Hello Sir/madam,
My father had filed a petition in his city of residence for parental maintenance. Since I was not able to go for few hearing, the judge at the family court issued an interim order of Rs 8000/- per month of maintenance. I filed WP in high court against the interim order as there was no other recourse.Later on, case was shifted to the family court where I reside as per sec 125 crpc. Father has enough resources and property to look after himself and does not need anything. However, he has produced incorrect information and trying to fight the case on unreasonable arguments. Though the proceedings are going on at both the courts ( at very slow pace), what is your advice to me to?? As per 125 crpc if the court case should proceed in the court where son/daughter resides, then in my case the interim order given by the family court from the place where my father resides. Would it be a valid interim order?? as case is now shifted to the court, where I reside.

Is there a way to get an immediate child custody order thru the court? my self and my husband has issues, because he is abusive i want my kids to be safe, so please suggest what are all the legal procedings I can have to take the child custody immediately?

My client which is a daughter and as per the will of the deceased mother she is equally entitled for share in the property as per the reply in your forum i have taken the matter and will apply for probate before the bombay high court
My query is that please provide me your valuable suggestion on exemption of court fees for the daughter at the time of filing a suit in the court.

I hv 3 yrs old daughter...my wife n in-laws kidnapped me. For this FIR got registered on my wife n in-laws with following sections of 323,363,506,149 IPC Oct 2017.
I wanted to talk with my daughter...but my wife blocked my phn no. I tried with diffrt no. but she refusing to gv...She telling that come by police or court orders...Evry one r criminals at my in-laws home...Plz advice how can I safeguard my daughter's life frm that criminals...
1) can I approach court by asking I want my daughter bcu evry one r criminals...
2) with thr personal motive they can do play any game with my daughter life

one more question.....Can she take divorce on the grounds that we never lived together and the marriage has never been consumated?I want the women to suffer for the rest of her life...She played with my emotions.I don't want to give her divorce.And kindly pls guide me About my RCR petition.

I got married 7 years ago, but due to my nature of job as iam working in defence services i was not always available at home. This was known to my wife before marriage she has done her mba and was eager to work but as i was posted in guwahati in year 2011 i asked her to accompany me but she refused and even denied to stay with my parents and returned to her maternal home and started job. After repeated attempts made by me and family she did not come back she often come and go back as she was working in delhi and my home is in Kanpur, but never agreed to stay with me she demanded me to leave my job and leave my parents and stay with her in Delhi. After going through finally i filed divorce case in return she filed 125 and 498a from buxar, she aslo got the divorce case transferred to buxar and written complaints against me in my office. Now currently i have taken bail from patna high court for my self and my parents. Recently few days back I appeared for 498a case proceeding and judge asked her to fo along with me and some how she came after pressure from judge. But again her behaviour has become more aggressive she misuse this situation and often threatens me and my parents about the consequences of 498a and made our life miserable. Please suggest me what should be next course of action. So i can be relieved as she says she neither wants to b with me bor she wants to give me divorce. My life is hell. Please suggest me some legal assistance as what should be my next course of action.

Hi. I was adopted when I was 2 months old by my Bua ji. I call her mother. I grew up with them. I still had contacts with my birth parents though. I am in love with the daughter of my actual mother's sister. From childhood, I have been staying with my current parents. We both would like to get married. My legal documents are registered with my current address and guardian details are of my current parents not my actual parents. Can we proceed with our marriage?

I'm Priti from bhandup,mumbai.My father name is Ashok .my family is mentally harrassed by my father.he just come home drank and just gives us bad words and not let us to sleep whole night we are facing this problem since our childhood.he also not give us any money for household expenses.we are really frustrated by all this.. I just don't know what to do.we have done police complaint 2 3 times but they tell us this is your family matter we can't do any thing.im really frustrated by all thia.im not able to concentrate on my CA studies....plz help us.

Can a sole owner of his property as a settler can transfer his property to a Trust authored by him consisting of only one trustee that is he himself with the conditions that the property shall vest as earmarked by him in the Trust Deed to his off springs as beneficiaries after his demise ? .

Flat rights/ownership claim
My brother bought a flat with some of his money and partly with our parents money(no name of parents in the sale deed as the loan was in brothers name and parents had given him additional money to reduce the loan amount ) and remaining on loan.
After few years he got married which was going in on fine.
After few months to close the loan our parents lent him more money and prepaid the loan.
He also gifted the flat to our parents since they paid more then 40% of the cost.
The house is now only on parents name.
Now since some months my brothers married life is facing some trouble.
Can his wife make a claim on this flat gifted to our parent even if she has not invested anything in it using any of the law like IrBM?
