Respected,
Married on 2005 in chennai, she left home after 5 months citing reasons ( harrasment/ torture etc which is not true), 2007 march she left bangalore with her family, all these 02 years i was in gulf but visit india in small vacations several times. jan 2008 i settled in hyderabad to continue relationship by leaving gulf & other abroad oppertunities. Went sevral times to call her in bangalore but she didnt, In 2008 last quarter she started caling me to send separation papers, but i moved to court for RCR in febraury 2009 despite of knowing & reciving notice she didnt attend haring, I got exparte, after then also i waited for some time then we met her uncles few times in bangalore finally they brought her chennai on july 2010, infront of both the family members she agreed to stay with me in hyderabad as house wife. she stayed only for 4 months, in december 2010 once again she stayed in her mother home in bangalore after bakrid festival vacation and still continued. We went to call her on march 2011 but she & mother send us empty handed. Now am moving to chennai, once i reach chennai i decided to call her once again if she joins alhamdullilah - if she didnt join me then decided to divorce her, now i need your guidience on what to do if she didnt join
1) whether i have to apply RCR again or i can send talaq notice directly to her with IDDAT period ( as providing IDDAT period time itself is a kind of reconcialtion effor which give time to wife to think and join husband)
2) already am having Exparte, again i have to apply for RCR or in previous RCR itself i can continue the case
3) I can apply RCR and send the first talaq notice at the same time
4) by keeping 2009 exparte notice i can send the talaq notice without applying for RCR now
Any other issues or guidiance which arises need you to please bring to notice to follow

Hi,
I got married 2 years back and things were fine for 1 year. After 1 year she got pregnant and after that her parents took her to their home without informing you. i went to my inlaws house and tried to talk to her but she did not talk but her parents talkes abusivly.
then she field a 498a case against me n my family to which we took some middle person and held a meeting and they agreed to cancel the case and she will come with me.
By that time i got a job in bangalore and she came to bangalore. She stayed for few days and when asked for the case closure she did not give any satisfactory response and flew back to her parents home again without informing.
Now she has delived the kid and staying with her parents. I have tried to talk to her , her parents but she is not giving a clear response.
Sometime she says she wanted to come and sometimes not.
I am not able to understand what she is upto and this thing is going on for 1 year nw.
I am not able to focus on work or stay calm on things.
Please suggest what i shd do in this case.

My question is: if a sikh girl married according to sikh marriage ceremony to a sikh guy. If she converts herself to another religion say Islam, then in that case will her current marriage be still considered or become void and null?
I mean to say, will she still be considered as married to that sikh guy, as according to sikh religion only sikhs should be married according to Anand Karaj (The sikh marriage ceremony).

my father had 2 wives i am from 2 wife. my father died in 1982.till now my step brother have not given us our share in my fathers property.can i file a legal suit in court now.pls advice

hindu widow daughter in law(no child) can claim properties from mother in law.
But section 15 says that daughter-in law
couldn't claim from mother-in-law-properties

parties married in india. one party obtained and exparte divorce from abroad for the sake of conveneince. aggrieved party want to set aside the divorce decree given in a foreign land.can it be done by the aggrieved party on their own or have to employ an attorney in that foreign country or can it be done from india if there are no jurisdiction problems. kindly advise me.

I have received the response from your experts regarding above in respect of streedhan after she got married to another man..in due reference they have given a car to me and car is in her name ..and i am using it..further one double bed they have given...but what about the gold which i have given ti her..i have receipts of that can i claim my gold..and further what is remedy for this car..shall i return to them...since 2004 it is with me

My question is, in a marriage between two Hindus performed according to Hindu tradition but registered under the special Marriage Act, can either spouse seeking remedy (judicial separation or divorce) plead under provisions under the Hindu Marriage Act (the marriage having been conducted as per Vedic ceremonies); or will he/she be strictly governed by the provisions of the Special Marriage Act under which the marriage is registered?

my wife, a Railway employee, filed a case u/s 125 Cr.P.C in the year 2000 for mantenance for herself and two minor sons. That case was disposed off on compromise wherein I made two fix deposits of Rs.30,000/- each for my two sons who are living with my wife. Now she has again filed a petition u/s 125.
Can she file a second application u/s 125 Cr.P.C. Pls tell me the remedy

Harrassed by Judiciary
I have enough evidence against Judiciary and my in-laws to prove myself innocent. But i cant take risk of my children future as i am the only care taker. Unless i get rid of the case & get divorce i can not even expedite as i m much sensible towards my children future. I am from a reputed family and it is not possible for anyone to get illiciate relation evidence so easily as she and her family are very carefull about the things as they know all law. i have agreed to their demand of money and a affidavit stating that i will not take any action against them after divorce. Can i expidite my case after giving affidavit for a social cause to let people know how judges & its staff missuses law and judiciary.
