One of my relative (23 yrs) married 8 years ago with already divorced women (34 yrs).
He accepted and legally adopted her child (12 years old).
After 6 months of marriage they both are living separately. he don't know where she is living now, whether she got married or living separately. Her parents also not know about her.
Now we are facing problem in getting divorce because no body knows about her.
Since they both are living separately (no divorce filed) from 7 years whether this could be the legal ground for divorce.
pls tell me the way out how we should approach for the divorce.(legally)

dear expert,
i just got married 5 months back,lived happily for 2 months, but now my life is hell, she dont like my parents and me,she dont respect them, and threatns them for false chrges and send them to jail although she lives with me, we have argument on everyday, she is already divorced(can this help me in my divorce?) , this is her second time but mine first,she wont leave me, and dont want to leave with my parents either she is a doctor and me too,she has good salary , what can i do to get a divorce? i cant spent my life with her. please guide me..

my wife file a dowry complaint in women cell.
And she file a maintence case in saket court in Feb'2012.
and she also file a DV case im tishazari Mahila court in April 2012 in which she demand maintence and 2lakh rupees.
can she file maintence case in two courts.
she is living her parents house from April 2012.
can we apply for anticipetry bail in ground
of DV case for safe my family for 498a case.
My mother disowned me legaly in may 2011.
and i am living in a rented room from last 1 year.
please suggest me.

I HAD FILED NULL & VOID CASE IN FAMILY COURT BUT SINCE 3 DATE HAS PASSED SHE DID NOT APPEARED IN COURT ,HENCE THE JAUDGE FOR COUNCELING FORWARDED THE CASE TO THE COURT,WILL IT BENEFIT FOR ME

Hello. We are both hindus of different caste, married with mutual consent after meeting through a matrimonial site in the year 2002. He is from an affluent family and i am from a lower middle class family. Till date his parents dont accept me as their daughter in law. We have two daughters. Somehow, my husband thinks that I married him for his money. There are lot of other issues like he is constantly scrutinizing me, my dressing, my way of talking, my eating habits..... I used to work in an MNC as Exec. Assistant to MD, had to give up due to pregnancy. My husband didnt complain..After my elder daughter was born, I couldnt take up a job as he travels extensively and there is no support for child care. He used to earn well so kind of hinted that i dont need to work. We bought 3 flats on loan. I supported him in every manner. The money and the signature on the registration would be his, but all the groundwork A- Z was mine for all the three flats. He was keen on buying as he thinks that if money is there in the bank, it would be spent by me. Its been 10 years now and he never bought me any jewellery. He had a severe accident 3 years ago and he was kind of disturbed about the loans and sold off one house to clear some debts. I asked him for one lakh to buy jewellery and he says that I was responsible for the state of financial position. Now he just gives me enough money to run the house, if I save some, he also asks account for that. Now he is asking me to find out legally how much a wife is entitled to? I am totally fed up and think that its better to get a divorce and seek settlement. I am well educated and can take care of myself without his support but I want to fight for the 10 years of my life I dedicated for this marriage. Is asking money for buying a dress or jewellery for self and children a mistake? Isnt buying gold a security for them in the future? He doesnt spend any money on himself nor others. On top of this, continuous nagging about me, my personality, my dressing etc. He doesnt want to come for counselling. Kindly advise.

I need help and guide from all of you about my family matter court.
My case is in the Family court and filled by my wife in march , after receiving the notice from the court i have attended the first counselling and then i have given next day which i have not attended because i was hospitalized for more than a week due to tension and fever. i have not appointed any lawyer for the my case till date . My wife she is taking divorce from me on the basis of dowry and harassment which is not true and i know that her brother and father are misguiding her against me and the advocate who has taken this cast is also misguided may be or may not be either he is misguiding to my wife. i am not that much educated to reply court notice in the english language because i have received court notice in English and i am unable to understand. Due to financial problem i am not able to appoint any advocate for my case even my wife she have filled monthly maintenance of 5000 Rs. from me.
I need guide and suggestion in this case and i am having some queries and request you all to help me.
Q.1 ) My case is in Bandra family court, can i ask to the court/ my wife to provide me NOTICE COPY (i.e. paper submitted by my wife )IN my mother tongue "Hindi" not in English and not in Marathi.
q.2) Can i give the reply to Notice in Hindi Language?
Q.3) I want to investigation of dowry complaint and other complaints in the my case can i request to court for investigation in the matter. and When i can file for investigation ?
Q.4) if my wife found that she and family have given false statement against me then what kind of action will court take against my wife and her family.
Q.5) How i can take help from court i need advocate and counselling but i dont have money to appoint a advocate for my case.
Please guide me.
Q.6) i dont want to go for divorce in any situation i dont want to breakup please suggest me what i do. i want from the court to counselling to my wife. Does the court help me for counselling at home .
Please reply me. also i need more suggestions from your side.

Dear Sir/ Madam,
I am Nomani N Parwez, from Bokaro, Jharkhand State of India.
My sister died on dec 15, 2010, after delivering a baby boy. Just 2 hrs after delivery she died. Now, I have mother 55 years, father 65+ and a sister (unmarried- studying now in college) 21 years approx.
We took the responsibility of bringing up the boy. The guardian of my brother in law suggested / advised to get marry my youngest sister with my brother in law. It was very sad moment for us that time since we had lost our sister. We told the them that we will think on this later. Indirectly they said that we will take the baby if marriage is not fixed. But due to my sister's graduation exam the decision on marriage got postponed one year.
Now, the baby is 18 months old. My sister exam is also over. My sister does not want to get married with brother in law.
When they heard this then my brother in law said ok we will take our baby then.
We are ready to give him his baby, since he is father, but only at the age of 4 or 5. (baby age). Because we want at least the baby should take care of himself by that time, or he can express his wants or requirements or pain to anyone at home. I am writing this because we know the condition of our brother in laws home. Everyone are concerned about themselves. My brother in law are three brothers and father and mother. He is youngest brother. ALl are having their family. They are concerned only about them. When the baby was born (dec month) nobody asked for the baby. It was very cold. My mother , siter and myself took the pain of bringing up the child. and when the bay is 18 mnths old, they are pressurizing now. When my sister was alive she faced many problems.
Is there any way that we can keep the baby for 3 years more. Other wise my sister will be compelled to get married with brother in law.
Kindly Advise. I dont have any other way to get help, because I m working in dubai, construction company, and I will get leave only after one year.
Please advise. we are ready to sign any promise letter to hand over the baby after 3 or 4 years.

Sir/ Madam,
One of my cousin, she is married since 1999, She have 1 Daughter,1 Son Age:13yr & 9 Yrs respectively, Her Husband is a Central Govt. Employee but he don't look after their basic needs, he don't come to home for 10-12 days. He drinks a lot & harass them.
What is the remedial action can we take so that we get rid of him & can she is get some maintenance from his salary monthly.
Kindly reply hoe to get help.

An agricultural land was take around 60 years back by the lessee from lessor. after 60 sixty years whether the property lies with the lessor or lessee.

can a lady filed 498a as the boy filed null & void case in family court & 2 date for counselling has been passed but the girl not apperaed since 1 year case is going on
