hello all,
i filed divorce case against my wife. she filed DV, 125, 24, and 26.
she was granted 30,000 as maintenance under DV case. after 5 months she got 50,000 maintenance under 24.
My question are
1) if i withdraw divorce petition what will happen to section 24 maintenance order. do i have to pay even if i withdraw divorce case.
2) my wife is not willing to live with me, can i file RCR , what are chnaces to get divorce in RCR

Now could you please tell me is there a way that i can get my husband out of his family and ask him to stay speratley with me coz that itself will decrease half of my burden Is there any law that I can go legally and seek justice, is there a law that says the boy should stay seperatly with his wife if his mom is mentally unwell coz. that would effect their healthy marraige life please suggest me something I am eagerly waiting coz what really happened on On 25th of Dec was my hubby n in-laws picked unwanted fight as usual but this time the verbal abuse was too severe and i was also asked to get out of the house so while leaving I simply warned them I am going to the police they all got scared and followed me immediately but vn they noticed my direction changed they still followed me to mom's house and abused me verbally unnecessarly about my character in public outside , my parents got shocked and warned them they will take legal action immediately for which my mother in law fainted dramatically and my husband and in-laws took her back saying they are rushing to the hospital but we dint hear from them for two weeks and on 3rd week my bro brother pressurised my husband to reply, now they are trying to reverse the case back on me he says his mom was in the mental hospital for 2days and skipped coma and he is already contacted consulted a lawyer in taking me back with terms and condition and we should face all consequence, now I am afraid of that coz( just 2 weeks before my wedding my mother in law kept us informed that she was mentally unwell and was under treatment and she said she now has recovered and she is perfectly fine from last 4years) so probably they are trying to utilize that in this case there is nothing goes less vn it comes to creating dramas and fake stories I have experienced this in every aspect with the days I I have lived with them

Sir,
Got married in Feb,2011 and due to differences between us we are living separately from August'2013. After one year she gave me a mail and asking for mutual divorce and accordingly we filed a petition for mutual divorce u/s 13B of H.M.Act 1955.
But surprisingly on the appearance date i.e. on 16.12.2015 (i.e. after six months of filing) she did not come and present at the Court and also did not inform us anything, I was present at the Court and took another date in January2016. Now, the situation is neither she wants to come back nor wants she to finalise this issue , so that I can not re-marry.
Now if the said petition is rejected, Whether I should file another petition U/s 13A clause 1(ia) or 1 (ib) or both. Also please suggest that if I file the petition U/s 13A , CAN SHE CLAIM MAINTENANCE IF I PROVE THAT I AM AN UNEMPLOYED MAN . But she has clearly written in mutual petition that she does not want any maintenance, has received her all ornaments from me does not have any claims from me and she is a self employed lady.
If I file petition U/s 13 1(ib), how long the case will continue and how much maintenance (approx.) can be granted from an unemployed person. I do not have any child or immovable property or immovable property, living in a PG house.
Please suggest.

Sir, My Sister is married to Reserve Sub Inspector in Andhra Pradesh State Police in 2007. We have given around Rs 10 Lakh dowry, 100 Tolas of Gold along with a land worth Rs 1 crore in Visakhapatnam.
The couple have 2 children (Girl and Boy)aged 7,6 yrs respectively.
The problem now is My Sister's husband is having illicit relation with a lady doctor who is divorced already and he is neglecting the family. He is giving. Rs 17000 Per Month for maintenance and occasionally visiting the family.. My sister says he is also forcing her to give divorce so that he can marry the lady doctor again. My sister says he is also harassing her mentally and physically.He is spending most of his time with his illicit relation only.
Now, my query is what are the best possible steps we have to do to take action against my sister's husband who has become a Psycho?? Being a police man, he is committing this heinous crime.

I mother in law(widow) aged 64 is a retd. teacher in Goa. She lost her son last year.
Her son owned a factory and few properties in Goa. Does she have any right in her sons properties.

