Dear All,
I seek your expert advice and guidance,I have got married in years 2007, my wife is staying with her father from last 4 years ,she has filled 125 cr pc, till now no maintaince order has been passed, I have filled divorce in 2011,now she is ready for mutual consent, we have submitted consent terms to the councilor, and also applied to court for converting my divorce petition into mutual content under section 13 B.
As per mutual consent terms I have deposited first installment via demand draft favoring Principal Judge Family court.
Now the wife lawyer has again applied for amendment in my divorce petition and deleted some of the allegation made by me in my divorce petition and requested the court to convert the petition into mutual consent under provision section 13B.
Kindly advice whether the above process is justified and required in mutual consent divorce.

I love this girl, but the situation is that my grandfather and her great grandfather are brothers. I want to marry her. I want to know if this is legal according to the hindu marriage act? And if not, can I legalize it by converting my self into Buddhism?

i have my father"s property in kerala which is self acquired by him. now he is mentally disorder . my mother not willing to do division. we are 3 childrens two girls and one son.. so can we go through legally? n how will be thw partition then?

My Wife had filed a divorce case according to muslim law around 3 years ago after leaving her matrimonial home and 2 sons, appointing my ex.advocate for the needful.
Before the filing of the divorce case in the court they were very friendly and we have found out that they also had opened a joint bank account together with instructions as either or survivor and he had also been the introducer for the joint account. The address for my wife was the matrimonial address as this was opened with address proof and his house address as the introducer's.
They also had a locker in the same bank on her name and had nominated him. In this her address was his office address and his as niminee was his house address.
The account was immediately closed and the locker account too when the same was found out about and has already been produced in the family court.
We had also previous to this filed adultery case on them.
He also picks her up in his car everytime they come to court from her work place.
Could this prove as adultery and is this amounting to professional misconuct as a lawyer.
Could we apply any criminal case on him for misguiding and misleading someones wife(that to ex. clients wife whos accounts and properties he knew of ins and out) besides adultery. If so under what sections.
Also is the wife entitled to any property or wealth in this case.
Kindly guide.

Hello Experts,
Husband files GWA petition for custody. Wife delaying the written statement from long time to avoid meeting father to a kid.
What can be done in this situation ?
Can we argue for striking off defense in GWA application as not filing written statement from long time ? It should be verbal argument or written application ?
Experts please help.

Wife has filed suit for maintenance under crpc 125. Husband in on govt. job and has been appointed in above job under dependent case of his father being declared medically unfit for the job. Before appointment husband was required to file affadavit that he will take care of his parents and in case of not doing so his 50% salary will be paid to his parents. Husband's net salary is around Rs.20000/-. Parents are staying with husband. Wife did not obeyed sec.9 hma decree and had also filed case under 498a.
Can husband get relief of his salary being considered Rs.10000 i.e.50% of his salary under provisions of CPC, sec. 60 or any other provision?

A father wants his child to his custody, but in between the parents of the child there was no marriage held, the father accepted the child gladly and gave maintenance all the time whenever the mother of the child wanted for the child's education or for any other necessity. Now the father wants the child in his custody because the mother of the child is not taking proper care of the child, and in the name of the child's education grabbing money from the father, In the mean time the mother of the child stopped the father to meet his own son. In fact the father is not getting proper news of the child also and he wants to admit the child in any good school for his good education which is not possible for the mother because she is keeping the child with an illiterate servant as she is a working lady.
i have filed a case u/s 25 of the Guardian & Wards Act, 1890.
This is the fact of the case.... can u give me good recent citations in favour of the father who is seeking to see his child and to take custody of him.... need it very urgently...

I with my wife is going to file Mutual Divorce petition in the court. We have also got a small daughter of 5 years .Currently the daughter is staying with her mother. Sir my in laws have promised me that my wife is not going to remarry again ever in her life on the basis of that I agree to file Mutual Divorce Petition and give 11 Lacs in the form of FD under my daughters name for the bringing up for my daughter as my daughter will then be look after properly by her mother....I have a doubt that if my wife break the promise of remarrying so will the custody of my daughter automatically come to me under Hindu Law???? or should i get this condition mentioned in the Mutual Divorce Petition before filing the same in court???????????? as I am very much concerned about my daughter .....and my wife is not at all ready to stay with me due to interference of my in laws in my matrimonial life.

Which medical test proves that there is no physical relationship between husband and wife.
Respected sir/madam,
I need your help in one case of my friend. He was married and his married life was a case of misery and loss.( I am sorry i cannot give much details of his case because of his request.) He needs to know what all medical test he can ask the honourable court to prove that he doesnot have a physical relationship with his wife. His wife always refused to have physical relation with him . He testifies that he doesnot have a physical relation with her but now has to prove to honourable court.
Request you all to please help in this matter.
