Guarantor for loan from pat pedhi

Sir, Please advise,

One of my friend taken Loan from PAT PEDHI. I and my brother are the Guarantors. We are retired from service and now getting pension.

My Friend is also retired person and getting Pension from BPT. But Now he is not paying Loan Installments.

Now Pat Pedhi by Legal Notice directed us to pay the Loan amount since we are Guarantor and our Friend is defaulter.

Please advise.

Can PAT PEDHI recover the Loan from us if Loanee is available and he is getting Pension.

Can PAT PEDHI deduct the Loan from our Account instead of Loan Account.

Registration of property & transfer of title

I purchased a house in the year 1995 in which I was living as a tenant since 1980. The consideration amount was paid to the owner under various installments. Of each and every installment a receipt was given by the owner stating that “the consideration amount in the form of such and such installment has been received”. Similarly the last installment has also been paid to the owner and receipt has been received. Later before the registration of the property as well as before transfer of the title the said owner went abroad and never returned for many years. On several occasions the owner was asked to come to India to register the property but he always expressed his inability to come. In 2017 the owner came to India and he was asked to get the property registered to which out of malicious intension he totally refused and denied that he has ever sold the property. Now since I have been residing in the said property since 1980 along with my family, what remedy do I have to get the property registered? And can the Owner file a suit for my eviction and any other legal remedy which he can avail

Write-off or auc accounts interest calculation

Dear sir,
my uncle taken cash credit (cc) and education loan by mortgaged his house from SBI. up to 2013 he paid the loan regularly. In 2015 the bank declared the loan accounts as AUCA. Now SBI released e-circular "SCHEME FOR ONE TIME SETTLEMENT OF NPA AND AUCA 2017-18 (RINN SAMADHAN)". But bank is telling you are not eligible because of security of your house and is costing more than your dues. After discussed with branch manager my uncle transferred 6.85 lakhs to his saving A/C. In the a/c statement the bank debited it as : TR to AUCA closure" and not showing any A/C number to which it has been transferred.. The manger has gave the calculation on white paper showing: outstanding as on today is 2,45,000/- and interest 4,40,000/-. Still we are pending Education loan. My questions are:
1. Is bank can collect AUCA loan. If it collects then how much interest they calculate and from which date.
2. Can i demand a detailed statement as printed copy including interest rates for the AUC account.
3. "OTS SCHEME" is applicable for these loans, if not why.

Property decree can challenged

Sir. I had property which i developed by taking all permission by the authority in meanwhile relativeshad filled case of partition. After some time they have compramise in it one of among them has already admitted my owner ship in the suit...he has given affidivit as well he has said it written statement same thing.decree passed by sr civil judge in that suit by taking undertaking of all respondence except the the preson of who has already admitted my ownership.but now after 8 yrs same preson approch the court saying that sign of mine was taken faurdly me....nw can that decree may be cancel by the court.?

Earned leave

My friend while she was working in teaching profession , she demanded earned leave for ten days from his principal in July 2012. The principal accepted her demand by taking application. But principal put question marks in attendance register instead of filing earned leave and he deduct ten days pay from his July salary. Principal doesn't report to his higher officials. Now she changed her department .for this she have taken NOC from department. The principal verified this period in her service book. Can she get her ten days arrears now.

Please help me to solve the following problem.

Amit had taken loan from Shyam lal by mortgaging his house for rs 300000 in march 2012 which he had promised to pay by Jan 2013. A year passed after the
expiration of time limit given by shyam lal for repayment of loan, Amit failed to
clear his debt. In Jan '2014, after non repayment of loan, Shyam lal threatens to sell his mortgatzed property (i.e. his house) by 3rd April 2014. On 3rd Feb 2014, Amit writes a letter to his friend, Rohit (a backer), stating his current condition and requests him to clear his debt from Shyam Lal before 3' April. Amit assures Rohit that once he had finished clearing of all the matters he will repay the amount of' debt to Rohit in due time. Amit requests Rohit to clearthe loan as soon as possible. Meanwhile, Amit was accused Dishonest Misappropriation of property U/S 403 of IPC, the trial of which had already instituted inJan201 3, amit is found guilty of the offence and on 23' Feb, 2014 he is sentenced for two years. Unknown to this fact, Rohit sends a letter to Amit on 24`. Feb, 2014 agreeing to pay the mortgage amount and save his house from resale. But the very next day he comes to know about Amit's conviction and thus decides to take no action regarding seting off the mortgage from Shyam Lal as a result of which Shyam Lal sells the house on 3 April, 2014 as he declared. On 4th April, Amit's brother, Sumit (who lived in the same house), informs Amit that Rohit did not clear his mortgage and thus Shyam Lal sold his house to some other person. Amit then asks Sumit to file a suit against Rohit for Breach of Contract .Thus on Amit's instructions; Sumit files a suit for Breach of Contract U/S 73 of Indian Contract Act, 1872.
Note: Indian Contract Act, 1872 is to be referred and give arguments. defendant side.

Adopting husband surname after marriage

Dear Experts,
My wife has adopted my surname after marriage. I got my surname added to her name through central gazette. After that, We Registered our marriage under Hindu marriage act. The marriage certificate bears her name with my surname as well. My query is 1. will she have any problem while doing any higher education or private sector job with her new name. 2. Can we buy joint property now with her new name without any fear?? 3. Will she face any problem in future in inheriting my wealth including mutual funds, epf, ppf etc if I nominate her with her new name.

Time Bond Enquiry

Sir We were Selected as JE in Punjab Govt. in Dec.2015 but in Feb. govt got paper leakage complaints and in 10April 2016 Vigilence registered FIR. But till Today Vigilence hasn't submitted Final Challan in thr Court. It has Been about 1.5 year but still no final report by vigilence. Can we as Succesful Candidates Take any Legal Action Against the Vigilence Enquiry In High Court. bcz I am now overage and cannot fill new vacancies. It has been till Dec.2015 we are waiting for Our Joining.
