Property issue

i have my father"s property in kerala which is self acquired by him. now he is mentally disorder . my mother not willing to do division. we are 3 childrens two girls and one son.. so can we go through legally? n how will be thw partition then?

As long as your father is alive you can not divide the property. However given his mental condition anyone of you may apply to the court for appointment as his guardian.

Do not make hurry to get his property. Concentrate on giving proper treatment to him.

Well said Barman Saheb. Interested in self-acquired property of the father instead of get him treated well that too against the wish of the mother! Mental disorder is not such a serious illness that it can not be treated. Leaving apart sentiments there is no legal remedy available at present to get this property by the children.
