Female NRI filing for divorce..PLEASE HELP!!!!!!!

Hello All!
I am a Canadian Citizen(NRI) and I got married in April 2010 in New Delhi to my husband of Indian origin. After marriage he told me that he only married me for sponsorship purposes to come to Canada. His mother, father and brother live in Canada on a point base system and I was told my husband couldn't come on a point base system because he didn't have enough points. Also, after marriage I signed the sponsorship papers and then thereafter he began to beat me alot. Everyday he was never home. He lied to me saying he was gone to work but came home late at night around 3am to 8am he would come back home VERY drunk and beat me alot. He threw a knife at me and threatened me many times. I told his parents everything because I wanted them to help me but his family supported him and were on his side. He mis-used me in many ways physically. As a NRI from Canada I had no family in Delhi and then I told my mom. A month after my mom came to took me back to Canada without my husband knowing. I am filing for a divorce in Canada and will be sending the papers to him in Delhi. My mother-in-law sold my wedding clothes and has my wedding jewelery in her Bank locker in Delhi. Can someone PLEASE help me in telling me how I can file a case against my husband and his family to get my jewelery back and get back the money I spent on the wedding, the money spent on the wedding clothes that were sold, and how I can sue him for the physical misuse and abuse he did to me????? He tortured me alot in Delhi and I was never to allowed to go outside of the house and never gave me money to spend. He even tried to poison me..please can someone help me as I want to file a case against the family and get back the money I deserve as pain and memories continue to haunt me. help me out

i got register married with my lover without knowing to any of our parents. we live seperatly. i am a software professional. i used to have drinks twice a month. my wife works in a alcholic de-addiction center and hence she hates drinking and she consider me as a addict. and hence, she is not willing to live with me and says same as the reason. we are couples legally but she is not willing to start life with me. i am ready to quit drinking, but she is not believing me. she is not in a position to understand me. what is the legal way so that i can have her live with me? what if she says she was forced to marry me(though i have enough evidence she loved me a lot)? what are the defensive and offensive actions i can take legally? is there any possibility that she can avail divorce stating that i am a drunkard? we have not started living together yet. what are the points i can have to make her live with me , if she/me approach the legal ways ?

abusive and disturbing childhood

i guess this is what happens when dalits are allowed to rot. i hope i've written the whole thing clearly, most of the narration is not in tune with my heart because of the intellectual hooliganism I’m subjected to, writing this is painful. i've presented the incidents in the chronological order starting from 1985. there are somethings i've omitted which i'm not willing to share in the open forum. i'll pm to the members who are interested. please give advice, suggest sections,act,judgments,etc. whatever is necessary in initiating a legal procedure or resolving the problem. I take my life seriously, these feckless people are just playing around so callously and emotionally mutilating in the process. I have been subjected to these people’s ignorant ways of doing things since I was few months old. It is long but please keep up with it. This is very urgent and things are in a precarious state.

What is the legal age of getting married??

I was under a perception that before the age of 18 years a person can not get married legally. But section 2 of the Indian Majority act says........



""2. Saving.- Nothing herein contained shall affect:--
(a) the capacity of any persons to act in the following matters (namely),-- marriage, dower, divorce and adoption;
(b) the religion or religious rites and usages of any class of 7[ citizens of India]; or
(c) the capacity of any person who before this Act comes into force has attained majority under the law applicable to him.""


Does that mean that a person before the age of 18 years can get married legally/Is this true for both girls and boys or is there some difference(of age) between the boys and girls for getting married legally???



I do actually wanna know what is the legal age for a boy or a girl for getting married or doing some other legal works like signing property documents etc...


Please help...

Married in India, Divirced in USA

My Brother Mr. X got married in India under the Hindu Marriage Act and had 2 issues. My sister in law left India with the two minor issues and got a divorce in USA. My Mother has died (after my Father's Death) and she has left some property to my Daughter and Son by a Will. During the probate proceedings my Children's Lawyer is demanding a certified copy of the Divorce in USA between my Brother and his wife. Mrs. X got a divorce decree and married another whom she also divorced later. How should my Children go about it now?

Maintenance claim

Dear Sir/Madam,


To prove that the husband is working in a particular company(for claiming maintenance,is it necessary to send a court notice asking for the details of the husband?What if the notice is not accepted by the husband or concerned person?What if it is returned?Will it help for claiming maintenance?If sufficient documents are provided for claiming compensation is it not the onus of the lawyer to prove that the husband is liable to pay the wife.(Restitution of property.gold and money).What if the wife is not financially sound to even pay her fees?My lawyer has wrongly notified the court and took money from me once.Again she is asking for another amount to file with on behalf of the maintenance petition.Can she revise the former petition file and make a new petition without taking money from the client?What can be done if mistakes happen from the lawyers side?

Can anybody provide me the authority in which court has taken cognizance against the person who has given the Dowry(Except Neera Singh) and kindly explain me the aggrevied person under sec 7 of Dowry Prohibition act.

mahila panchayat at commissioner crime branch

we have complained at commissioner crime branch regarding attrocities,harrashment,abuse ,threats by groom n family to my daughter,so case was handed over to womens cell where counselling started.after two sitting it was felt counselling is not to our satisfaction so we dont want to attend next session in which baby n continue it.can we legally refuse to attend without implication.what are prose n cons of act of refusal from our side.help throw some light on the issue.2 years old baby have also been called along with us.
