My brother filed for sect 9 to call her wife to reside with him in 2013. But she transferred her case from supreme court from Mumbai to lucknow. The ground for transfer was
1 she being a woman cannot travel alone due to lack of safety.
2 she has no relative in Mumbai.
3 she has no money to afford travel.
All of these are false
Can my brother reapply for retransfer to mumbai ? On what grounds and under what section

sir, my wife has filed 498a, 406 against me and my family members. now she is ready for compromise and we have filed divorce by mutual consent.
please suggest whether we should go for quash of fir in 498a or quash of criminal proceedings and what is the difference between this. pl. advice as i am a government employee, and this matter is pending about 10 years. but yet evidence of my wife is not complete.

i have obtain decree of restitution but the decision is exparte. now whether i can obtain decree of divorce on that ground. suggest me any case law in this regard.

the marriage never occured officially and unofficially or neitherr of religious nature, I need to get a null and void marriage decree or decree of nullity of marriage, for the same what documents are needed ?

Wife went with girl child 5 yrs old to her uncle's house where her mother lives. I called her to enquire about the health of child, I could hear her mother instructing her not to say anything. I scolded her and her mother for that, and switched off the phone for 1 day. She did not come to our house after 4 days as she had told earlier. No phone call from her. child often catches cold that results in life threatening wheezing and pneumonia. I could not call her or go to her uncle's house because she and her mother insult me there. It is 15 days since the incident. I am deprived of seeing the child. She and her mother beat the child often. What can I do?

Dear experts,
I am from Indore (MP).In 2014,My elder brother died due to heart attack in the age of 30 Years.At that time,My sister in law was pregnant & later she had a baby boy.Since she was very young and hence we get her remarried.
The child is with me and I am taking care of him.
Now I want to adopt him legally so that in school & other record,My name can be written as father name & my wife's name can be written as mother name.
Could someone pls let me know this intra family adoption procedure?

Hi,
Please provide some more clarity on below points.
1. If a Muslim man is already married under Nikah and wants to marry another woman under Special Marriage Act is this permissible and if Yes then is it permissible without divorcing the first wife legally?
2. If this Muslim man approaches the court for special marriage act to get married for the second time then what should be his marital status which is to be declared in the affidavit Married or Bachelor?
3. If this Muslim Man declares himself as Married will the second marriage commence through the special marriage act?
4. If this Muslim Man declares himself as Bachelor will the second marriage commence through the special marriage act?
5.Last but not the least what are the consequences if this Muslim man describes himself as Bachelor and submits the application to file under Special Marriage Act.

My brother in law is going ahead with second marriage. I need to know is there any provision in law where i can get any surety from him for my sister's future expenses and her children.
I need a legal surety for her since I don't believe in him.
He is not divorcing her but I fear that he may not meet her expenses in future post his second marriage.
