dear,
learned members ,i have a question for you, my mother has filed a case against her brothers for share in agricultural land which was purchased by her mother, now the case has been in the court for many years, and my mother wants to write a will in which besides divideing property among her 2 son and 1 daughter includeing myself, now, she wants to give away the share in the property for which she had claim against her brothers, to the son of one of her brothers ,who is very close to her,is it possible that the property which she anticipates that will come to her,( she , wants to give her nephew the said property if the property comes to her even if she is not alive) she is severely ill, and has no hope that she will recover , do shed some light on this matter!

lawyer fees

My lawyer charges me fees at 10 times the going rate in CASH just a day or two before the hearing date without giving me any receipt or at times on my insistence tells a clerk of his to sign on a plain piece of paper without any revenue stamp. though I have already paid him handsome advance engagement fees. Then he sends me a Bill on email without acknowledging the cash payment I have already maid to him.

Can he trouble me at a later date ? I am based in another city. Can he stop me if I want to change my lawyer ? Are there any fixed rates for lawyers fees ? Justice it seems is so very expensive that I may have to give up my case because the lawyer is fleecing me and blackmails me on the day or two before the hearing date and forces me to pay cash. How can I check him ?

partition of the property

Respected sir
We are five legal heirs of our late father who died instate. four of us do not want parttion in the house. it is not the ancestral house,it is built by two of the heirs after the death of the father. Rest of the four heirs are willing to give market value to the heir who is demanding partition.

Is there any provision in the property law that can prohibit partition?

i am a decree holder in EP petition.now we have attached many property of defendent. defendent has to pay me 2 lack rupees. he is getting 50000 per month from his agri and lorry business but he is asking 15 installments to pay for me.how can i prepare pettion or application to pay in 3 installments.please send model petition

sir, my question to the legal experts is that, whether is it possible to give power of attorney for registering release deed and if yes , in what circumstances , and in this case , does the power of attorney needs to be registered......?

CAR ACCIDENT :: TRAVEL ABROAD

Hi Sirs,

I am indeed glad that the lawyers have formed this site so common people like us could ask our queries without much hurdles. I am a medical student who is studying abroad, who had come for vacation & intend to leave back on the 25th of this month. I would appreciate if anyone can guide me with the following issue.

2 days ago, while I was driving my Scorpio (Complete documents & Third Party Insurance. Ownership - In my moms name) in the city, packed with traffic, I happen to bump on the right side of a brand new Maruthi Swift (Full cover insurance. Registration of another state) during its sudden braking. There is a dent on the right bumper & the tail-lamp is cracked on the swift & my car, the front left indicator & bumper is slightly affected. To avoid further traffic jam in that rush hour & to save time, both we drivers decided to meet regarding the issue in a day or two as both of us were busy at that time.

Yesterday, the car was taken to Maruthi Service & the swift repair cost estimate is about 25000 out of which 95% will be covered by the claim & remaining the customer has to pay approx 2000. I had informed the swift owner that i would pay that amount; which the owner refused & demands more money from us, though the insurance would cover the damage.

Now, they want to make it into a police case, though there are no witnesses for the incident nor any casualities. So, this is my query: is there any problem for me travelling abroad, if there is a police case that is rised up against me? is there any way to avoid this (can my dad be mentioned as the driver instead of me)?

I would be really thankful if anyone can guide me regarding this issue.

Correction of Plot No

Respected Experts,
I purchased a land thro registered sale deed in 1984. Which is in my possession and being cultivated by me. No one has any objection. Now when I read the deed carefully I observed a discrepancy regarding plot no. it is written 1010, but actually it should have been 1024. Other things like Khata No. description of boundary and area purchased are correct. This land is situated adjacent to my another plot 1025. Actual plot no 1010 belongs to other person. He does not know about this. The land is situated in a district town of Jharkhand. How it will get corrected? Plz, advice Thanks to all.

Maharashtra Cooperative Society Act

We have filed DV Case against Homos*xulal husband. They sent two notices to him but he rejected these notices. Now DV office said us that they will do wireless and call him and if he fails to come then they will give permission to us for filing 498 A against him.

But our lawyer said on the basis of that we can put a case in court for DV. I just wanted to know can we file DV case through Court. and what would be the actions Court would take against him......
