I loved a girl before marriage. She had to marry for certain problems. After 14 days it got unbareable n she returned home. She will be filing a divorce n hopefully it will be mutual. So after she files it can we get vack in to a relationship as 18 months time is required and after that we r planing to marry. Will this be considered as an extramarital affair once she files it?

Both husband and wife are Hindu and belongs to same caste. Marriage was registered under the special marriage act and on same day marriage was also solemnized as per Hindu vedic rituals. Now they want to file divorce petition by mutual consent. Now issue is should I file divorce petition under section 28 of Special marriage act or Under section 13b of Hindu marriage act.

Dear Sir,
My self private employee. Performed Muslims marriage in 2008 and
NOT REGISTERED in the special marriage, first wife DVC is pending not given Talak to the first wife and not applied for divorce and her name also not included in the passport.
Two years ego, I got married to another Muslim girl with Islamic way. I wish to register the second marriage in special marriage act for the purpose of passport and to include directly second wife name in the passport. Passport office is stating registration of the marriage is compulsory.
my question is
1. in the special marriage registration form there is one question which is to be signed by both husband and wife "HUSBAND IS UNMARRIED/MRRIED/DIVROCED ---?"
As I do not have first wife death certificate (since first wife alive) or divorce decree or talak, can I state that I am unmarried and register the second marriage as if it is first marriage?
2. After signing of the form only, a Muslim will come under the civil law.or his entire life is under civil law?

one of my friend has given cross in the court and when the respondent(his wife) cross came . she never appeared and the judge orders no evidence for his wife. Now the final argument are starting would it be helpful to win the case for my friend if no evidence is done. the case is only for judical seperation and child custody.
Also i know the family court not allows the child custody however few of lawyers says there is chance in such cases where negligence is done againt child and family court can order child custody too. but i really do not know which law is applicable in this.
also if i can know any online material available for sc/hc hearing for child custody.

I got married under Hindu act... I'm 27 years old and he is 34 years old... From day 1 there is no sex relationship between us... after 4 months I take my husband to doctor.. he told that my husband has problem which is related to sex... after that doctor took some tests and told he has very less posibility ( means only 10%)to get child.... he doesnt even care about this he went to office daily and come have food and sleep... I was shocked and totally upset thought that my life gone waste... daily i was crying a lot alone... then I was searched so many ways how to get child .. after 1 year i went to infertility specialist and told my story...after that I got one solution... after all these I have gone through ivf treatment.. in my side I'm having good health condition... in ivf treatment only i got pregnant in first cycle itself... I took my full effort for this child... my mother in law and father in law both are money minded... both didn't come and didn't give me even a single help.... my mother in law always torturing for dowry from day 1 of my marriage my husband also torturing me he didnt understand my feelings ... now I decided that my child is enough for me through out my life... now I'm 3 months pregnant through ivf treatment... my doubt is: I need my child till end of my life.. if I'm applying divorce means I need my child with me till end... is there any possibilities that my husband take my child from me.. pls give me suggestions

My father (deceased last week) converted to Islam for sake of marrying another woman- and even took permission from State Govt under the garb of conversion to Islam.
My mother is Hindu, married as per Hindu custons, is still alive and not divorced. Had to seperate and forcing leave her matrimonial hone 27 yrs ago, as father was bringing another woman hone to co-inhabit.
....
My father & his second wife never adopted their Muslim nanes in any correspondence / official matters. Even his last rites and subsequent poojas were done as per Hindu customs (Chautha, Pagdi rasam).
My Question is :
1. How does one prove Fraud conversion to Islam.
2. Can my mother file for cruelty against other woman after 27 yrs?
3. Can the permission of state government for second marriage granted to my father in 1989 be quashed by court as illegal?

I am a father of 2.5 years son. I have applied for child custody under GWA with interim application. Judge had passed order for interim application that i can take my child from her home on last sunday of every month from 10:00AM to 02:00PM. I had gone her home to take my child but my wife and her family intentionally was not present at home.Now my next date of visitation is 27/03/2016. After that i have date of hearing in court 01/04/2016. My questions are
1.Can this be consider contempt of court?
2. I am also afraid that this time they will not be present at home.
3. What remedy can be taken to maintain order passed by judge?
4. Is there anything can i do before my hearing date?

My great grandfathr was having two wife. First wife is having one son and second wife is also having one son who is my grandfather. Now the whole property is registered in the name son of first wife who is issueless. Now my father who is son of second wife son of my great grand father. My father has instituted inventory proceeding with respect to whole property. Now mutation process is going on in mamlatdar office and cousin brothers of estate leaver have filed objection stating that second marriage of my great grand father is not registered in any office as such we do not possess any rights. They have filed civil suit and their claim is that my great grandfather has only one wife and we are no way connected to their family. I do not have any record regarding second marriage of my great grand father. Please guide me what should i do?
