How to get justice in civil case

If a person is filed a civil case in court regarding based on grounds of GPA to be prooven as it is denied by the gpa given person,
Due to our advocate was in understanding with opposite party, he played the vital role in turning the case instead of getting justice, as the party is on full faith with him. He repeated the same role in the high court also. Hence due to both courts have seen only the orders of lower courts and repeated the same order, and also supreme court dismissed the case under same views.
Hence now the poor party is requesting for justice.
Hence the moral of justice is GPA is no where questioned and prooved, without prooving it, the case was dismissed.
Hence please show the way to get justice.

Encroachment of my site by neighbour in bangalore

I need guidance on how to save my property in bangalore from a landgrabber neighbour. My site was encroached by a neighbour who claims to be a major in the Indian Army..he has built a shop etc on my part of the land about 400 sq ft of my land. I have documents to prove the land is mine, he has not shown any documents till now. He threatened my parents. We complained to the Police and got a stay order from the Civil court with the help of a lawyer. My aged parents are running from pillar to post as Im unable to run behind this as I work in Chennai. Police in that station say that we need to be tough and use force otherwise no one can help.. we dont have that kind of influence. Since we are not able to get the address of these encroachers(they live elsewhere), we are unable to deliver the stay order to them. What can we do? Any suggestions? how long will it take for the court to decide on this matter?

Stay of execution proceedings

sir, a collaboration agreement was entered between A(Owner of land) & B(Builder) and was agreed that both the parties will share equal amount out of sale or rent. after completion the property was vacant, and A filed a suit for recovery of possession, rent, damages wherein B was proceeded exparte. suit was decreed exparte in favour of A and eviction orders were passed against B. now bailiff has been appointed in the present execution. B did not appeared in execution also. however the property is in possession of C. and he has nothing to do with these cases. C filed its objections but they were dismissed, C went into appeal, which was also dismissed. C went to Highcourt for stay of exccution but that was also dismissed. in the mean time C filed a suit for declaration & PI against A which is at the stage of evidence. now my questions are:
1. what remedy is available to C for staying the execution proceedings as he was a bonafide purchaser.
2. what course of action shall be adopted by B to get the execution proceedings set aside.

Rent control act

1) Is there any rent control act in Noida, Uttar Pradesh for residential premises?

2) Is any rent control act applicable for the usual 11 month lease agreement done for residential premises in Noida, Uttar Pradesh?

3) With help of these ultra short lease agreements of 11 months with clause of 1 month notice for eviction have taken the form of racket wherein the landlords in conspiracy with property agents ask to evict whenever they get another tenant paying more rent. Moreover this frequent eviction of tenants at sweet will of landlords has led to skyrocketing of rents for residential premises since whenever a new tenent is let in, he is always let in at a much higher rate than before. Is 11 month lease agreement with provision of 1 month only notice of eviction bad in eyes of law or Article 21(life of dignity)? Since no dignity of tenent, constantly living a life of vagabond with Damocles Sword of 1 month eviction notice constantly and permanently hanging on his head even before 11 months.

Rent control bonfide case - what can i do?

Hello Gentlemen,

I filed a case against my tenant under the bona fide category, I won in the H’ble Lower court in 2010, and tenants’ petitions were also dismissed in both H’ble High Court and H’ble Supreme Court. In addition, couple of months before the final judgment from the High Court, we got an order based on Atma Ram Properties (P) Ltd. vs. Federal Motors Pvt.Ltd., (2005), which ordered the tenant to pay sum of Rs. 25,000 per month from the date of passing of the impugned eviction order till the disposal of this petition, in case of default, the petitioner shall become liable to be evicted forthwith. Till date we haven't received a dime. And, when the final outcome was decided in H’ble High Court the judgment just simply dismissed my tenant’s petition, as there was no infirmity found in the H'ble Lower Court orders). However, the orders did NOT say anything about the arrears (tenant did not ask for any time to vacate either, funny). Immediately, my tenant filed a petition in H’ble Supreme Court, and below are the orders, his petition was again dismissed, and still the order say nothing about the arrears. Can I get the eviction orders based on non payment of arrears even though H’ble Supreme Court has given my tenant one year to vacate, please see below? Your expert suggestions/comments will be very much appreciated and highly regarded. Thanks,
Sumit Kapila

H’ble Supreme Court Order, Came in today:

We find no ground to interfere with the impugned
order. The Special leave petition is dismissed.
However, as prayed for, one year's time is granted
for vacating the premises upon filing usual undertaking
in the Registry of this Court within four weeks from
today.
