Respected Experts,
My query is:
My mother has two own brothers[born to the same mother]. Both the brothers divided the Ancestral property among themselves. My mother was not taken her share due to love and affection on her brothers.
1. The elder brother was living with my mother when the elder brothers wife died in the year 1992. He also died in
the year 2011. This brother has no children[Issueless]
2. The younger brothers died in the year 2014. This brother has no children[Issueless] His wife is still alive.
The younger brother sold his property when he was alive.
My question is that the property of my mothers elder brothers fully comes to my mother by the way of succession. or else it goes to her younger brothers wife?

One lady of our family was living in Jodhpur ( Rajsthan)with her husband and two minor children.Marriage happened in approx 18 years back in Bharatpur( Native place of Husband). The parental house of lady is in Ludhiana (Punjab). Her husband is a govt employee in Jodhpur due to which they are living in Jodhpur in rented house. Now Lady is living in Her parental house with her parents with reason of bad behaviour of Her husband . Lady was a house wife so was not working. She want to get separate due to very bad behaviour of her husband. First she want to file the maintenance case so which place will be the jurisdiction to file the case of maintenance Jodhpur where they were living last , Bharatpur where marriage happened and in-laws of lady are there or Ludhiana where there is a parental house of the lady. Kindly advise

As per my grand fathers (registered) Will, Narender (my chachaji) is the legal heir of the property. Now after death, his wife, son and daughter are ready to transfer the property to me. Narender's wife can gift the property to me and no income is applicaple as per the blood relation. Now my question is how Narender's son and daughter can transfer the property to me? Whether they can gift this property to me?

Respected sir,
We got divorced as per muslim personal law in sep 2017, certificate is also recieved from the muslim board.
I remarried in November 2018. I have some bank loan also.
After the divorce she has filed cases challenging the divorce, conjugal rights, dowry harassment, dvc and maintenance.
She is well qualified with MSC bio chemistry and purposely she is not doing any job in order to ask more maintenance from me.
My present salary is only 6000 per month. Whereas she is asking 90000 per month. Case is at the cross exam stage.
Pls guide me what to do as she is trying to create financial problems for me.

hi all , i got married around one year back according to muslim sunni culture . My wife left me around 5 months back . I sent her a legal notice for mutual divorce . She has complianed about me and my family in police station alleging domestic violence . She is also threatening to add dowry harrasment against us. Still the complaint has not turned to FIR . She is showing some pics of her with injury marks to police . She clearly told she is not willing to give divorce . She tells she wants to come back . but i want divorce . can you please help me ? wht will be the impact of the complaint along with pictures. But i have not beaten her anytime . how can i protect my family . plz help . Also will there be any constriants on my movement out of india. as i may require to travel for short duration of 1 or 2 weeks frequently.

My ex-wife filed a case against me in 2012 complaining that my family members and me did not return her stridhan and other items she demanded for at our main house. She has retained her words in her cross also.
She has produced a paper on which details are that some of the items she is taking with her to her parental house and some of them like jewellery given by us and furniture items are lying with us in our main house. This paper is signed by 6 people, three of us and three of them including she and me on 23.5.2010
When she moved to a rental house with me in July 2010 she and me signed a paper on which it is written that all the items except 2 suits and a briefcase have been received in the rental house on 27.7.2010. She and me both signed it.
Then in April 2011 during her cross examination in the case u/s 125 she accepted before the court that " मैंने अपने वाद पत्र व शपथ पत्र में नहीं छुपाया है कि मैंने मई 2010 के बाद अपना सारा सामान प्राप्त करके अपने पति के साथ अलग रहना शुरू कर दिया था। ये सभी बातें मेरे वाद व शपथ पत्र में शामिल हैं।
In original complaint in 2012 she wrote that she demanded her materials from all of us at our main house which we refused to return.
Can you please throw some light on the possible outcome of the case keeping in view the above points. In fact this is a false case on me just to blackmail me and snatch money from me.

I am an Indian origin US citizen. I came to India on a visit visa recently and got married to an Indian citizen girl. Everything went well for 2 months after which she started acting strange. Everyday she visiting her mother house and fight with me when she come back. One day she cursed me a lot snd told me that she still loves her ex boyfriend and talking to him everyday. I was shocked and upset. She said if I want then I divorce her and then she will file case against me and my mother. I am US citizen but my mother doesnt have a US Visa. I dont want to stay with this girl as she is harrassing me everyday. I am afraid to do anything because anything I do might effect my returning to US. I am on a 6 month visa. Please suggest me what should I do. If I divorce her then will she stop me from going to US? Will my US citizenship be revoked?
What cases can she file against me?
Will my mother get into problem?
Will I be arrested?
Will they harass my mother after I leave?
Can I come back to India? As I am the only child to my mother and my mother stays alone.
Please experts answer my questions and advise me with what approach should I take.
FYI- I am a Muslim and marriage was performed as per Muslim traditions.

P.O in case of 498a
In a case of 498a husband got the bail and FIR was only against him and after all efforts for bail he could not get the same even from Hc and then he surrender in district court and after all proceedings he got bail @ cost of 50K assurity. In the meanwhile he went to the jail in case of maintenance execution and and after staying in jail one month he commited to clear all dues in next date but after that he has never attended the court and declared P.O by court and on moving the application of 319 his mother also summoned ad accused and she also has not turned up and declared P.O. Now I want to know that if accused are not attending the court then what action court will take against the assurity. In case they traced out in near future then what action court will take against the accused as definitely accused will apply for bail again and what will the condition for that . Kindlt advise
