Dear Sir,
This is regarding a girl of 23 years who was living me for almost many years who is now married with two children. Her husband has been harassing her both physically and mentally. She has no right to raise her voice as her husband mentions that she is his wife and he can do anything to her. We have been their guardian from the time she was with us as her father was an alcoholic and used to survive on children's income.
She does not want to live with him. Tell us as guardians can we fight with her for divorce. The husband also mentions that he wants the child and is in a position to take care of hime all by himself whitout the mother's care. The child is 2 & 1/2 years.
Kindly reply back

Hi All,
I have some query relating to marriage. A marriage took place 9 months back but husband and wife are living seprately and living at their parents home from the last 2 months. Now the incident which took place between both the families have been reported to police(Italaha) by the husband's family. Now the incident is such that husband doesn't want to continue his marriage and his wife wants to come back they are also making threating calls.
Now my question is
1) what should a husband do if they forcefully come to husband's place and leave his wife at his place can he oppose to that on the basis of Italaha which he has made to the police. "OR" on what all ground such a situation can be handled because divorce case can't be filed before 1year.
2)Should I get hide and alongwith should I make another report to the police stating about the threats and stating that due to which i'm going hide and on demand i'll be available as required.
3) With all the above incident they are also blaming my parents for all this and also threating them that they will make false cases against them. Should I also mention it in the statement. What should I do to also protect my parents?

"Dear All, I am 36 years all and from New delhi and got married in Nov 2003. The thing is from day one my marriage is in trouble. I am having two kids aged 7 and 5 years respectively and i am the only son living with my parents. In the last eight years i ignored many incidents of my wife and her family. Because of all this tension, in July 2010 I had no other option but to leave my parents in their old age and live with my wife on rent, now I have come back to my parental house and living on ground floor whereas my parents are living on first floor. The basic problem is my wife who is though physically with me but mentally at some other place. Every time she tries to degrade me and my family. There is lot of interference from my in-laws side. It is a long list of compromises. I doubt that she is having another man in her life. If I am right then he is the guy who is living just five houses away. Me and my parents have started keeping eye on her. And we found that the time my wife is out the guy just come up outside our house. Moreover, the cloth design and colour of my wife and the guy matches. Everyday there is a new thing from her. I met her mother many times, relatives but of no use. My life is suffocating. I want to get separate from her but I am having pressures from my family. My father is having artificial hip bone and mother is multi-disease heart patient. Further my both kids are with special needs. My daughter wear spects of -10 no. and son also suffers from febrile seizure. But i don't know till when i can control. Further we went for two year marital counselling after my marriage at Max Hospital also and treatment for my depression. My medicines were stopped four years back and counseling yielded no results. I would be grateful if you could clarify my following points : 1) What would happen to kids if I go for divorce? 2) Generally how much time it takes for divorce ? 3) How much money I have to pay her ? I am having a package of Rs.6 lakhs per annum 4) Whether she can claim part in my parental house, since I am living with them. 5) Whether it would be beneficial if I buy flat in my name ? You are requested to please advise what should I do. Whether I should get separate from my parents or not. Or I should apply for divorce. Need your guidance urgently Thanks, Gurman"
