I won u/s 125 interim maintenance case in family court in sept 2016.but diovrce case is still running in family court. in month of nov 2016 she challenged family court order in high court. high court online case status showing issue date of notice :- 10/3/2017 and service date is 19/4/17. but still no one came to serve notice at my home. i am going to work whole day and tenant living at home whole day. they refuse that no men came to serve the notice. 2 days before when i am checking the case status than still service date is 19/4/17 but a another information is showing that a new criminal stay (RSTAY) filling on 18/4/17 ( a day before service date)it is also mention that "case status in which this is main case" (125 original plea in high court) i am confuse what is it's means ? is it is she filled stay order for family court order u/s 125 or any another case.

Sir,
25 days before my wife took our 5 year old girl child to her uncle's house where her mother lives. I had a quarrel with her over phone and she stopped talking over the phone and none of her relatives talk with me. I could not know the health condition of our child. I fear they will not allow me to visit the child, I will be ill treated at their residence. The child may sometime cry and ask me to take her to my house if I visit her. In such circumstance can I take her with me even if my wife objects. If I am not allowed to see her what can I do? If they harass me and insult me there either by word of mouth what can I do? Can I complain to police? How often can I visit her at their residence?

my husband filled divorce case against me. i filled counter interim maintenance u/s 125. family court reject my plea. than i moved to high court for same. nowdays i listen from some relative that my husband is trying to marriage a another girl secretly. who is residing in a another state. he also made "roka" with her. still i have not get any perfect details of another girl ( name, address, etc.)can i make a advance plea in high court to prevent my husband from second marriage without first marriage.

Dear Experts,
My first motion of Mutual consent divorce is over and second motion date is in last week of May 2017.
Me and my wife (Our parents live in MP) lived in Pune after our marriage for six months, we both are from Madhya Pradesh, she also started working in Pune after marriage. Issue started after 6 month and wanted divorce and XX lacks alimony (Extortion), we settled for YY lacks. But the issue is she wanted divorce instantly without 1 year of separation. After 6 month she started living desperately in Pune on rent and doing job. I have to say date of separation is after 3 days of marriage in court to show separation.
I need your suggestion shall I go ahead with Second motion what if she goes to high court after getting all money. As documentary evidence will be there for separation(Her rent agreement).
I understand that marriage is totally broken but I don't want future litigation on this. If I say for correct date she will defiantly drag me and my relative in False cases.
I need expert guidance.

1. FIR of torture, dowry, attempted to murder was filed by my daughter in law and witnesses I were her father and mother inhe lower courta gainst four members of my family has been quashed by High court .
2. Can we file suit of defamation against my daughter in law and witnesses?

