Dear sirs
I would like to thank you all for your guidance in defending my 498a case.
Now myself and my parents have been aquented.
In case of dvc which was filed by my wife was stayed by honarable high court as I have gone against the interim order of maintenance and exparte order.
Honarable high court in May 2017 gave judgement in my favor by giving order to grant maintenance to my daughter of rs 5000 only and setting aside exparte order.
Please note that my wife is a central govt employee and earning a salary more than 70k per month.
My queries are:
1. Do dvc court take cognizance of my aquinttel in 498a , as all allegations made by her are same.
2. 498a judgement clearly states that it is a false case and they have utterly failed to prove offenses.
3. I am basically an NRI , while deciding the alimony do lower court take cognizance of her employment details , which she her self has accepted of her employment details in court.
4. Will she be eligible for any maintenance, I am ready to take the responsibilitiy of maintaining my child.

Respected members, interim maintenance granted 6 months back for me and my kid. Still 4.5L arrear amount should be made by husband. As I wanted to join my son in better school I have been asking for clearance of some amount from arrears for school fee payment from March, they threw deaf years. Cross examination will begin from next date. Help me with any suggestions to recover arrear amount. Thank you.

I need help, my father who is 81 years old is suffering from Parkinson disease and due to the severing of hands is unable to sign papers also not movable, he wants to write a will and also nominate me as legal hire, I do not have any siblings, my mother is alive and is healthy, what are the options for a will and legal heir certificate, is it possible to procure a legal hire certificate when a person is alive ?

My sister is married in the year 2014 (arranged marriage) and has a 9 month old daughter. Within few days after her marriage, her husband, without her consent and knowledge, sold all her stridhan given by our parents stating that he had to clear loan taken for marriage. Thus, she has left no stridhan, except those received from in-laws in marriage including 1 small malgalsutra & 4 small items i.e. finger ring, bindiya, payal & challa. Her husband is normally alright with her, unless he drinks and comes home late night after work. When drunk, he abuses & beats her saying that she has not brought much in marriage from her parents. Her main problem is her mother-in-law's behaviour towards her. Her mother-in-law & sister-in-law are fair and beautiful, whereas my sister & her daughter are dark in complexion. Her mother-in-law daily, constantly abuses & insults for not being fair & beautiful and for not bringing much in marriage. Not only that she pulls my sister by her hair, beats her and uses filthy language towards my sister. She constantly keeps on quarreling with my sister.
Recently, my sister’s mother-in-law started quarrel with my sister and gave her filthy names and asked her to leave the house. Her husband was at work. My sister therefore picked up her daughter. However, the mother-in-law asked her to leave without her daughter. So my sister came to our parents’. Then she called her husband and narrated the incidence, upon which he started abusing her and said she must only have said / done something to upset his mother. Next day, he brought their daughter to my sister at our parents’ place and told her to stay there for few days and then he will take them back home after all is settled peacefully. After two days, he called up & told that he and his mother don’t want to take them back and disconnected the phone. After two more days, my sister received a legal notice for restitution of conjugal rights and calling her to return home within seven days. We all were shocked to read the allegations in the notice, saying that my sister has been abusing and torturing her husband and his mother.
My sister wishes to stay with her husband with love and peace. She does not want to make any hue and cry or any issue out of all her sufferings. This is the only reason that she has not yet approached the police, nor has she revealed anything to anyone.
We seek your guidance as to what can be done and what we can do to send her to her husband peacefully.

Dear Learned Friends,
Mother had given a house to her married daughter towards Streedhana Property (Pasupukunkuma in Telangana) few days after her marriage on a Bond Paper and it is not registered.
Now the daughter wanted to sell that property to my Client. Her husband has no objection. Can my client purchase such land by way of registered sale deed. We he get legal title or will there be any problem.
Kindly clarify me about the above legal position.

Hello sir,
My grand father has gifted me and three other grand children with a property. In the document, demarcation of land is not done between the grand children. At the time of registration, one of the grand children is a minor and unfortunately, he died after becoming major.
Now I want to purchase the share of the deceased person. who is the owner of the deceased person's share? who should sell me the share? will his mother gets rights over the share or how?

Maintenance for a higly qualified working women
Dear Expert,
I have been going through the section-125 case from Feb-2016 in roorkee court. My wife is claiming maiantenace of Rs 30000 (25k for herself and 5k for kid). Iam un-employeed since Jan-2017, but was working earlier and was getting Rs 50000 as salary but shown that Iam working in some another company and getting Rs 18000 as advised by my lawyer.She dont have any income proof of mine till now. But she has asked my detail under section-91 and I had also asked the same from her. She is working in a mall as a store manager since Feb-17 and left the child with her parents in another city.I have some photographs of her while present in her store but she has declared that she is taking coaching for govt job and submitted the I-Card of coaching centre in court. Judge has also given the decision that she is not working and taking coaching on 11-May-17 and living with her parents and taking care of the 2 year old kid.
Now I want to now the following
1) Can we submit the fresh application of Section-91 by attaching the photos of her working in the shop.
2) Is there any time period for submitting our application to review the judgement in the same court.
3) I got a job offer of 45000 now, can I do maximum saving and investment so that my in-hand salary is reduced and maintenance amount can become nominal which is sufficient for my kid (which I intentionally want to give to my child).
4) What would be the basis of deciding the maintenance as she is highly qualified (done MBA) and I have my dependent parents and one unmarried sister with me in my parents house.
5) please advice how should I prove that she is working and doesnot deserve any alimony as she has intentionally nove out from the marriage with self-made issue.
