Title disputes

Sir.,
This belongs to Andhrapradesh pattadar passbooks act-1971.
we say "X" have purchased the 2.15 acres land in year 1964-65 on sada bynama and from that time my names are recorded in pahanis. and year-2003 approached MRO for pattadar pass books and XIII-B CERTIFICATES. After conducting enqiury by MRO and issued pattadar passbooks, title deed and XIII-B certificates. but opposite party say "Y" approached Joint collector for cancellation of said Title deeds, Pass books and XIII-B. Then joint collector cancel the Title deeds, Pass books and XIII-B and felt that there is a dispute on land title, MRO or RDO or Joint collector is not deciding authority and directed the parties to go to civil court and civil court will decide the title of the land.

Now my question is
1. Who is go for the civil court whether "X" or "Y"
2. Is there any time limit for above.
3. If answer for (1) is "y", and he is not interested or willing to go civil court due to poor evidances in that case what is the remedy .
4. Joint collector cancell the MRO order i.e., Pass Books, Title deeds and XIII-B
what is the status of the land whether the land belongs to "X" or "Y".

Thank you sir.,

Validity of documents.

Dear Experts of the forum,

I WISH 'ALL THE L C I MEMBERS', "HAPPY SANKRATRI".

In a sale transation,a GPA holder Mr. 'BR' of a property enters in to an agreement with a person Mr.'NM',aceepting the fact that he had received total consideration and declares that he will attend to the registration office to signe the deed when ever Mr. 'NM' calls him ,this happened in the year 1968. but registration had not taken place.

In the same year Mr. 'NM' sales 40% of this property to Mr.'AR'. and balance60 % of the property was sold ( in the year 1980) to Mr.'PV'.using the same wording as used by Mr.'BR' as explined above.

In the year Mr.'AR', applied to the revenue authorities(During this time AP state had given a chance through a GO for regularisation of such trasactions) saying he has unregistered sale deed and wants revenue authorities to regularise the same .The REV authorities had issued notice to Pattedars and to legal hires of Mr.'NM',the legalhires of Mr.'NM' confirmed the existance of the document but the Pattedars abstainedthemselves from the proceedings and Revenue authorities made a note of the same(made Pattedars as exparte) and regularised the same after collecting the due amount as per rules.

Mr.'PV' did not used this oppurtunity, but the land is under his occupation even today. Mr.'BR' died in the year 2003.

{As on today this property along with some other properties passed on to some one else through a WILL.Case is going on in a CIVIL COURT among the family members for partition.}

My question is, who is the owner of the above dicussed property.(i)What happens to the property of Mr.'NM', regularised by Revenue authorities? (ii) can Mr.'PV' clim rights on land in his position.( As thease properties flown to thease person through a GPA.)

Thanking YOU ALL in advance, with a requst to go through my above QUERY and GUIDE me.

Regarding will

Sir,
I Uncle who was unmarried made a register will in favor of her sister who is also unmarried. After making of this registered will( after 6 months) he purchased a flat, for which he made notorised will, which is also in favor of her sister. My question is can both wills are legally o.k. Properties in both wills are separate. The property in notorised will is purchased after making of registered will. Also in 2nd will he has clearly mentioned that register will also remain valid. My uncle expired in jan last year. Please guide.

Non payment of dues

We have supplied to one of clients about 3 years ago but not received the payment till date. Every time the client states that his payment is blocked and not paid by his customers due to which he is unable to pay us. After waiting for 3 years, now we have concluded that we'll go legal against this client. But unfortunately we lost all the invoices, purchase orders given by the client. We have only 1 balance confirmation letter given by the client in Aug'10. My query is that can we file a case against the client with this a proof of outstanding? What are my chances of getting the money?
