I am muslim married for 20 years and living abroad with 2 kids and wife and returned back with family in 2010. Due to misunderstanding she left the kids and went to her parents home and is working since then and not sent a single penny for their welfare. It is six years now since she left. There was no one to look after my kids who were 10 and 12 years old in 2010. In spite of repeated calls by the kids she was not willing to come back and they even told her that I will remarry if she does not return. So had to marry another muslim girls to look after us and life is going on for us. Also I am jobless for the last 5 years and my mother, brother and sister are helping us to pay for our house rent, food and kids education.
Now she has filed for dissolution of marriage citing cruelty and not paying any maintenance. Asking for dissolution on ground of cruelty and desertion and any other order the court may deem fit.
I dont want to pay any maintenance as I am jobless and kids burden but willing to sign the dissolution without any maintenance. If not can i tell the court she must come back to her matrimonial home and take care of kids education even though I have second wife living with me. What will be the courts point of view. Is she liable to pay for the children's education as she is working? she had earlier filed for custody but is still pending as she stopped coming and the kids had clearly said they want to stay with the father.

Dear learned members,
Dv case going on in Bangalore. In August 2015 issued summons through RPAD to the respondent's HR manager which was returned saying wrong address,but i'm sure husband is still working in same organisation. So As suggested by my lawyer I had sent a fake courier mentioning husband's Reg.no. and block and other details by XYZ name which was received by concerned staff. I collected acknowledgement from courier office. Have 2 questions here
1) How far this acknowledgement will help me to get salary details from husband's office when summons issued to HR for salary details again?
2)Order also passed to issue summons for salary details through protection officer to HR manager of husband. Can i accompany protection officer to husband's office so that they don't mix up with him and return courier again?
or please suggest other procedures if any. Thanks in advance.

My wife filed 125 crpc seeking maintenance. I gave proofs that I was a shop keeper which High Court also mentioned in its order but now circumstances have changed, I have started doing job from the last three-four months.
Query?
How can I tell the court and bring this on record that circumstances have changed as I am doing job now.

Hi, My sister and her husband have been living apart since 2013. She lives in Bangalore while her husband lives in US since 2013. They have issues and thus applied for divorce with mutual consent in the local Bangalore family court. After 6 months of cooling period, at the final hearing, both of them had cold feet and withdrew the plea. But soon they realised they cannot live together at all. They kind of have moved on in life and thus now are sure they want a divorce. If they apply for divorce with mutual consent again now, is the cooling period compulsory, because that would waste another 6 months of their lives. Is there a way to avoid those 6 months?

Respected experts,
I'm PRIYANKA,Filed 498a on husband A1 and his parents(A2,A3). Hearing started. 5 hearings over so far A1 only appearing on all the hearing dates. A2,A3 who are on AB didn't appear in court yet.
Can A2 and A3 be discharged from 498a before trail without cross examining witness? If yes under what IPC section? My brother is the eye witness here to prove their physical and mental harassment against me. I have voice recording of his mother A3 asking my dad for property on my husband's name which is not submitted in the court yet.

Hi, my name is a venkat raman, my age is 24 when I was 2 years old, my grand mother executed a will stating that one house is given to me after attaining 18 years by keeping my father as guardian. But the said will has not registered and my grand mother died in 1996. In order to sale or to keep it as mortgage the above said house is this document is valid or not.

Hi Experts,
I got married on Feb 2013. And lived with my spouse till September 2013. My wife left me and on Feb 2014 she had filed nullity of marriage for non-consummation(she had not given her consent for intercourse) of marriage. I contested and represented as party-in-person and the case has been dismissed on June 2016. Overall we are living apart for more than 2.5 years.
My query is "DOES ANY HINDU SPOUSE OF WOMAN CAN REMARRY WITHOUT GETTING DICVORCE DECREE FROM HER HUSBAND"? Is it a valid marriage as per LAW?
Is there any such provision in Indian LAWS for a woman to re-marry like that?
Please help me in this regard.

until what age does a father needs to provide maintenance to child if wife files a maintenance ? Is it 18 if it is a male or until he gets a job ? Kindly need reply & help experts
