NI Act 138

my client is a transport owner.

some person had stoled one truck with loaded goods total worth Rs.11,32,000/-

He was arrested by Police. then after one of his friend had given a cheque worth rs 7,00,000/- regarding surety against the said theft. after passing of time the transporter had deposited the said cheque in bank.

the cheque was bounced with insufficient balance.

can we proceed under NI Act?

We have already issued a statutory notice to the guarantor....

what should be next?

ex-parte

when an apllication for setting aside ex-parte order does not mention the date and source of knowlege of the pendency of lis.what wud be the legal effects?

POA For executeing release deed .


just want to ask as to whome power of attorney can be given to register release deed,( besides blood relatives) in favor of brothers. because of medical reasons. is there any other way of executeing release deed .

Rectification Deed

Hi...I want to ask that
1) WHAT ALL IRREGULARIIES IN THE MAIN REGISTRATION DEED ARE NOT RECTIFIABLE?
2) IF A DEED OF ASSIGNMENT HAS BEEN REGISTERED ON THE BASIS OF THE POWER OF ATTORNEY CONSISTING MANY IRREGULARITIES REGAURDING AREA (WHICH EXCEEDS THE PRACTICAL SITUATION),AND FINANCIAL IRREGULARITIES AND THE RECTIFICATION IS MADE AFTER IT HAS BEEN OPPOSED BY THE EXECUTER OF THE ATTORNEY THROUGH A NOTICE TO THE PEOPLE INVOLVED IN THE TRANSACTION INCLUDING THE SUB-REGISTRAR. IS THIS LEGAL ?

need your advice

My mother had brought a house by self earned money. She made a will in favour of her grand sons.But unfortunately due to ignorance she did sign only on the last page and not on all the pages and the will was also not got registered. Me and my brother are the only legal heirs of my mothers property.

I request you to kindly advice me that being an aunt what deed should I do to transfer my share of property in the names of my nephews as decided by my mother in her WILL. Because I have apprehensions that my husband or my son may ask a share in this property but I want to follow my mother's wish.

I have taken advices from some lawyers who asked me to do relinquish deed/ release deed/disclaimer deed and some ask me to do NOC. Please advice which deed should I do through which my rights can directly be transferred to my nephews since my brother also does not want to take this property in his name .

Can me and my brother both transfer all our rights in the property to my nephews through a single deed?

when leave to defend is refused but suit is not decreed under order 37 rule 1and 2 C.P.C and judge has called the evidence of plaintiff what would be the remedy against order of refusal?remember decree is not passed

Change of OP 2(MC of CHS) pending hearing

I have filed a case against a builder and office bearers of CHS in District Consumer Forum and the matter is posted for submission of written arguements by OP2 ie CHS. However, recently the General Body elected new MC and hence change in Office Bearers, who had originally submitted evidence on oath before Ho'nble Forum. My query is that if the new office beares are representing in place of earlier people, can I object of their authenticity on grounds like proper resolution of AGM, approval from the Registrar, submission of Indemnity Bond or for any other technical ground ?

regarding partition

sir,
1. is grand son or grand daughter can claim the partition over maternal ancesteral property?

2. my problem is one of my friend mother is no more, but her father ( his grand father) has property in bangalore, can my friend ask or file suit for partition against his maternal uncles?


3. in such a case how i can ask the property with his uncles?

4. sir,there any impediment to ask property to the female who married before 1990 ?

5. what will be court fees for partition?

6. what is the court fees for declaration of property?

2) Difference between vindictive damages & exemplary damages as per the indian contract act.witht the suitable examples or any case laws.