Dear Experts,
I had discussed put up my case in this forum before and experts had opined on the same .But now the circumstances have changed and so again require opinion .
Facts in Brief
1. My-self Dr and married to Dr in 2006
( arrange marriage)
2. Stayed with my parents in their house
3. My mother-inlaws undue interference in
our married life
4. Tried to discuss with wife and my father-in-law but all in vein
5. 1st baby born on 2009. delivery done in our city .Mother-in law stayed with us for same.Stared fighting on simple issues like burning charcoal for heat for post pregnancy ( IV light already available at home ).Before taking wife to their home for rest Mother in-law threatened to file 498a and left off.
6. we had no contact with them for next 3 months.
7. in 4th month we got call from police saying 498a .306, plus some more sections filed against my wife and her parents and brother by parents of their daughter in law who committed suicide .
8. we kept part from them till judgment from court came .( 3 years period gone)
9.her Maternal uncle intervened with assurance that her mother will now stop undue interference in our life .So bought her back and started cohabiting back
10.learnt that she and her father made duplicate birth certificate of my daughter at municipal corporation at their place when i was having the original one ( when BC from one municipal corporation is issued ,can other issue the same ? ).kept quite thinking whatever it is , atleast i ahve my daughter with me.
( admitted my mistake, should have asked about 2 BC to clarify them )now have filed RTI to know what documents they have submitted to get same
11. interference from her mother still carried on .by 2013 next baby girl born
12. quarrel happened between me and my family with her regarding same .
13. left parents house and look other house on rent and started living there with wife and kid as did not want any fight to happen in future
14. aggression and fights from wife and mother in law increased and started fighting on any irrelevant things
15. by the time renewation of degree date was due for which we require to attain CME and collect certificates ( points) and submit same to medical council.
16. wife did not attended and got her friends certificate ,earesed her name and wrote her .made me to sign on her part saying if i dont do the same she will hang herself and me an my family members will be blamable for same .so had to sign
17.had to visit her village for some work .she handed over the certificates and told to get color xerox from there.
18.visited her parents house and told them what she doing is wrong but instead they supported her
19. same fabricated documents submitted to medical council
20.told her to accept the wrong she had done before they catch you for same.
21. instead she fought and made to go out of house.than called up on cell and said she is committing suicide and will write my and my family members name on suicide note stating we harnessed her .
22. ran back home ,had to break the door as she was not opening the same and found her sitting and playing mobile games.
23. stopped talking to her from then and just lived in the house for sake of my daughter
24. her parents came and said me that this marriage is over and to leave the premises and they will live there . i can meet my daughters whenever i want .
25. already bugged up i left the house and got another rented one for my self and started living there
26. visited on every alternate day to meet daughters
27.one fine day mother -law called and started giving bad words saying my daughters are ill and where i am.i was in clinic with patients .so told her the same and also told to speak properly.instead she banged the phone
28. annoyed with this i went at their place ( which was earlier my house ) and asked clarification as to why .she stated yelling and tried to assault me by hitting me with her hands . ( wife was not present there at that time )
29.left the house and than never visited back there.
30 .as i could not bear the wrong done by wife , i filed complained against her in medical council for submitting fabricated documnets
31.i am not allowed to me my daughters
my query..
1.should i file application for visitation rights or for custody of children .
2.should i file divorce petition and is yes on what ground .or should i wait for them to file the same as i will have strong ground for divorce when their baseless allegations ( if any ) proved false.
3. can i take part in person during cross and argument satge .
Imp--- i have video recorded all the conversation happened between me and her and her family members including the one where i was assaulted.

Hello sir, my father in law married someone around 40 years back and have 3 girl child, all are married, and he had given money for their marriage, they just married for 5 years n separated. Not sure whether registered or not. after 5 years he separated from her, not divorced, he without disclosing the 1st marriage, he married again in 37 years back and have 2 children, boy n girl, and this marriage got registered, and they lead life till now about 35 years, I married to second wife's girl, now he is again going to 1st wife, n asking second wife to go away, what happens to the property, how it is divided. After the second wife stayed with him for 35 years, they have all the ration card, court id, now what will happen to them, if he give all property to 1st wife child. What can be done. If he transfers the property to second wife, can 1st wife still can come to claim property, who didn't lead life at all with him. Please suggest what can be done by second wife and children.

Dear sir / madam i got married on 2013, as it was in vain as she was having habits of smoking beedes ,drinking, chewing tobacco. We informed her parents and they took her to their house which is 100km far after she was with me only for 1.5 months after marriage and she have filed complaint 498a and dvact on me and m family members. And recently I have got news that she has got 1.5years old girl baby.as I ve not undetwent any sexually commitment. ..as she have got married illegally now..
plz tell me what steps to take
