Hi,
I am 32 yrs old.I was married on sep5th 2005.I have one son (7yrs)we were together till may 2012,after tht misunderstandings we're happening with us and I came to my parents house and stayed there for about 8 months.after lot of convience,again i went there on jan29th 2013and stayed till March 23rd 2013..bt still the problem hasnt solved and from mar23rd 2013-till now I'm residing in my parents home. My son is with him..as he likes his father much..I didn't pressurize him to stay with me.Now I feel to get seperated from him permanently..to carrion my further life..I don't need any compensations from them..I don't force on child custody.Im looking for a mutual divorce.
what should i do for that?
How should i approach them for mutual divorce?
If they deny?how long will it take it there is no mutual consent?

sir,
my father died before 2 years ago. to withdraw his bank balance i made legal heir where my name, my mother name and my elder sister name is there as unmarried. before some months ago she ran away with someone and left the house. now my mother and only i live here.
as i heard that while joining some service some companies (like banking sector) ask details about family background, assets, no of person living in house.
so to avoid this i need to remove her name from legal heir and from all the documents where her name is mentioned. so is this possible or what type of problems i would face in future if i will do this.
and i am not interested in property. is she demand her share in future i can give her part.

Dear experts,
wife is suffer with the problem of Epilepsy since childhood. At the time of marriage neither the husband nor his parents were informed about the same. within a year of the marriage wife became pregnant and had some complications. during medical checkup the doctor asked about the history and the details of treatment taken for problem of Epilepsy but wife and her parents avoid to provide the papers. due to such problem of not providing the details of the treatment taken for the Epilepsy all most all the private medical practitioner refused to provide the treatment hence wife was admitted in government hospital wherein also the doctors asked rather forced the wife to provide the case papers of the treatment of Epilepsy hence she submitted the same before the doctor.At that time the husband very first time aware that since the childhood his wife is suffered with Epilepsy.
After the delivery the doctor advised not to go for second child. But after about two years the wife again became pregnant and she had hide the said fact from her husband for about more than four months. again after certain complications she gave birth to a child but after second delivery she often visited at her parents house and now since last about more than three years she resided at her parents house.
my query is that can a husband file a divorce on the ground of separation or can he file a a petition for declaration of his marriage as null and void as at the time of marriage he was not informed by the wife or her parents about the Epilepsy problem. How can he prove the same.

Respected Lawyers,
I am going through a contested Divorce case filed by my husband. I have also filed a Domestic Violence Case against him and his family and my father-in-law has filed a fraud case against me and my father.
I have been in this for the last three years and am very disappointed with the lawyer's services who have been representing me till date.I am also not in a financial position to pay their exorbitant charges anymore as I am not working.
Please let me know if a friend who does not have a law degree, represent me in these three cases in the court?

Sir, me and wife decides to get mutual divorce on settlement of Rs. 5 Lakhs on condition that wife will cooperate to quashing in high court but I have doubt that she has mala fide intentions after getting Demand draft Rs. 5 lakh she will not get divorce in that condition how I can stop payment of Demand draft.

I got married in May 2015. my wife deserted me six month back when she was 2 months pregnant. Inspite of 2-3 round of negotiations, she is not ready to come back. She sent me legal notice through her advocate wherein she is asking for maintainance & divorce. in legal notice she had mentioned reason for leaving is husband forced me to leave Job because of his doubting nature which is not true. in reply to her notice I asked her to return matrimonial home with 7 days of receipt of my notice. but she instead of returning home she file divorced petition in court. now she is asking for a maitainance and child custody also. About her qualification she has done B. Com & having 4 years work experiance in small propritory firm .After marriage also she was working till she was 2 months pregnant & her last drawn salary is 20000/pm. Now she is not working.I Am ready to accept her back & I dont have any issue with she is doing job in future.
About my qualification I have done B.Com and having monthly take home salary Rs. 42000/- & Housing EMI 18000/- & personal loan EMI 8000/- PM (taken before marriage)
My question is
1) Can I deny maintainance amount as she is B.Com with 4 yrs experience.
2) is she eligible for maintainance? If yes what will be the maximum amount for both wife & child
3) Can court consider her as qualified wife if she has done only B.Com with 4 yrs experience. If yes please provide judgment ref.

Hello All,
I have posted earlier related to divorce case my husband wants to file. I have married on Feb 19th we only stayed for few days and my husband went to haryana on march 20. He has doneB, LLB, ML and now doing phd in law but not ready to work and he is 32 now.
My husband said he married just for the money I earn and the jewels and property I
have.Form March till early june there was no communication between me and him.
On june 5th we had meeting with our families for negotiations.
Day:1
I consulted the people who did this marriage and my relatives and arranged a
negotiation.I was very stubborn to live with him but he said if you people make me to live with her I will suicide and then after long hours of arguments he simply said he doesnot want to live with me and accept me. Since he said he doesnot want to live with me one of the mediator asked to return the 45 sovereign gold and all the belongings which he said yes but later denied stating it was in locker.
Day2:
He returned the gold after a long drama taking one pair earings(1.9 grams of gold).He demanded my mangalsutra and the engagement ring which everyone asked to remove if he is not ready to live with you.Then we have asked for the other materials and money which he took from me and denied by him.
Day3:
He asked me to sign notary stating that due to differences in ideology and preferences we opted for divorce which I denied and demanded to make a full settlement of 126000 of cash given as Dowry and the Mobile phone which I bought.Then my husband did drama he doesnot want any divorce and he was under stress by the panchayat people so opted for divorce and wants to live with me. The real story is he doesnot want to earn and is doing phd in law at haryana. He simply takes money and spend lavishly for shopping. Now he says he will file RCR on me and makes me to come to his home and then he will torture me, He then files divorce and he will not let me to court for 2 hearings and he will get the divorce in 3rd time.
After all this drama, even I do not want to live with him becoz i have found that in past he had sex with his student and seperated by signing a document that they do not hold anything for the accident.
My question is how can I get the money which I gave as dowry and the other materials with Divorce as he has only a house in his name.