Subject: Regarding family issue.
Dear Sir / Madam,
Hereby I would like to explain that I got married to a girl XYZ on 25th DEC 2013. Whom I loved from 14th DEC 2008 (I proposed in the month of SEP 2008 and she accepted on 14th DEC 2008).
You might ask why too much gap between love and marriage. Since she told that she will marry me after completion of engineering.
But now we are facing huge misunderstandings between me and my wife.
Hence seeking legal advice how I can proceed.
Details story:
I started loving her from Sep 2008. It was going good. Immediately after her acceptance we informed our respective families. She is distant relative.
At the time acceptance, she informed that she loved 3 boys and they broke up by using her. And asked me in this status do u accept me? Since I love her too much and accepted her whole heartedly. And appreciated her for being straight forward.
In 2009 she joined engineering in one of the college in Bangalore. I look after her Tution fees, Text books, partial monthly expenses. Taking her out for refreshment. All was going on well.
During 2010 she informed like two of her close friends (1 male and 1 female) unable to pass the exams and expecting her to teach. She asked my permission. I said go ahead. You are doing good work by teaching fail candidates.
But one day I found few messages sent by her friend (male -fail student) stating “ I want to hug you, Kiss you etc…..” when I asked with XYZ who is he, she didn’t respond to me and avoided me by not receiving my call.
Later on, one day she apologized for the mistake happened by her and explained the things happened between her and his friend (which went till bed room). I was literally upset. Even after providing so much of freedom and necessity items why she is doing like this. And she begged me not to leave her alone. Considering her guilty factor I accepted again.
Afterwards in Jan 2011 she started suffering from Ovarian cyst. Initially we went one doctor and treatment was not successful. I checked up with my friends and family and found right doctor and started treatment to her. Taking her to hospital every month. Getting her medicines everything required for her. None of her family members to take her even for a single month. With god grace it got cured in the month of JULY 2016.
Few quarrels been going on between me and XYZ. She never wants to accept the mistakes. Even though it’s her mistake she don’t want to accept. By the way I need to inform age difference between me and my wife is 5yrs 6 months. Being a senior I was thinking she will be right one or the other day
During her final year engineering, to guide her I suggested one of my friend for her project.
She completed her engineering June 2008. and married on 25th DEC 2013.
After marriage she never did any house work
• I used to sweep the floor
• Clean the toilet
• Keep the things right at home.
• Cook food for her.
• Taking her to hospital till it get cures ( till JULY 2016)
• Need to put water for heating before she wakes up.
• Used to get breakfast every day till she start working.
Been continued like this. She used quarrel and was going to PG and staying there for 1 or 2 months and come back after my several requests.
After marriage, she went to PG in the month of march (due to some quarrelling and hope I slapped her for her mistake) and left me alone.
At this particular period, I found few of the messages in her mobile which she left ( she took only SIM with her) stating “DARLING” to my friend which I suggested her to take help for her project.
I shown the messages to her family and they said since the messages are pertaining to the date before our marriage and I compromised at that point also.
I was assuming like she will look after me very well since I accepted her mistakes and treating her in way as before.
She started working as trainer in one the PU college from SEP 2014. I allowed her to go for a job even though she had a bad history. She was not ready to come to my native place.
For that also I adjusted and started leading life. In few of the quarrels she also beat me, I also slapped her. In every quarrel her family members started interfering and supporting her by saying its not yet all her mistake.
Recently she is always be on calls till 12:30 (not official calls) might be by her friends.
I suspect it might be extra marital affair. Because no friends can speak all the 7 days till late night, the way she dress, way she go out and come back late night.
Another reason for suspect is that she is forcing me to give divorce. I am not interested in giving her divorce.
If she go and apply for divorce, How I need to proceed?
If her extra marital affair proved during Divorce judgement, does she will be sent to jail. If yes how many years??
Her family members didn’t allow me to know in which PG she is staying. Can I file case against them?
We have not mate from 1 1/2 years, in this case can I file a case against her?
Not coming to any of my family functions nor just to my parents visit. How can I go ahead with this situation??

Sir, the daughter-in-law has falsely implicated the father in law under 354/509 IPC. Now, the father in law is in constant fear and wants that his own son and daughter-in-law to look for alternate accommodation but daughter-in-law is obstinate and even not listening to requests of whole family though a rented accommodation has been arranged by her husband. The father in law is the absolute owner and has self acquired property. No child is there of daughter-in-law and son. Kindly help how eviction can be done .

Hi, We have a residential property in which on ground floor our Chacha ji (he was never married) used to live and on Ist floor my laws and family of my brother in law lives.
After chacha ji passed away couple of years back, legal heir was my father in law who is his only sibling. Now my brother in law and bhabhi got a will prepared stating that chacha ji has gifted entire property to my bhabhi while he was in his last days and got his thumb impression on the prepared will. They also took into confidence my in-laws giving them verbal insurance that first let the entire property get transferred on the name of bhabhi and than they can transfer half of the property on my in-laws name. And so they got NOC signed from my father in law. The case is in court at present.
My husband and I both are working and have not been staying with our in-laws. They visit us in between. Since both of us are earning good we were never bothered about residential property thinking whatever in-laws would do we would rightfully accept it.
Now recently we got to know from our sister-in laws who lives close to our in-laws that my brother-in-law is fighting my in-laws and telling them "shukar manaoo ki mere biwi tumhara kar rahey hai, aur koi karega bhi nahin" making them realize that they completely dependent on them, even though my father-in-law get a good pension.
While the case is still going on in court
we are very apprehensive that my brother-in-law and his wife may not give my in-laws their share in residential property.
Is there anything which can done on papers legally at this stage to ensure that my in laws get their 50% of share. We believe that verbal commitment may not just suffice once everything is on my bhabhi's name. Is it too late to take any action against them? We also don't want the property to get locked as disputed property.
One of the piece of advice we got is that my Father-in-law does a case against his children that they are bothering him for property and we as family do an out of court settlement and get court stamped on the decision that 50% will remain with in-laws and 50% with brother-in-law.
Our main purpose is to have some proof which can be used to challenge them in case my brother-in-law and his wife create problem in transferring 50% property. Also down the line my in-laws do not have to run after court to get their 50% especially considering their age which is in 80`s.
Looking forward to advice on this situation.

