All Experts.
My query is :
What is the procedure and requirements for change of Advocate in family Court. I have appointed an Advocate for my sisters case but i now want to appoint a another advocate and to discontinue with the present Advocate who is at presently handling my sisters divorce case. What is requuired to be submitted in the court and whether any acknowledgement is required to be obtained from the preesent Advocate before appointing a new lawyer. What is to be taken care of so that it does not create problem in future litigation of the case.

If you want to change the lawyer you will have to take no objection on the vakalat from that lawyer, if he didn't agree for that then issue notice by terminating his vakalat.

If you are not satisfied with your advocate's services,definitely you have right to appoint another advocate but before appointing another advocate you have to take No Objection from previous advocate and if he does not agree then withdraw the power by issuing notice to him.

You can change your Advocate by executing a fresh Vakalatnama to the new Advocate,but it is better to take "no objection" from the previous Advocate.

Right to your defence through a lawyer, whom you consider to present your case effectively, cannot be denied. If the present lawyer does not give you no objection, you can represent to the court of law with appropriate reason for proposed change.
