Child Maintenance

1) Both father and mother are in software profession. Is there a method to calculate maintenance amount for child paid by father?
2) What are the criterias for the court to decide maintenance amount?
3) Does it depend on father salary? if yes, will it be linked to some percentage of salary?
4) Can a father file petition and ask for complete custody of child after child ages 5 years?
5) For how long monthly maintenance has to be paid?

Widow's claim on deceased husband's property after remarriage to another person

A was head of a family. B is his wife. C is his younger brother. Father & mother are no more. All inherited property was given to A to facilitate clear all his debts with C not claiming any share. A had purchased one site in 1993 from a housing society which had 10 years lease period. Because of debt A sold the site to C for a consideration in 1995 and A gave GPA, SALE AGREEMENT and AFFIDAVIT to C as site could not be registered during the lease period.

'A' died suddenly due to heart attack in 2004 at young age. Since A was own brother and very honest person C did not like to force brother to register the site immediately after lease period and instead was waiting for brother to become healthy (acute diabetic) for getting the site registered.

Now B took all the inherited property in her name after A’s death. B knows that A has sold site to C but did not know that site has not been registered. A and her two sons (then minor & now major) have signed as consenting witness to the sale agreement. In 2005 C got remarried secretly to another person from different caste immediately after one year and living with him and two major sons. Marriage is registered in a sub-registrar office.

When C revealed B that site could not be registered in 2008 and requested her co-operation for registration, C got the idea to take the property in her name. She immediately (June2008) got the Municipality records changed to her name by submitting death certificate and claiming the property as widow. (but she is remarried in 2005 ).

C is in possession of all original documents and has been paying the municipality taxes from 1994 to date. B could not register the site in her name, as she does not have the original documents. The site is vacant and nobody is physically possessing.

How B can get the site registered in his name. Please anyone can help for this case at Bangalore ? Please send me contact details. Thanks. PISSAY

Is there any way to get divorce in a month?

I have met lawyer who says can do so however wants a huge amount of money.so is it possible?

Delhi dispute resolution society

Dear All,

Need your valuable advice .

My mother and we all family members are having a tuff time due to harressment by daughter - in law after the death of her husband at young age.

She and her relatives have forcefully tracepass my mother's newly bought property (self acquired) and harressing us that they will file fraud cases against us for dowry /domestic voilence etc .She is married for last 2 and half years .

We gave a compliant at Police station and PS has forwarded our application to Delhi Dispute Resolution Society .They have called us to meet them .

I want to know what is the process this society follows .How they work .Is it social mediation or legal?What is the legal santity of this call mediation centres.

Will they call both the parties . After listening to both the parties will they give a judgement in writing ? Would that be binding on us ? What is the value of their judgement in the eyes of court of law if in future we would decide to move in to the court.

Pls reply as its urget and we got a upcoming date there.

Physical Relations, Marriage and Divorce

A boy and a girl loving each other since four years. After engagement but before marriage they were having physical relations and frequent intercourse. Afterward they got married on the date fixed for the marriage. This was one of the reasons why boy decided to marry girl. Now girl has filled case for divorce from the boy saying that they have dispute before 4 days of marriage on some matter and she don't want to marry the boy which was settled afterward with the help of elders and as per their guidance who don't have knowledge of the above fact. The boy would like to know that how much above fact is important to defend divorce case. Girl has not mentioned about her relations with the boy before marriage anywhere.

A query about 'Hindu Marriage Act'

Dear Sir,

Regarding my family matter, I discussed with many advocates but the thing is most of them advised for mutual consent to get divorce; still some opined as 'dont worry let we fight through the court' and one of my friend told that - "Ramesh, once you married a girl whether she lived with you or not, you have to give the alimony for her maintenance till the final judgement and when the divorce is declared, you have to give the compensation as per the decision of the court... at any cost in your case no provision for nullifying the marriage". And also he added that, law is already fixed in favor of Ladies.

Sir my query is - is there any 'rigid law' in the constitution?

Second thing is, all the child born to a parents may not be mature, all the matured ones may not be fit reproductively, all the fit person may not interested to marry, all the married persons may not be a husband and wife; and all the husband and wife relationship may not be successful. The actual situation is like this but still how a single law can justify all these innumerable circumstances and situations equally?

3. Even after divorce, both the person have equal and likely chances to choose their life partners. If that is the case, why they show favor towards female gender?

Please Sir kindly suggest something.

Talaq - Kindly advice

Dear Sirs,
I, Md Ibrahim, Working as AM in a reputed bank, got married to lady on 06.11.09. She did not offered herself to me from the day of marriage. My in laws deceived me & my parents by giving false age of their daughter. As my father is pious & elder person i never disclosed teh facts in front of him. i respected my parents & tradition & i kept calm & waited for her. my father passed away on 30.11.10. & i got requested for transfer of job to my home town. I & my wife alone stayed for 9 months, after my father`s demice i got transferred. before the 40 days of my father`s death ceremony my wife left me saying she would like to visit their parents for couple of days without seeking me or my mother`s permission dt 08.01.2011. on several occassions we called her, but she did not turned up till today. my in laws started abusing me & my mother over phones that we tortured their daughter, never offered food. I posted a registered letter stating to come back & if she has any issues asked to keep in front of concellors to clarify. they started threatening me over phone by making some person to call saying they will lodge FIR in Womens protection cell at Hyderabad. I revealed all the facts of my wife to my mother & my grand father. they came to a conclusion & asked me to take her back. with this intenetion my grand father asked to come for discussion they did not responded properly & made mess at my home, with which each & every person came to know that my wife left me. After a cuple of days my in laws called my grand father for TASFIYA/ compromise & started abusing in filthy language & threatened him to kill him & me.
My in laws are also saying that i am impotent so thats why i was calm. my wife & thier parents are not willing to send their daughter to me, and asking me to leave my mother & sisters. how could i leave my mother, who lost her husband just few months ago & we dont have any financial support except me. I have to unmarried sisters, i have to take care of them. I am scared now, if I accept her she might book me some complaint over me or my mother, then what will be my sisters future. kindly advice me in this regards please.

advice required

is it true that a marriage certificate is not valid till both the spouses and the two witness signed in the form and in the register of the marriage registrar?
In that case me and my husband never signed in any register however our lawyer made us sign the form along with the witness.so is our marriage certificate valid or invalid ??

Maintenance for Child

I filed a case of Restitution of conjugal right against my wife and also filed a case for Child custody. Me and wife both are employed in Govt department. We have a girl Child whose age is 1.5 years old. I know that court will only give me visitation hours. My question is that If my wife demanded maintenance for child, Could I show the LIC Children policy of my Child whose premium is paid by me alone.
