sir shilpa is my client,
and shilpa get married with shayam on jan 2000.now dispute arise on dec 2000.her husband shyam wants divorce on the ground that she terminate her pregnency thrice since 2000. and shilpa said that in the earliar years of her career and looking to the nature of her job she may b not able to look after her child properly. so plz sir tell how i defence my client shilpa

Dear All,
One of my friend had booked flat in Mumbai. Though he has not received possession letter from the builder and society is not yet registered, builder has allowed him to occupy the said flat as all the internal and external work of the building is already done. He has already repaid loan amount to bank and made title cleared for the said flat. Now he wants to transfer the said flat to his brother out of his responsibility towards him who has also shown consent. Transfer of the property will take place through Gift Deed and will be registered at Registrar Office after paying stamp duty & registration charges. My question is whether builder can charge him transfer fees on the flat transferred through gift deed ? Whether his brother will have absolute ownership on transferred flat to him ? Can anybody make claim in future through any law / court on the said flat including friend’s spouse as friend’s wife is living separately and may be in process of divorce to him in future. His wife lived with him about 4 to 5 months only and property was purchased / booked before marriage.

Husband withdrew RCR and filed divorce. Prior to this wife filed divorce. Wife filed objections for the withdrawal of RCR petition and went to CRP against the dismissal of the objection to withdraw. HC dismissed the CRP and directed the family court to dispose of both the divorce petition with in 4 months.
Only after of this direction of HC wife filed counter in the divorce petition filed by husband and had made only evasive denial of the allegation levelled by husband.
Evasive denial is deemed as admission in law, can the husband seek judgment on admissions made by wife in the counter filed by her. Will the direction of HC to dispose of both divorce petitions come in the way of seeking judgment on admission by husband and will the husband be compelled to go for trial.
Please clarify. Thanks.

If you are legally married can your in laws or spouse force you for the conventional marriage(Hindu rituals).
Is it crime or cheating not to marry conventionally in anyway?

I had deposited various complaints in police station stating my marriage is based on fraud and concealment of her medical problems viz. Endometriosis , removal of left ovary and right repaired and stated that she had done same fraud with her first husband also . she is a divorced woman. Now, the local police station had appointed an IO SI for investigation.My wife is living in her matrimonial home since after her complaint in CAW cell .I want to know whether I file section 156(3) against my wife and her family members or wait Io to investigate the matter first ? My wife is working in home Minstery Deptt.

Wife filed divorce on self-contradictory allegations, husband in his counter has not specifically stated that the allegations are self contradictory and mutually destructive. Though all the allegations were specifically denied.
Further husband has not stated specifically that wife approached the court with unclean hands in the written statement.
Will this preclude the husband from taking these grounds in his cross examination, evidence and arguments. In other words should all points/question of law be raised in the written statement before evidence and arguments.