My father Late Sri S Yesuyohan was an Railway employee as Pman/SS/O/TNGL. PPO No 27054100944 and he was expired while he was in service on 25.04.2005, leaving behind him, my mother Smt S Jayamma and my brother Sri S Harish and Myself as his legal heirs and i further state that my mother was taken family pension of my deceased father till her death and my mother also expired on 31.10.2006, leaving behind her, myself and my bother. After the death of my mother, i have taken the pension till i attained 25years age. I.e upto May 2008.
From June 2008 the Railway Department has stopped the payment of my pension. After enquiry with the railway DPO, he informed that the format has been changed and asked me to Re-Submit the documents to process Family Pension to Un-married Daughter Beyond the age of 25 years, As per given check list, and as per instructed I submitted all the documents to railway department, Hubli Personal Department on 21.08.2010.
On 03.06.2010 I got married to Mr. V Paul Varma resident of Chintalpally ‘V’, Manjeera Barrage “Po’, Sangareddy “Mdl’, Telangana 502294. After Marriage I submitted all the required documents to the Railway Department on 21.08.2010. Whenever the department made Queries/Remarks, I submitted all the necessary documents to speed up my file to get the disbursement of my pension arrears settlement till the time I got marriage (I.e June 2008 – May 2010). Under the scheme Family Pension To Un-Married Daughter Beyond the age of 25Years.
My Case is pending in the Department from 7years (Seven Years).
Need your Guidance for followings.
Received a letter on 13.08.2015, to submit pending documents to processed the file, 1) Survival Certificate issued by Revenue Authority.
In a confusion i replay with LIFE Certificate issued by sangareddy Tashidar, to the railway department, but they required Legal heir certificate instead of life certificate.
My brother got job under compassionate in the year 2007 and working in Hospet, he applied 4 times for legal heir unfortunate got reject, as i did not produce local id proofs.
i applied in MRO sangareddy and got the certificate based on the FCC (Railway Department), Attested Death Certificate by advocate, local ID proofs.
I submitted the document on 06/09/2017 to railway inward section, after frequent follow up now they are asking LEGAL HEIR certificate of Hospet MRO not the sangareddy MRO.
As i applied for Pension Claim for unsettlement / arrears from June 2008 – May 2010. i dont know why they are asking the Legal Heir certificate when we Produce FCC and PPO. and iam not asking for Extension of Pension but for the settlement.
Sir Pls Guide me in this matter.

Hi every one !
My name is simar ,I have been living in delhi in live in relationship with my boyfriend since 12 years,
Two years back we got married in Arya samaj mandir without our family constent,
And one week before I got to know that he was already married 3 years ago in his village bihar under family pressure,
I was shocked and still I am in same condition or more worse..
I always used to ask him to inform his family
But he always denied with excuses
Whenever he brought his village wife to delhi he used to say me his parents came here for doctor,
He even used my credit card to present his village wife and told me his father is in hospital that's why he needs my credit card,
He has also one daughter from her..
When I asked him about his marriage he told me he doesn't like this women and want to stay with me..
He also write the Same on paper and signed it out there,,,
Three days before he ran away with his village wife to Ahmadabad and left all his academic qualification degree at my house,
He used to call me time to time saying that he would come back to me and I should wait for him,
He is lying ..
I am in depression now ,I am totally not able to come along with this situation for me it's terrible and now getting life threatening,
What kind of action can I take against him and what kind of evidence do I need for that?
Please suggest me
